我国工伤保险程序存在的问题及完善

工伤保险自诞生以来就具有强大的影响力,原因之一在于其程序简便易行。然而在我国,劳动者申请工伤保险待遇却要历经多重程序,耗时之长、过程之艰难已经成为工伤保险制度优越性发挥的障碍,为此,应以法律人本主义理念改革我国的工伤保险程序。     

The Abuse Disability Questionnaire: Internal Consistency and Validity Considerations in Two Samples

Comparative psychometric information on the Abuse Disability Questionnaire (ADQ), given to women who were receiving services from domestic violence shelters, was presented. The total score of the ADQ and its subscale scores for Relationship Disability, Life Restriction, Psychological Dysfunction, and Health Status Issues demonstrated adequate internal consistency across two shelter samples. Further construct validation was evidenced by the relationship found between self-esteem and impairment, and also between prior abuse and impairment. Additional research to establish the utility of the Abuse Disability Questionnaire as a research and/or clinical instrument was proposed.     

The Implementation of European Anti‐Discrimination Directives: Converging towards a Common Model?

This article examines the impact on national law and policy of two Directives on combating discrimination adopted by the EU in 2000. It considers the extent to which their transposition has resulted in the 'Europeanisation' of anti-discrimination law and whether this implies convergence in the direction of a common model. Two themes are examined: the list of protected grounds of discrimination and the creation of equality institutions. All 27 states have introduced legal reforms in response to the Directives and a loose level of convergence can be identified. Nevertheless, specific national traditions have proved resilient, for example, shaping the meaning attached to terms such as 'disability' or the structure and powers of equality bodies.     

关于长春市职工工作满意度的调查

工作满意度表达着人们对工作状况的自我感受,与职业变动、社会流动有一定的关联,可以成为测量社会流动的一个指标。调查发现,目前长春市职工的工作满意度并不是很高,得分仅为3．22。提高职工的工作满意度。必须做好多方面的工作,对此本提出了相应的建议。     

Marriages among people with disabilities in 19th-century Sweden: marital age and spouse’s characteristics

ABSTRACT

While marrying was an expected event in 19th-century Western society and has been subject to much historical research, there are few studies on how disabilities influenced people’s marriage patterns and spouse selection. The aim of this analysis is to contribute clarification on this issue by examining with whom disabled men and women married and the marital age and socio-demographic characteristics of them and their spouses. In total, 188 disabled individuals born in the first half of the 19th century and who married in the Sundsvall region, Sweden, are studied. The results reveal that disabled men and women did not marry each other, and they entered into marriage at a slightly higher age than the average, although there was usually no marked age gap between them and their spouse. Endogamous patterns were primarily found regarding the socio-spatial background of the two spouses. This analysis is one of the few studies identifying the marriages among a comparatively large number of disabled people using demographic data. Their participation in the partner pool highlight their agency historically and emphasize that disability did not lead to distance from social life in past society.     

Northern Irish legal education after Brexit

ABSTRACT

In this article we argue that the impact of Brexit on the law schools in Northern Ireland is tied to the “unique circumstances” of legal education in this part of the world. Legal education in Northern Ireland is likely to develop to become even more distinctive than that in other parts of the UK. Although there are two distinct jurisdictions on the island, they are deeply entangled by shared history and geographical proximity that make cross-border practice a daily reality. These circumstances seem likely to drive the trajectory of the development of legal education in Northern Ireland. Indeed, EU law is likely to remain a component of the Northern Irish qualifying law degree. The potential for the development of law specific to Northern Ireland under backstop arrangements is another significant driver for the future orientation of legal education in this jurisdiction. Legal education in Northern Ireland is, therefore, likely to become noticeably more “European” than that in other parts of the UK.     

Troubling frames: Zapiro’s iconography on Oscar Pistorius as traumics

ABSTRACT

This study aims to examine the comics form in relation to its representation of perpetrator trauma. Specifically, the study considers a selection of Jonathan Shapiro’s iconography on Oscar Pistorius as biograph(y)ics, since the artist ‘commixes’ Pistorius’s life from his rise to athletic fame – through the court trials for his alleged murder of Reeva Steenkamp on 14 February 2013 – to his conviction followed by a thirteen-year jail sentence on 24th November 2017. In my reading of the panels, I draw on Hilary Chute’s notion of the ethics of testimony in illustrative art and Jacques Derrida’s theorising on hauntology and the revenant to argue that wrongdoers can also experience their crimes as trauma. This critical engagement enables me to read Shapiro’s panels as not merely reinforcing dominant interpretations of the fallen hero, but also as a means by which the cartoonist destabilises and reconfigures socially accepted notions of the villain.     

以制度安排求解农民组织化问题

农民组织对于农民来说,有着经济、政策及教育功能。但在方兴未艾的新农村建设和目前大力引导的农村土地流转政策中,农民组织及农民组织化问题并未得到应有的重视。因此应重新审视农民组织化,梳理其现状及存在的问题。总的说来,农民组织要在规范、依法的轨道内运行,包括法律在内的制度安排是必不可少的。     

Measuring the Effectiveness of New Approaches to Housing Support Policy for Persons with Disabilities

Housing support policy for persons with disabilities who require access to 24‐hour formal or informal support is changing throughout Australia. This is consistent with international trends including: independent living in generic housing; facilitating choices about where and with whom people live; individualised home‐based support; and community integration. Are these trends leading to policies that are effective in the Australian context? This article presents a framework for analysing the effectiveness of new approaches to housing support using a rights perspective. The framework consists of four domains: client outcomes; administrative systems; service viability; and coordination between formal and informal carers. Applying the framework to six case studies found that they all aim to foster independence, while providing effective individualised, holistic housing support.
