公共政策中的集团决策模型及在我国的适应性

如何制定出科学有效的、反映各方面利益并为社会所普遍认同的公共政策,是所有现代政府所面临的基本问题以及获得政治合法性的关键所在。通过描述社会政治现象,分析政府行为,探讨集团决策模型的起源、基本内容、主要缺陷及其在我国现实政治中的发展等问题,建立起公共政策决策中的集团决策模型的基本理念和分析框架,可为我国公共政策决策的科学化和民主化提供有益的思路。     

Convergence Criteria for Participation in the Flexible Mechanisms of the Kyoto Protocol

We suggest a multi-layered system of three convergence criteria – similar to those used in the run-up to the European monetary union – that define the notion of "demonstrable progress" towards reaching the emission commitments under the Kyoto Protocol. These are the existence of an independently evaluated national emissions inventory, the level of domestic policies and measures, and the quantitative convergence of emissions towards the Kyoto target. While the first of these criteria constitutes a necessary condition for use of the Kyoto Mechanisms, the other two should determine the degree of participation allowed for any given Annex I country.

监狱人民警察作为一个特殊的职业群体,集多种社会角色于一身,易产生心理冲突。大量研究表明,心理健康问题正严重威胁着监狱人民警察的生存状态,极大地降低了他们的生活质量,并严重影响其工作热情和效率。加强监狱人民警察心理健康问题研究,构建与完善监狱人民警察心理健康保障机制,具有十分重要的理论意义和实践价值。     

从沙尘暴防治看立法理念的转换

近年来沙尘暴事件频繁发生、社会危害严重,引起全社会的高度重视.我国颁布实施的《防沙治沙法》以防沙治沙为目的、被预期能直接应对沙尘暴,但法律治理效果甚微.这需要我们反思环境立法理念.从源头上看,沙尘暴的表现形式为自然灾害,但人类对自然界的严重破坏行为是原因的主要方面.因此相应的立法理念、思路和重点就必须重在对于人的行为进行控制,需要治沙但更为重要的是在立法中引入人地协调的理念.理念的转换带来相应的制度的完善,解决现有的防沙治沙的问题、实现其立法目的,其根本上还要在防沙治沙法中突破原有单项思维模式,引入综合决策方式.     

论保安处分：制度、反思与重构

保安处分制度源于19世纪的欧洲,具体包括决定制度和执行制度两方面的内容.目前,我国的保安处分制度一定程度上存在着决定制度合法性和执行制度合理性的问题.本文从保安处分的基本制度入手,分析了我国保安处分制度本土化和保安处分移植过程中存在的问题,在此基础上对保安处分制度进行了重构.     

违宪判决的形态

宪法审查的一个重要功能就在于保障宪法价值在法律体系中得以贯彻，然而仅仅将法律法规认定为违宪并不足以有效实现对法律体系的合宪性控制。灵活运用违宪判决的形态可以促使合宪状态的进一步达成，同时避免对政治和法律秩序造成过度的冲击。违宪判决的形态大致包括违宪无效判决、单纯违宪判决和警告性判决。违宪判决形态的选择方法和原理是政治智慧和法律技巧相结合的产物，对这些不同模式下的判决形态选择方法加以梳理、比较，并分析其背后的制度因素，可为激活我国的宪法审查制度提供一种可能的推进策略。     

网络交易的纠纷解决机制探析——基于民间法与国家法互补的视角

高风险一度是网络交易发展的瓶颈所在。近年来,网络交易平台发挥网络科技的优势,为交易者提供了一些独特的风险防范和纠纷解决机制,极大地促进了网络交易的发展规模。但此种民间型机制的局限和优势一样明显,未能有效＂定分止争＂。要真正保障网络交易的稳定发展,最大程度上解决交易纠纷,除进一步发展和规范民间型机制外,尚需对传统的官方型机制予以适当的＂网络化改造＂,最终形成两者的良性互补。     

Examining Factors Co-Existing with Interpersonal Violence in Lesbian Relationships

Interpersonal violence within lesbian relationships is a significant yet understudied problem. Women attending a gay pride festival in Atlanta, GA, were asked to complete a survey concerning same-sex interpersonal violence. Women who reported being in a current or previous same-sex partner relationship were included in the analyses (N = 226). Factors that occurred in the context of interpersonal violence were investigated: substance use, HIV/STI risk behaviors, barriers to reporting abuse, and attitudes inhibiting seeking of social support. In addition, the survey assessed relationship-related power dynamics. Results of multivariate analyses support the hypotheses that power imbalance and inequality when making sex-related decisions within women’s same-sex relationships are associated with interpersonal violence. Further findings suggested that a combination of factors must be considered when dealing with and reducing the risk for violence in same-sex relationships.     

Case law of the EPO Boards of Appeal in 2006

Legal context: The article reviews significant decisions handed down by theBoards of Appeal of the European Patent Office (EPO) in 2006,concentrating on decisions of the Enlarged Board and the Boardsof Appeal issued in 2006 and published or to be published inthe OJ EPO. Key points: The article discusses the application of Art. 24 EPC on exclusionand objection to members of the boards of appeal in the lightof the following decisions: G 1/05, T 281/03 and J 15/04; referralspending before the EBA on the subject of divisional applications(Art. 76 EPC and R. 25 EPC) and exclusion from patentabilityunder R. 23d(c) in conjunction with Art. 53a EPC; and decisionsof technical boards of appeal on exclusions from patentability(Arts. 52 (2)(3) and (4) EPC), the requirement of industrialapplicability (Art. 57 EPC) and re-establishment of rights (Art.122 EPC). Practical significance: The article provides an overview of the 2006 case law of theboards of appeal which is particularly useful since most ofthe decisions discussed have not yet been published in the OJEPO. The author is critical of the recent case law on the applicationof Art. 24 EPC (exclusion and objection to members of the boardsof appeal) and reports on several decisions of particular legalinterest.
