析泰国在禁毒执法领域中的国际合作机制

在全球一体化的进程中,许多国家的贩毒网络已发展成有组织的、分工明确、牵连多个国家和地区的跨国贩毒模式,因此,凭借一个国家之力要彻底捣毁这类贩毒团伙是非常困难的,必须通过各国通力合作,采用“特殊手段”才能有效摧毁这类贩毒网络。泰国与其他国家进行引渡跨国犯罪合作由来以久,目前,泰国的跨国犯罪引渡法正处于修改完善阶段并与其他国家签署了10个引渡跨国犯罪的协议。     

中国-东盟自由贸易区内毒品问题现状与发展趋势

进入新世纪,毒品犯罪在整个中国-东盟自由贸易区内仍然呈上升趋势,成为非传统安全领域中的新型威胁,成为中国-东盟自由贸易区经济建设的一大毒瘤,也成为区域内各国政府首当解决的问题之一.因此,研究中国-东盟之间毒品问题的现状和发展趋势,对于中国-东盟自由贸易区建设的顺利进行有着重要的现实意义.     

Urban Drug Problems, Policymakers and the General Public

The main focus of this paper is: how strong are people's opinions and policy preferences on the issue of drugs and drug users influenced by their own exposure to drug problems? From a general population survey conducted in eleven European cities, it is concluded that opinions and policy preferences are influenced only to a limited degree by exposure. The people who are not exposed to drug problems in their neighbourhood are more strongly inclined towards a repressive approach than the people who are affected by drug nuisance. Personal experiences with illicit drugs play an important part in the viewpoints. People who have tried drugs themselves lean far more strongly towards a health approach. That tendency is even stronger among those who are exposed to drug-related nuisance.     

试论禁毒部门的反情报对策

情报工作在侦破毒品违法犯罪案件中有着举足轻重的作用。随着禁毒工作加强 ,毒品违法犯罪分子的反情报能力也更加全面。针对当前毒品违法犯罪分子反情报活动的特点 ,各级禁毒部门应当采取相应对策 ,以在禁毒斗争中取得主动。其对策为 :一是加强禁毒部门的反情报意识 ;二是严防出版物泄密 ;三是加强情报安全 ;四是建立快速反应机制 ;五是加强禁毒谋略的运用。

非法持有毒品罪是查获毒品而不能证明实施其他毒品犯罪时兜底适用的罪名。刑事推定是在无法直接证明案件事实前提下,根据已查明事实以经验法则做出合乎常理的推论,刑事推定必须达到排除合理怀疑、结论唯一的标准。

基于法定证据类型在贩毒案件中的特点以及打击贩毒犯罪形势的严峻性,推定,作为证明责任的特殊配置方式有其适用的必要性,是秩序与效率法价值的一种制度体现。在认真分析贩毒案件中推定的几种类型的同时,深入研究法价值的多元性与动态均衡性的特点以及推定在认定案件事实上的地位,从而得出要认真对待推定、有限度适用推定的结论。     

Loperamide as a Potential Drug of Abuse and Misuse: Fatal Overdoses at the Medical University of South Carolina

Loperamide is an over‐the‐counter, μ‐opioid receptor agonist commonly used as an antidiarrheal agent. Loperamide was thought to have minimal abuse potential due to its low bioavailability and limited central nervous system activity; however, there have been increasing reports of loperamide misuse in supratherapeutic doses to achieve euphoria and/or avoid opioid withdrawal. A literature review suggests a rise in loperamide abuse was inevitable, with substantial increases in reported cases over the last decade. Five fatal cases of toxic medication use where loperamide was listed as a primary or contributory cause of death were identified at the Medical University of South Carolina. The characteristic autopsy demographics and findings are described, and the mechanisms of abuse and toxicity of loperamide are reviewed. Loperamide overdoses are a growing concern from both a forensic and clinical standpoint, and the frequency of reported cases will likely increase as awareness grows within the medical and toxicological communities.

食品药品安全的刑法规制正在形成以风险控制为中心的三维立体模式并可进一步加以完善。法益保护的前置化着重于一般预防，主要是抽象危险犯的设置；资格刑的配置着重于特殊预防，从立法完善的角度，可增设禁止从事一定职业的资格刑；对监管责任的强调和特别规定，则旨在从制度上堵塞漏洞，及时发现和查处相关违法犯罪行为，控制犯罪风险。     

论毒品案件侦查中控制下交付与诱惑侦查的异同

在毒品犯罪案件中,控制下交付和诱惑侦查是常用的侦查措施,对抓毒枭,打网络,摧毁毒品地下工厂意义重大。两者在我国的法律法规中均未有明确的规定,对于两者的研究与规范也是鲜有人问津,实践中常有人把两者混淆。对其进行比较分析其异同,对于进一步认识实践中的法外侦查行为,以及推动侦查行为的法制化和人性化将有重要的意义。文中将主要以毒品犯罪案件侦查为例,试对这两种侦查措施的特点进行分析、比较研究。

随着劳动教养制度的废除,与之类似的收容教育的存废引起了学界的关注,亦多主张废除。违法行为矫正法的制定应考虑伦理与法律的关系。对吸毒人员的社区戒毒应有相应的配套措施,明确具体的责任主体,做到专业性与稳定性的统一。
