The authors investigate MacCormick and Weinberger's claim that the Institutional Theory of Law provides a conceptual framework for the study of legal phenomena from a socio-legal point of view. They evaluate this claim by confronting both the Institutional Theory of Law and Weinberger's theory of action with two approaches in socio-legal theory, i.e. the instrumentalist and the constitutive approach. The conclusion is that the Institutional Theory of Law lends itself to empirical research from an instrumentalist perspective, for both place the concept institution in the context of law. Weinberger's theory of action may provide a basis for empirical research from a constitutive perspective. The authors make some suggestions for refinement of Weinberger's theory of action in order that the relation between institutions and action can be labeled dynamic. 相似文献

It has been abundantly argued that the Spanish transition was based on an implicit ‘pact of silence’ by which the main political forces accepted to leave the thorniest aspects of past behind as the only way to peacefully construct a democratic future. And it has been widely accepted that Spanish society subscribed to this. This article defends a more nuanced version of this state-level agreement by focusing on memory-related initiatives at the local level. The present paper describes the development and validation of the Preference for the Merit Principle (PMP) Scale, a measure to assess people's preference for allocating outcomes on the basis of the distributive justice principle of merit. On the basis of data from a large sample of undergraduate students, we tested the construct and predictive validity of the scale and compared the results with the performance of two existing justice scales (Rasinski's, 1987, Proportionality Scale, and Rubin and Peplau's, 1975, Belief in a Just World Scale). Overall, we found that the PMP Scale had superior construct validity as compared with the Proportionality Scale. In brief, the PMP Scale was more independent of conceptually distinct constructs, such as prejudice and right-wing authoritarianism. 现行的征地补偿制度以地方政府垄断经营土地一级市场,征地按土地的原用途补偿为两大基本特征,从而构成了土地管理上的利益驱动,并与兼顾失地农民的合法权益形成了一种博弈关系。征地补偿存在为公共利益的需要征地与所有非农建设都要征地之间、土地补偿的低偿性与土地价值增值性之间、征地主体地位的强势性与农民利益保护脆弱性之间、征地建设谋发展与让被征地者分享发展成果之间等深层矛盾。完善征地补偿机制必须实行制度创新,从改革地方政府征地绩效评估机制入手,解决征地补偿、就业安置、社会保障等方面存在的突出问题。 相似文献

刑事诉权理论是刑事诉讼法学的理论基础。其内涵表现为它是向国家审判机关请求的权利,是宪法性基本权利,是程序涵义和实体涵义的统一。其外延在程序上表现为公诉机关的公诉权、刑事自诉人的自诉权和被告人的应诉权,在实体上表现为控辩双方的期待胜诉权。其本质特征表现为它是由宪法保障、国民平等享有的权利,对审判权具有制约性,自身具有程序性。刑事诉权理论为当事人主义审判机制的存在和发展及侦查权的刑事诉权属性奠定了理论基础,为当事人在刑事诉讼中的具体权利的合理配置、公诉案件中被害人诉讼主体地位及一些新型刑事诉讼制度和原则的引进和确立提供了理论依据。 相似文献

Research-based knowledge of the effects of affirmative action has been little help to policy makers. That is the case because there has been no means through which to organize into a policy-relevant whole the findings that have come from a variety of disciplinary sources. A heuristic schematic of the psychological ecology of affirmative action is proposed as a step toward developing a conceptual framework that can reduce this problem. A psychological ecology of affirmative action consists of the mutual relations between policy interest groups and the procedures used to implement these policies. A critical point that the ecological framework leads to is that the nature of affirmative action procedures has a major influence on the material and subjective links between interest groups. Given that claim, the schematic is used to categorize, review, and critique the multidisciplinary research on affirmative action. From that overview, a set of general guidelines for the design of effective affirmative action programs is proposed. Finally, a call is made for a shift in the unit of policy analysis from a focus on group justice to relational justice. 相似文献
