This study examines the pattern of rib injuries occurring in cases of fatal torso stab wounds in Ireland between 2011 and 2018. It has been suggested by previous studies that rib fractures are not commonly sustained in stab wounds to the torso. We wanted to ascertain whether this was the case, as our data suggested that rib fractures were frequent, and where a rib is fractured there is a higher chance of organ injury and death, making this an important area of study. One hundred and forty seven cases of fatal stab wounds from an eight-year period were retrospectively reviewed. Fatal stab wounds to other body areas, were excluded; leaving a total of 104 cases with stab wounds to the torso. We found that 69.2% of cases had rib injuries, a figure significantly higher than previously reported. Our data suggests that stab wounds to the torso often fracture ribs, putting the underlying organs at increased risk of injury and perhaps contributing to fatality. The amount of force needed to cause a rib fracture can be difficult to quantify and indeed from the high percentage of rib fractures sustained in our data it appears that the ribs may be fractured regardless of the amount of force used; this is borne out by the finding that self-inflicted injuries also caused rib fractures. Our study shows that other factors, such as anatomical positioning and wound depth may have a greater bearing than force in terms of whether a rib fracture is sustained. 相似文献

This study investigates the pupal development times of the blow fly Calliphora vicina, which were studied in the laboratory at six different constant temperatures (15, 20, 23, 25, 28, and 30°C each ± 1°C). Lower thresholds (tL) for development were estimated from the linear regression of the developmental rates on each temperature. These data have made it possible to calculate the accumulated degree days (ADD) necessary for C. vicina to complete the larval stage and to achieve adult emergence. The minimal duration of development from oviposition to adult emergence was found to be inversely related to temperature. Additionally, six landmarks in pupal development are showed, and for each of the landmarks, the ADD value was calculated for every rearing temperature involved. These data assist in calculating the duration of the pupal stage based on morphological characteristics and would be of great value for future forensic entomological casework. 相似文献

目的探讨道路交通事故所致精神伤残的伤残程度重新鉴定意见改变的原因。方法回顾性分析绍兴市第七人民医院司法鉴定所2009年10月—2011年10月受理的交通事故致精神伤残的伤残程度重新鉴定案件51例。结果要求重新鉴定的案例中,鉴定意见有改变的共计30例(58.82%),其中伤残等级提高8例,伤残等级降低22例。按鉴定意见改变原因分,鉴定人评定时对精神障碍严重程度的理解差异8例,鉴定人自由裁量差异10例,鉴定人对某些精神症状的认识差异2例,鉴定时间差异10例。结论精神伤残程度鉴定应准确把握鉴定时机,减少鉴定人个体差异引起的鉴定意见改变,正确理解条款规定的要求。 相似文献

A minority of men and women with intellectual disabilities at times engage in, and are suspected, or convicted, of illegal activity. Recent policy developments in England and Wales emphasise the need to respond appropriately to putative offending risk through the provision of safe and effective community management, treatment, and support services. In line with these concerns, research has focused increasingly on testing the utility of an evolving variety of risk assessment procedures. Here, the authors set out to challenge the repertoire of a number of prominent and/or recently developed risk assessment procedures and the scope of an associated research literature, on the basis that contextual risk factors are receiving insufficient attention in relation to offending among people with intellectual disabilities. Drawing on the wider criminological literature, a novel study is reported that compares key contemporary proximal social and environmental circumstances in the lives of offenders and non-offenders with intellectual disabilities. A contextual risk score is derived, providing statistical support for increased consideration of the impact of relevant social and environmental circumstances. Increased emphasis on key contextual risk factors is recommended to strengthen community service responses to offenders with intellectual disabilities. 相似文献

