我国反家庭暴力的立法研究

家庭暴力破坏家庭的和谐与稳定,已经成为社会的公害。从分析家庭暴力的概念和成因入手,通过对中国立法现状和外国立法经验的总结,从立法、司法层面提出了构建我国未来的家庭暴力防治法的建议。     

艾滋病、小偷与立法

“艾滋小偷”正在成为一个严重的社会问题。“艾滋小偷”对他人的种种不法伤害,是 现阶段一种新的违法行为,造成实际传染后果的应当构成犯罪。“艾滋小偷”不仅犯有盗窃罪,同 时又伴有吸毒、贩毒、嫖娼、敲诈、抢劫等多种犯罪。我国应尽快修改和完善《刑法》、《看守所条 例》、《强制戒毒法》、《传染病防治法》、《监狱法》等法律法规,早日出台《艾滋病防治条例》,以便统 一监管和及时惩治各类艾滋病犯罪。     

The Ambiguity of Love: Beauvoir,Honneth and Arendt on the Relation Between Recognition,Power and Violence

The paper sketches out an account of ambiguous and agonistic love by drawing on the work of Simone de Beauvoir, Axel Honneth and Hannah Arendt. To begin with, I reconstruct the ambiguity of love within the conceptual framework of a paradigm of recognition. I argue further that the social relation of love, understood as an intertwine between dependence and independence, entails a power dynamic. Insofar as the dynamic actualises as “power in concert” or “power with”, namely as mutual empowerment, love unfolds as free love. Finally, I show how agonistic love is damaged by turning into violent domination.     

‘Keeping the Ruins Private’: Anna Kavan and Heroin Addiction

Abstract

In 1964, the number of registered heroin addicts in Britain was 753. One of these was Anna Kavan, née Helen Woods. Beginning her writing career under the name Helen Ferguson, she wrote conventionally realist novels that enjoyed modest commercial success. In 1939–40, after a number of serious breakdowns and suicide attempts, and now calling herself Anna Kavan, Woods/Ferguson left a Swiss sanatorium addicted to heroin, which had almost certainly been therapeutically prescribed for sleeping disorders and severe depression. From then until her death in 1968, when she was found collapsed over a box of heroin, Kavan had an intermittent but intense relationship with the drug. This essay examines the ways in which Kavan has been constructed as an ‘addict writer’, both by her biographers and critics, and how this designation has influenced critical readings of her work.

日本社会小说作家山崎丰子的大部分作品中贯穿着反战思想,其中既包含了反对战争、热爱和平的内容,又有对日本对外扩张行径的反思,深入挖掘了战争中日本国民的紧张与不安,探讨了人物内心深处对"归"的渴望,唤醒了人们对战争残酷性的共识。本文以山崎的"战争三部曲"为研究对象,通过文本分析,对贯穿于山崎文学中的反战思想进行研究,详细剖析其"归"的主题和"哀"的基调,对日本是否具有"反战文学"进行深入讨论,了解事实真相,厘清文学概念,促进日本社会对历史的深刻反省。     

Small Gestures and Acts of Grace: An Interview with Germaine Koh

Knitwork is an 80-metre long work generated by unraveling cast-off garments, and reknitting them into a wide blanket. The piece is visually rich: bands of bright colours, softer shades and painterly mixes. The artist Germaine Koh, who lives and works in Canada, conceived the piece in February 1992 as a life-long project. It has since been shown in galleries across North America, Australia and, most recently, in 2002, at the British Museum in London, where it cascaded down marble steps in the Great Court. Knitwork is reminiscent of the work of feminist artists of the 1970s (such as Judy Chicago and Miriam Schapiro in the United States, or the Feministo group in Britain), work that commented on the devaluation of both domestic labour and craft, particularly with regard to textiles, traditionally associated with women. Although Koh intends this reading, Knitwork is one of a series of-what might be described as-conceptual art projects that she has exhibited over the last decade. These focus on the ways in which we invest time and effort in seemingly mundane activities, what Koh describes as 'the weighty psychic accretion of everyday habits and mundane debris'. By using commonplace objects, abstracting them or changing their context, she aims to stimulate reflection about how we interact, and the tokens or gestures we use. Sometimes Koh knits alone, privately; and, at other times, publicly, when the piece is on exhibition, transforming it from object to performance. By 1998 the piece had 'consumed' more than 260 garments and was over 60 metres long. By 2002 it had grown to 80 metres, including nearly 300 garments, and weighing 400 pounds. Koh describes Knitwork as a comical object, somewhere between the sublime and the ridiculous. Yet, because it has both its past and future written into it, it contains a certain melancholy. It is a measurement of a life, its output, and also its duration, each stitch a record of a decision, and of a moment in time.

北宋的孙复是庆历前后著名的《春秋》学者,所著《春秋尊王发微》具有浓重的尊王攘夷倾向。细绎之,《春秋尊王发微》在基本观点、尊王倾向,尤其是以日月时例解经等方面都与《毂梁传》有明显的继承关系。从这个角度讲,孙复丰富和发展了《毂梁传》的思想,对《毂梁传》的传承起到了重要作用。     

资源失灵与阻抗力——基于M村婚姻暴力现象的研究

解释婚姻暴力时资源正功能论和资源负功能论并存,现实中女性拥有较多资源也可能长期遭受婚姻暴力,构成本文所谓"资源失灵"现象。本文通过对资源概念进行界定及分类,厘清问题本质,考察农村家庭中妻子面对婚姻暴力时经济资源失灵的过程与机理,揭示家庭背景、社区文化等结构资源对个体经济资源的主导作用,从阻抗力的角度思考相关对策。女性具有的男权中心性别观念会扭曲其对经济资源的主观认知,抑制其资源利用能力,导致资源失灵。家庭因素、社区环境等结构资源通过社会化过程影响个体的观念系统,也会以社会支持方式促进或压制经济资源的作用。婚姻暴力阻抗力能减少受暴女性对施暴者或者婚姻关系的依赖性,其产生需激活相应的外部结构资源,并激发个体的意愿与决心。     

Scottish parliamentary record scholarship in the devolution era

In 1707 Scotland’s parliament ceased to exist. Yet it has since been the subject of two monumental acts of record scholarship; the Acts of the Parliaments of Scotland (1814-1875) in the nineteenth century and the Records of the Parliaments of Scotland (2007) in the twenty-first. Using the first of these as a touchstone, this article examines the ways in which the records of the pre-1707 parliament are presented, positioned and interpreted in the second. Unlike the nineteenth-century edition, which was produced in an era when adherence to the 1707 Act of Union with England went all but unquestioned, the twenty-first-century version was created during a period of constitutional devolution amidst a national debate over the question of independence from the United Kingdom. Approaching this new edition of parliamentary records as a cultural product, shaped and informed by the context in which it was created, therefore enables us to learn much about how the relationship between history and national identity in Scotland has changed since its predecessor was published. From there, the article questions the assumption that present-day understandings of Scottish identity are primarily civic and forward-looking, and argues that they are in fact partly based on claims which, whether secessionist or devolutionist, are fundamentally historical.     

乌拉圭回合《农业协议》国内支持条款缺陷问题研究

乌拉圭回合《农业协议》实现了农产品到多边贸易体制的回归,但协议并不是对国际农产品贸易的永久性安排,各成员仍有义务通过后续谈判,不断提高国际市场农产品贸易自由化水平直至完全实现自由化。因此,研究《农业协议》国内支持条款的局限性与执行中存在的问题,分析新一轮农产品多边谈判中应修正的问题,对于我国实施国内支持条款和参加新一轮农业多边谈判,具有理论和实践意义。
