法国公务员行政赔偿责任制度评介

公务员行政赔偿责任涉及到行政相对人、公务员和行政主体三方的关系,是国家赔偿制度的重要组成部分,法国公务员行政赔偿责任制度历经发展,形成了以"个人过错"为核心的、允许行政相对人直接向公务员求偿的行政赔偿责任制度,并通过一系列判例确认了各项具体制度,易于操作,达到了合法性与效率之间的理性与平衡.     

北京地区人群(汉族)人血清备解素因子B分布频率的调查及其在血痕中的检出

作者采用琼脂糖凝胶高压电泳、PAGIEF及免疫固定技术测定了北京地区234份健康人(汉族)血清Bf的分布。其表型频率为SS171人,FS49人,FF8人,SS07 4人,FS07 1人及SS045 1人;基因频率为Bf~S=0.8462,Bf~F=0.1410,Bf~(S07)=0.0107,Bf~(S045)=0.0021。Bf表型分布与Hardy-Weinberg定律相吻合。经测定室温保存的已知Bf型的22份血痕,其可检出时限为3周。并将Bf型测定用于检案的血痕分析及亲权鉴定。     

Beliefs About Wife Beating Among Arab Men from Israel: The Influence of Their Patriarchal Ideology

Despite the recent increase in public and professional interest in the problem of wife beating in Arab society, in Israel, and in the rest of the Arab world, there is a serious lack of empirical research on different dimensions of the problem in those societies. This paper presents the results of a survey conducted among a systematic random sample of 362 Arab husbands from Israel, in an attempt to examine the contribution of patriarchal ideology toward explaining their beliefs about wife beating. Although about 58% of the participants indicated that there is no excuse for a man to beat his wife, 15–62% still justified wife beating on certain occasions (e.g., adultery, failure to obey husbands, disrespect for parents and relatives). In addition, although the participants tended to perceive abusive and violent husbands as responsible for their behavior, 52% still expressed understanding of that behavior and, on some occasions, 23–43% even blamed the wife for violence against her. Regression and multiple regression analyses revealed that over and above the participants' age and level of education, their masculine sex-role stereotypes, negative and traditional attitudes toward women, nonegalitarian marital role expectations, and familial patriarchal beliefs were the most significant predictors of beliefs about wife beating. Implications of the results and limitations of the study are also discussed.     

Corporatism packaged in pluralist ideology: the case of Slovenia

Corporatism has been an influential doctrine in the Slovenian polity since its beginning. After the onset of democratization in the early 1990s, its influence remains strong. Forms of corporatism are embodied in the National Council as the second chamber of parliament, in the chamber system, the system of social partnership and the RTVS (Public Television of Slovenia) Council. It is also present in certain socio-political priorities such as a higher value being placed on partnership over competition, on fairness over human rights, on community over individualism. Social pluralism has always been a part of Slovenian public life. Political pluralism emerged at the end of the 19th century and was never fully developed. There has always been a strong inclination in the political life of Slovenia to organize around interest groups and editorial boards of various publications, a tendency that reveals a plurality of voices but a general unwillingness to fight for political power. It could also be concluded that the development of pluralism in Slovenia relies heavily on corporatism because of the general lack of liberal foundations.

治安管理处罚中引入社区服务令制度可行性研究

随着行刑社会化、行刑轻缓化及恢复性司法理论的不断发展,社区服务令制度得到国际社会的广泛认同,并被很多国家引入作为针对轻罪的行刑方法。社区服务令制度不仅在刑事司法领域具有重要的制度价值,在行政处罚领域也有大可为之处。当前,可行之处是将社区服务令制度纳入治安管理处罚领域,需要对其在概念上重新进行界定,在此基础上构建一套符合我国国情的社区服务令制度。     

浅谈侵犯网络游戏虚拟财产的责任承担

随着网络游戏业的迅猛发展，侵犯网络游戏虚拟财产的案件出现得更为频繁，矛盾愈发激化，然而当前我国法律法规还没有对如何保护网络游戏虚拟财产权利作出具体规定。为了建立和完善网络游戏虚拟财产权利的保护机制，有必要对网络游戏虚拟财产的法律属性及权属作出界定，同时厘清用户与网络游戏运营商之间的责任承担。     

依据Marshall和Hoare的数学模型推断死亡时间的新方法

在对Marshall和Hoare的尸体直肠冷却数学模型做进一步研究的基础上,建立了一种适于在环境温度为3°～24℃时推定死亡时间的新方法。用本法检测34具机械性损伤尸体与国内的两种计算方法比较,效果较优,于死后15小时内进行168次计算,误差在±1小时内的为57.1％～77.7％,它能较好地反映个体差异,因而比Marshall等的原方法更能客观地反映直肠冷却规律。     

小儿感染与多系统器官功能衰竭──附12例临床及病理分析

本文对１２例小儿感染致多系统器官功能衰竭死亡病例进行临床及病理分析。临床表现有发热、外周血白细胞总数增高、心率增快、呼吸困难、呕吐、意识障碍、无尿等。其中发生二器官功能衰竭３例．三器官功能衰竭３例，四器官功能衰竭６例。病理学检查见多器官组织内炎细胞浸润；脏器充血、水肿、出血、ＤＩＣ形成；肠粘膜变性、坏死：淋巴免疫器官病变等。本文在形态学上进一步证实了多系统器官功能衰竭发生的炎症介质学说、微循环障碍、肠源性感染和免疫机能下降的综合作用机理。     

人格理论视角下的宽严相济刑事政策

宽严相济的刑事政策是党和国家在建设社会主义和谐社会过程中提出的刑事司法政策,在贯彻过程中应当注重与建设和谐社会的背景相适应,调动一切积极因素打击和控制犯罪.为此,我们应当结合人格刑法理论,在定罪、量刑与行刑时,充分考虑行为人的人格,抛弃传统的刑罚万能观念,该宽则宽,该严要严,二者结合,充分发挥刑事政策的作用.