Abstract The principal aim of this study was to investigate whether attitudes towards judicial competency, legal liability, voluntariness of offence and judicial disposal options were influenced by known classification of an offender as learning disabled compared to an offender with a suggested intellectual disability, but not formally classified. Subsidiary aims were to explore participant attitudes based upon group membership and parental status. The sample consisted of 101 participants (69 undergraduate nursing students and 32 from the general population). Participants were requested to complete a questionnaire assessing their attitudes within the aforementioned domains and towards ascribed levels of victim parental responsibility. Fifty participants completed a questionnaire designed for the purpose of the study where the offence scenario depicted made reference to the offender having a formal classification of learning disability. Fifty-one participants completed the same questionnaire where an intellectual disability was suggested but not formally stated in the form of classification. Results indicated that classification did significantly influence attitudes in most domains irrespective of group. The nursing group attributed greater levels of competency to the offenders depicted. No interactions between variables were observed. The reasons for and implications of these findings, limitations and recommendations for future research are explored. 相似文献

Abstract This study found that 59% of social care staff were currently supporting a client with a learning disability who had offended or displayed an offending type behaviour. The range of behaviours was similar to that displayed by clients in a secure health facility and included rape, sexual assault and exposure. Only 22.9% of social care staff had received training in this area, while none of the health staff had. Both groups expressed low levels of confidence in supporting this client group. The areas of difficulty were common to both groups and included personal attitudes and attitudes of others to the behaviour, and concerns over risk, responsibility and safety. In respect of attitudes, social care staff were found to be significantly more likely to hold negative attitudes towards the person's behaviour, while health staff were significantly more likely to feel negatively towards the person. Health staff were significantly more likely to identify training as a means of further support, while social care staff identified professional input. Both groups identified the need for theoretical training about working with this client group. Despite this no significant differences were found between those who had and had not received training and confidence, attitudes and the need for further support. 相似文献

This paper argues that luck egalitarianism, especially in the guise of equality of opportunity for welfare, is in tension with the ideal of fair equality of opportunity in three ways. First, equal opportunity for welfare is compatible with a caste system in employment that is inconsistent with open competition for positions. Second, luck egalitarianism does not support hiring on the basis of qualifications. Third, amending luck egalitarianism to repair this problem requires abandoning fair access to qualifications. Insofar as luck egalitarianism cannot support fair equality of opportunity, it cannot do justice to the claims of the disabled. Indeed, in the absence of fair equality of opportunity, disabled people are likely to be marginalized. 相似文献

Laws in the UK and the USA protect college students with disabilities from discrimination. The laws of both nations are complex and require institutions of higher education to accommodate qualified students. This article examines the requirements of both nations’ laws with respect to the kinds of inquiries that may be made of students with disabilities, how the institution must go about determining what accommodations are needed, whether the needed accommodations are reasonable and consistent with academic standards or requirements, and whether the institution is required to attempt to accommodate undisclosed disabilities. The article also discusses how the laws in each nation are enforced, addresses the remedies that are available to students in both nations, and focuses on the interpretation of these laws with respect to admission, academic accommodations, nonacademic accommodations (such as housing, student discipline, and co-curricular activities). It also discusses the institution's duty to students with psychiatric disorders who may engage in self-destructive behavior. 相似文献

This study examines three hypotheses: (1) there is an association of parental and offspring substance abuse for sex offenders and paraphilics; (2) there is a higher occurrence of substance abuse among the parents of sex offenders and paraphilics than seen in the general population; (3) substance abuse among the parents will be associated with a higher frequency of birth and developmental abnormalities, learning disabilities (LD), mental retardation, attertion deficit hyperactivity disorder (ADHD), and school learning problems (school dropouts, grade failures, and placement in special education) common in sex offenders and paraphilics. A sample of 1,012 male sex offenders and paraphilics were asked about substance abuse among their parents and about their own birth and developmental abnormalities and school learning problems. Three in five families had a parent who was a substance abuser and there was a significant concordance of parental and offspring substance abuse. Substance abusing parents more often than nonabusing parents had sons with developmental and learning problems on every measure examined. Results suggest that parental substance abuse appears to play a role in the neurodevelopment, associated learning problems, and substance abuse reported in studies of sex offenders and paraphilics and it should be explored as a possible factor in the genesis of sexual disorders. 相似文献
