食品药品犯罪侦查专业力量建设实证研究

在食品药品犯罪猖獗的情形下,构建专业的侦查力量无疑是解决问题的关键。虽然目前对组建专业食品药品犯罪侦查队伍还存在争议,但是食品药品安全在保障人民群众生命健康、社会发展、国家稳定中的基础地位是不言而喻的。为此,在实证调研的基础上,通过剖析目前食品药品犯罪案件侦查的队伍现状,分析问题产生的原因,论证建设专业侦查队伍的必要性,以期解决食品药品犯罪侦查中的瓶颈。     

Drug counselling behind the prison wall: staff responses to collaborative challenges

In the last decade, 13 Drug Counselling Units (DCUs) have been established in Norwegian prisons. These units are to offer prisoners with substance use problems coordinated treatment and rehabilitation so they can better cope with their problems during imprisonment and after release. Key means in achieving these goals are to establish inter-agency collaboration between the prison service and the specialist health services. Psychologists, social workers and prison officers from these institutions are to form an inter-professional team in the collaborative process. This study explores the challenges these occupational groups face when they collaborate within this organizational frame. The results show that the occupational groups experience two of the same types of challenges, but that they respond differently to them. The pattern of responses impacts collaboration, both in positive and negative ways. However, all occupational groups endeavour to maintain a high standard within the institutional framework provided by the Norwegian prison system. This article discusses how the responses of the occupational groups in the collaborative processes in the DCUs are influenced by their affiliation to the DCUs, as well as the system of management and professional logic.     

关于推进贵州省“阳光工程”法治化的思考

＂阳光工程＂是贵州省在自身实际情况的基础上探索出的社区戒毒新模式。＂阳光工程＂自实施以来,通过各种途径安置戒毒康复人员,有效地提高了戒毒康复人员管控率,降低了戒毒康复人员复吸率。然而,在＂阳光工程＂的实施中,还存在规划目标不明确、制度不健全等问题。＂阳光工程＂的法治化将为这些问题的解决提供一种有效的思路,进而推进省内社区戒毒工作的进一步发展。     

毒品案件侦查中控制下交付和诱惑侦查之解析

控制下交付和诱惑侦查作为司法实践中最常用而有效的特殊侦查措施,在遏制、惩处毒品、走私等犯罪方面发挥着重要作用。新刑事诉讼法对控制下交付进行了明确的规定,但对诱惑侦查仅进行了概括的授权。对于控制下交付,应当在适用主体、前提、目的以及审批方面进行规制;对于诱惑侦查合法性的判定标准,应坚持主观标准为主、客观标准为辅的原则。     

吸毒“正常化”与香港防治毒品政策之转变——以青少年吸食氯胺酮为例

香港政府的防治毒品政策大体可分为两大主轴。第一主轴是刑事司法,包含立法禁毒、执法及针对毒品相关罪行及吸毒者的判刑。第二主轴是社会政策,包括预防吸毒行为、识别吸毒者及提供戒毒复康服务。就吸食氯胺酮而言,香港青少年群体很大程度出现了帕克所述的正常化现象。同时,日常社交圈子中网络状的接触点大幅增加了非滥药群尝试氯胺酮的可能性。这种吸毒正常化对香港毒品防治政策有很大的影响。     

新型策划药亚甲基二氧吡咯戊酮研究

亚甲基二氧吡咯戊酮是一种被广泛滥用的策划药物,由于其具有严重的心血管、认知、知觉、胃肠道和神经危害作用,已经引起了国际性警报。部分国家和地区已将亚甲基二氧吡咯戊酮列入管制,但我国尚缺乏相应的关注。本文通过研究亚甲基二氧吡咯戊酮理化性质、药理和毒理作用、滥用和管制等,以期加强对亚甲基二氧吡咯戊酮的认识、研究和监管。     

毒品犯罪中的预备案件研究

自毒品的危害被人们认识以来,人类就在不断地采取措施打击毒品犯罪。时至今日,单纯地将毒品打击活动局限在事后打击上,对于日益严峻的毒品犯罪活动显得较为滞后。毒品犯罪案件中的预备案件是将对毒品犯罪的打击提前到预备阶段的一种侦查措施,它能有效地防止人民币外流,减少毒品对社会的危害。预备案件实施必须有可靠的信息情报、丰富的缉毒经验、规范的操作程序和人身安全保障及法律法规的支撑。否则,将可能存在诱人犯罪、侵犯人权甚至增加社会危害性等不良后果。     

Exploration of the Concept and Path of Chinese Mutual Aid Therapeutic Community from View of the Social Rehabilitation

The experiment on the drug rehabilitation community in China started at the end of 20th century from the transplantation of the US “Daytop Mode” in Yunnan Province. With the increasingly relapse rate of drug users and the deepen development of government purchases services, many places like Shenzhen have put forward the concept of “No-drug Community”, aiming to explore the indigenous experience on community treatment. After reviewing the history of community drug control work, taking Shenzhen as an example, this paper explores the concept and path of the Chinese Mutual Aid Therapeutic Community from the view of social rehabilitation. It finds that external supporting system needs to be constructed during the course of rehabilitation. Meanwhile, by stimulating the changing motivation, strengthening cognition behaviors, rebuilding supportive family relationship on the individual level, as well as providing the support from peers, colleagues, and self-organization and positive culture on the environmental level, social workers can help drug users from exclusion to rehabilitation.     

Attempted Drug‐facilitated Sexual Assault—Xylazine Intoxication in a Child

There are only a few cases of drug‐facilitated sexual assaults on children reported in the literature so far. Here, a case of a four‐year‐old boy is presented. He was unconscious, and the accompanying adults reported that the child had been at a playground on his own. Returning home, he complained of having been stung and collapsed immediately. Urine and serum samples of the child were investigated. In the toxicological analysis, xylazine, a sedative and muscle relaxant used in animals, was detected. Subsequent quantification by GC/MS after solid‐phase extraction revealed 0.053 mg/L xylazine in serum and approximately 0.63 mg/L in urine. Furthermore, the child was examined by a forensic medical specialist. Police investigations revealed that the godfather, who had been previously accused of sexual abuse of children, had injected the child with the drug, possibly in preparation for a shared bath.     

我国药品专利司法保护制度立法与实践的宏观评析

专利司法保护之于激励创新药物研发的作用毋庸置疑,且得到了国内外研究和实践的印证。全面、宏观地梳理近年来我国药品专利案件总体情况,是评价和健全＂中国特色＂药品专利司法制度的基础。本文将在回顾我国创新药物专利保护立法现状的基础上,以＂中国知识产权裁判文书网＂登载的所有药品专利案件为样本,分析药品专利诉讼现状,并预测未来此类案件的发展趋势,以期为完善药品专利司法保护制度提供参考依据。
