大数据时代,匿名化规范既是个人信息保护中风险预防的手段,也是我国数据经济发展中数字流通的法律基础,但匿名化的法律标准在我国法律中还有待明确。欧盟已通过《一般数据保护条例》提出明确的匿名化标准,但该条例基于流程设置的标准适用于欧盟境内尚可,适用于我国或显得过于严苛,有碍数字经济的发展。我国个人信息匿名化法律标准与规则的重塑应当考虑环境、再识别风险,建议进行功能性匿名化。将比例原则应用到我国匿名化法律标准和规则的重塑之中,并将其引入到评估匿名信息接收者的风险等级,有助于降低个人信息被再识别的风险亦有利于匿名化的法律标准制定和规则构建。  相似文献

美国金融危机到底以何种方式在全球传播,以至于演变成全球经济海啸,一直是近几年学术界所关注的问题之一。本文以美国金融危机对外传播的贸易传染渠道为切人点,分析了美国金融危机通过贸易伙伴型传染和贸易竞争对手型传染这两个贸易传染子渠道对东亚新兴经济体的溢出程度。对面板数据进行的GLS实证结果显示,美国金融危机通过贸易传染渠道的溢出,与大部分东亚新兴经济体经济波动之间存在10%以上显著性水平的相关性,因而贸易传染渠道是美国金融危机对东亚溢出的一个重要机制。  相似文献

侦查模式是侦查的最一般路由,侦查人员借助其对案件侦查形成基本的工作思路.当前犯罪出现了动态化、智能化、组织化的异化现象,处于基础性地位的反应型侦查模式在应对犯罪异化时遇到了困难.本文研究反应型侦查向主动型侦查转型的相关问题,借助了大数据对于行为、事件的预测功能扩展了原有的主动型侦查模式适用的外延范围并厘清了其在适用时所要解决的与反应型侦查所不同的法律问题.  相似文献

Despite the substantial body of research on the psychological and social effects of racial segregation in schools on African Americans, few studies have considered the possibility that more racially inclusive schools might reduce the risk of extremely negative adult life experiences such as incarceration. Yet such a connection is made plausible by research linking black racial isolation in schools to variables that are often associated with incarceration rates, including concentrated poverty, and low educational and occupational aspirations and attainment. In this paper, we apply methods first developed by labor economists to assess the impact of racial inclusiveness in schools on individual incarceration rates for 5‐year cohorts of African Americans and whites born since 1930. We find strong support for the conclusion that blacks educated in states where a higher proportion of their classmates were white experienced significantly lower incarceration rates as adults. Moreover, our analysis suggests that the effects of racial inclusiveness on black incarceration rates have grown stronger over time. These longitudinal effects are consistent with the argument that the educational climate of predominantly black schools has deteriorated in more recent decades.  相似文献

In order to promote the development of its industrialization, we should make clear the regulatory model of utilitarianism of big data in public health care, and settle the conflict between the active utilization and the principle of informed consent. China's legislation ought to encourage the active use of big data in public health care, so as to settle the conflict between the use and protection of big data in public health care through the flexible use of the principle of informed consent and the introduction of alternative or supplementary protection mechanisms. And we should guarantee thatthe big data resource will be applied appropriately.This article also presents a systematical classification method of big data in public health care, clarifies principle stipulations, and discusses some exceptional cases.  相似文献

对于互联网平台公开数据的保护不宜采取赋权的强保护模式,应当采取反不正当竞争法的行为规制模式。激励理论与公地悲剧理论不能作为互联网平台公开数据赋权保护的正当性基础,赋权保护无法满足数据权利的法定性与透明度的内在要求,强行适用赋权保护会过度妨害数据市场运转、数据技术提升、科学研究以及数据共享。运用反不正当竞争法保护互联网平台公开数据时,须转变数据保护的思维理念,摒弃司法实践中的权利侵害式裁判模式,回归对互联网平台数据竞争行为自身的正当性评判。在一般性条款的适用过程中,司法裁判者应秉持反不正当竞争法的谦抑性,并借用比例原则对互联网平台数据竞争行为的边界进行限定,维持不同数据相关主体利益以及公共利益之间的平衡。  相似文献

《欧盟一般数据保护条例》(GDPR)率先在个人数据领域赋予数据主体数据迁移权,成为全球数据保护的立法标杆。数据迁移权的诞生为企业参与数据竞争正向赋能,企业竞争中也存在诸多数据迁移障碍。本文结合欧盟数据迁移权的相关规定,以数据、数据迁移权和数据竞争三要素之间的互动关系为进路,通过剖析数据迁移对企业竞争和创新发展的双向反馈,认为我国不应急于实施数据迁移权,而是将数据迁移权定性为一种柔性权利,按照"三阶段五步骤"的路径规划,逐步建立符合我国国情的数据迁移制度。  相似文献

In forensic identification, the use of foot dimensions to predict stature is a requisite. For Taiwanese male stature prediction, available information about stature estimation using foot dimensions is still lacking. Therefore, the primary purpose of this study was to establish Taiwanese adult male stature prediction models for various foot dimensions. A total of 2,072 male 3D foot models were collected and the subjects' ages ranged from 18 to 59 years old. Thirteen foot dimensions for each foot were utilized in this study. Bilateral differences were tested using paired t-tests. Stature predictions based on different foot dimensions were conducted using simple linear and stepwise regression methods. The results showed significant bilateral differences in the majority of the selected foot dimensions (p < 0.001). Foot length had the highest positive correlation with stature in the right and left foot. Using length-related dimensions generated better prediction accuracy (0.356 < R2 < 0.533, 4.193 < SEE < 4.928), whereas the worst accuracy was observed with angle-related dimensions (0.001 < R2 < 0.023; 6.072 < SEE < 6.137) when employing a single foot dimension to estimate Taiwanese male stature. Stepwise regression analysis results indicated that the coefficient of determination was improved to 0.590 and 0.593 by applying five and six foot parameters to predict stature, respectively. The findings of the present study suggest that these stature estimation equations can be applied to predict Taiwanese male stature in the forensic science field.  相似文献

Abstract

International attention to the benefits of openness for empowering citizens, strengthening economic performance and ending poverty has emphasised the importance of achieving accountability and transparency through freedom of information and open data. The ability to achieve openness depends upon the quality, completeness and accessibility of government records and data. However, chronic problems in managing this information in many Commonwealth countries, particularly in the digital environment, undermine the ability to achieve these goals. There is a critical need to develop and share solutions for managing this essential resource as a basis for digital governance across the Commonwealth, especially in relation to the post-2015 Sustainable Development Goals.  相似文献

The study of external interventions in conflict management is critical and has implications for international relations and conflict theory. Quantitative studies of the relationship between external interventions and civil war have been prone to some conceptual limitations (understudied lower-intensity periods) and data limitations (unavailability of event battle death data). This article presents a new external interventions data set covering the period between 1989 and 2010 for Africa, building on the Regan et al. (2009) data set, which covers the period between 1945 and 1999. Novel features of this new data set are: the recoding of the overlap period; a broader range of categories of intervention, including UN and non-UN missions; and wider temporal scope, by extending the period of analysis to 2010, by lowering the civil war threshold to 25 battle deaths, and by starting the conflict period from the date of the first battle death in each civil war (based on UCDP GED version-1.5-2011). The advantages of the data set are illustrated with an analysis of the different effects interventions have on high- and low-intensity conflict periods.  相似文献
