The authors examine the future of public service broadcasting in the context of current debates about, and commercial pressures on, the BBC. They describe the European Community constraints on public service broadcasting and the need for a clearer definition of such broadcasting, noting that such a definition is not currently provided in UK law. The BBC is also under increasing pressure from fair trading rules derived from competition law, some of which may weaken its ability to deliver its public service mission. Original research undertaken within the BBC suggests that external and internal pressures have undermined the conditions for a distinctive public service output, although there remains the basis for such an output within the culture of programme-making. The authors develop theoretical bases for a redefinition of public service broadcasting centred on the principles of citizenship, universality and quality in relation to services and output, and examine the implications for the structure of channels in the digital era. Finally, the authors discuss the legal and regulatory implications of their analysis in the context of the Government's Communications White Paper, arguing that the social and cultural purposes of public service broadcasting must not be made subordinate to competition-based concerns.  相似文献

Jane Ellen Harrison (1850–1928) and Virginia Woolf (1882–1941) are two of the most iconic figures in British feminist history whose enduring influence have helped create and sustain a multitude of feminist discourses. Interestingly, both produced their landmark feminist studies in Cambridge when it was, arguably, the most aggressively anti-feminist institution in Britain at that time. Evidence of the kind of institutionalized disciplinary control Cambridge historically exercised on women can be found in the three Committals books (1823–1894) of the Spinning House (1631–1894) in the University archives. So called because the inmates were given wool to spin, the Spinning House was a penitentiary for young girls who were judged to be compromising the morals of the undergraduates. The Spinning House had its basis in the legal authority of the University which declared ‘That the University by virtue of their Charter sanctioned by Act of Parliament, have an undoubted right to cause the Public Street to be inspected, and loose and disorderly women to be taken up and sent to the Spinning House or the house of correction’. Against the background of the culture encapsulated by the Spinning House, women academics, in the late nineteenth and early twentieth century, were making tremendous efforts to bring about intellectual equality. And though the two—the spinner and the woman student—occupied mutually exclusive spaces, they were nevertheless held on the margins of the power structure that produced both. This paper examines the socio-historical context and the puritan intellectual politics of Cambridge against which feminist theories of Harrison and Woolf were produced to identify some of the methods with which they negotiated masculine orthodoxy and structured their feminist discourse of alterity.  相似文献

G.A. Cohen criticizes Rawls’s account of justice because his difference principle permits inequalities that reflect the relative scarcity of different skills and natural abilities. Instead of viewing the ‘basic structure’ as the primary subject of justice, Cohen argues that individual citizens should cultivate an egalitarian ethos, which would enable a just society to dispense with the use of incentive payments to induce individuals to use their talents in socially ideal ways. This study examines Cohen’s critique, including his rejection of ‘incentives,’ and vindicates Rawls’s approach. Ultimately, Cohen’s argument fails to grapple with the moral pluralism that characterizes modern, democratic societies, whereas Rawls’s theory is constructed to accommodate such pluralism.  相似文献

The authors build on the summer 2005 The Journal of Arts Management, Law, and Society article "Muddy Waters: Consigned Artwork and the Vagaries of the Legal System in Massachusetts," which discussed the Consignment of Fine Art Law in Massachusetts. Since that time, revisions to the law have been enacted, in reaction to high-profile cases and a desire in the Massachusetts legislature to streamline the economics of the gallery system. The article presents a study of neonatal tetanus on the tiny island of Vestmannaeyjar (Iceland) during the 18th and 19th centuries. At an early date, Vestmannaeyjar was known for its high levels of mortality from neonatal tetanus. This appalling mortality is analysed, inter alia, on the basis of parish registers at the individual family level. During the late 18th and early 19th centuries, more than three out of four newborns on the island died during the first 2weeks of life. At the beginning of the 19th century, Icelandic and Danish authorities had already showed great interest in improving infant survival on Vestmannaeyjar. In 1827 a physician was appointed to the island and by the late 1840s the disease was successfully fought on the island. The achievement on Vestmannaeyjar is a good example of how the sanitary movement was able to bring about important improvements in infant survival long before the breakthrough of the bacteriological revolution.  相似文献

This article shows how party competition has influenced reforms of unemployment benefits in Germany. The existing literature on German labour market policy emphasises institutional factors and predicts policy stability. Consequently, the recent fundamental reforms (‘Hartz reforms’) pose a challenge to previous research. By looking at the spatial configuration of the party system and at policy demand, this article argues that the incremental retrenchments of the 1980s and 1990s were conditioned by centripetal competition and a high degree of welfare consensus, whereas the more radical Hartz reforms were made possible by a limited shift in public opinion in favour of restructuring and the lack of a left-wing counterweight in the party system. Thus, the structure of the party system exacerbated the effect of a demand shift that was only moderate. The analysis is not meant to discard other explanatory factors, rather it intends to demonstrate the relevance of party competition to the study of labour market reforms in Germany and, more generally, to comparative welfare state research.  相似文献

Abstract

This article begins with a brief discussion of the three terms: the poet, ontopoiesis and eco-phenomenology or phenomenological ecology. An explication of its thrust, viz. the significance of sowing/sewing ‘a quilt of harmony’ (Wild 2012: 20), in relation to the broad yet symbiotic theme of cosmic ecology follows. The discussion proceeds by presenting a close critical analysis of Ben Okri's ‘Lines in Potentis’, a poem commissioned by the then Lord Mayor of London in 2002 in commemoration of the bombing of the City of London and which is featured in Okri's most recent anthology of poetry, Wild (2012: 26-27). Both my thrust and my argument are predicated on another occasional poem from Wild, ‘A Wedding Prayer’ (2012: 20-22), which is not analysed in any detail. Axiomatic to the interpretation is the poet's own conception of ‘wild’, cited on the dust cover of the anthology, as ‘an alternative to the familiar, where energy meets freedom, where art meets the elemental, where chaos can be honed’. More precisely, for this London loving Nigerian poet, ‘the wild is our link with the stars…’. This is not aesthetic posturing. As I attempt to show in my reading of the focal poem, it has to do with mystical unrest viewed from an eco-phenomenological ‘enjoyment of literature, of beauty, of the sublime, the elevated, as well as our compassion for the miseries of humankind, [and] generosity towards others.. inspired by the subliminal passions of the human soul’ (Tymieniecka 1996). As the conclusion attempts to show, this projects some of the epistemology of Africans in Africa and the Diaspora. It does this by invoking the contentions of fellow African phenomenologist, Achile Mbembe, in comparison with Tymieniecka's argument that the soul is the ‘soil’ of life's forces and that it is thus the transmitter of life's constructive progress. Such progress is from the primeval logos of life to its annihilation in the anti-logos of man's ‘transnatural telos’ (Tymieniecka 1988: 3).  相似文献
