Tackling Corruption at its Source: The National Corruption Prevention Bureau

In Spring 2007 as part of its ongoing anticorruption efforts, the PRC announced the establishment of a new organization called the “National Corruption Prevention Bureau” (NCPB). The article first examines the origins of the NCPB and its position in the current Chinese anticorruption regime. The NCPB will concentrate primarily on information collection and coordination work. Given these goals, This article examines the organization’s potential for improving work in three areas related to information collection and coordination; increased oversight of the private sector, improving information quality and dissemination, and strengthening routine anticorruption activities. The final section examines potential problems that will likely limit the ability of this new organization to improve anticorruption work, such as the possibility of increasing complexity within the anticorruption system, and the NCPB’s limited independence from the agencies it seeks to coordinate.

沿海开放地区黑社会团伙犯罪问题研究

改革开放以来 ,随着境外黑社会势力的渗透与影响不断加深 ,我国沿海开放地区的黑社会犯罪形势相当严峻。本文论述了有关犯罪的主要动向和十个主要特点 ,从八个方面分析其原因 ,并指出六点防治的基本思路。     

比较法视野下的盘查制度研究

盘查是世界各国警察为预防犯罪或进行初步侦查所普遍采用的一种措施,英美法系国家与大陆法系国家的盘查制度虽然在立法体例上有所不同,但均对盘查制度在适用标准、条件以及程序上进行严格规制,以防盘查权过度滥用。我国盘查制度在立法上存在疏漏,盘查措施在实践中则常作为刑事强制措施的替代,故有必要对盘查措施加以明确,对盘查标准及条件加以严格规定,对具体程序加以规范实施,从而完善我国的盘查制度。     

流动人口的社会化与犯罪防控

随着流动人口犯罪率的逐年上升,外来流动人口逐渐成为城市违法犯罪的主体。对广州外来人口犯罪情况的抽样调查显示,社会化程度偏低是目前引发流动人口违法犯罪的一个重要诱因。建立服务型管理模式,加强社会化教育,提高流动人口的规范意识,是实现对流动人口犯罪防控的有效途径。     

青少年罪前心理特征及其诊断和预防

青少年阶段是个体人格发展的重要时期,也是最多心理困惑和心理危机的人生阶段,极易出现违法犯罪行为。针对青少年心理发展的特点,在其犯罪之前即能发现其心理异常表现,及时开展有效诊断,进行心理教育和疏导,对预防青少年犯罪行为和犯罪心理的发生具有重要的意义。     

犯罪防治与和谐社会构建——辽宁省法学会犯罪学研究会成立大会暨首届理论研讨会综述

犯罪学在国际上经历了长期的发展历程,但是在我国还是一个新兴学科。在经济急剧转轨、社会急速转型的新的历史时期,重大刑事犯罪增多,并有进一步严重化的趋势,各种刑事犯罪活动成为社会稳定的消极因素和破坏力量。加强犯罪学理论研究,特别是研究新形势下各种犯罪的新特点、新趋势,可以为更有效地治理各种犯罪活动提供科学依据,为改革开放和社会的和谐稳定做出贡献。本次会议的主题是犯罪防治与和谐社会构建,围绕这一主题与会者对黑恶势力犯罪、凶杀和暴力犯罪、商业贿赂犯罪、未成年人犯罪、职务犯罪等多个问题领域进行了探讨。会议收到的论文集中反映了我省犯罪学领域研究的新成果,体现了我省犯罪学理论和司法实践的新成就。     

社区防灾减灾机制与应急能力建设研究——以陕西省为例

社区作为社会治理的基本单元,其防灾减灾及应急能力影响着应急体系建设工作。陕西省社区防灾减灾工作存在工作长效机制未确立、风险评估工作缺乏专业性、居民参与度不高等问题,社区防灾减灾机制与应急能力建设必须以"示范社区创建工作"为引领,"多元参与"为主导,长效激励机制为着眼点,夯实基层应急能力,从而达到完善社会整体应急体系和应急能力提升的目标。     

新冠肺炎疫情“依法防控”内涵解读

针对此次新冠肺炎疫情,习近平总书记提出了“依法防控”的战略部署,并强调指出当前疫情防控正处于关键时期,依法科学有序防控至关重要。“依法防控”是深入推进全面依法治国的具体实践,是国家治理现代化的现实要求。坚持“依法防控”,应从国家、社会、公众三个层面进行思考,将顶层设计与法治实践完美结合,切实打赢疫情防控攻坚战。     

A Systematic Evaluation of Restorative Justice Practices: School Violence Prevention and Response

ABSTRACT

Despite its increasing recognition and use in U.S. schools, a limited amount of research has evaluated the effect of restorative justice (RJ) for school violence prevention and response. To date, there is no standardized method for RJ implementation. Therefore, this systematic literature review investigates peer-reviewed studies on the application of RJ practices in K-12 school settings. Ten articles were included in the review. Results of the review indicate a high degree of variability regarding the implementation and evaluation of RJ practices in schools. However, the majority of studies reported positive outcomes, including improved social relationships and reductions in office discipline referrals. The utility of RJ as a school violence prevention and intervention approach are discussed, along with future research directions.     

论国家对公民基本权利的多重保障义务

现代社会是风险社会,国家应承担预防风险的义务。国家应承担保护权利主体在实现基本权利的过程中不受第三人侵害的义务。在紧急状态下,国家应对公民基本权利承担制度保障功能。这三层义务和功能层层递进,形成新时代国家对于公民基本权利保障的制度体系。
