警政是对有关警察的国家和政府事务的统称。中国警政史的研究内容是:以治安问题为起点,以警察职能为核心,具体考察中国历史上各种警政思想、警政机构、警政措施的发展演变过程,分析警察职能的行使和政治、经济、文化等因素的相互关系,揭示中国警政制度的产生、发展规律。从时间上看,中国警政史的研究范围包括中国警政萌芽、发展的全过程;从空间上看,新中国成立以前的中国警政史,应该以鸦片战争前的中国版图作为标准。在学科性质上,中国警政史属于史学的专史范畴。但在中国警政史学内部,也可区分出中国警政通史、断代警政史和专门警政史。 相似文献

This article argues that the work of the hedgerow poet John Clare is invaluable for legal social history in illuminating the
reality of the operation of the poor law as it affected the lives of the poor. Clare's poem,The Parish, written between 1823–6 was not published during the author's lifetime. Written as he first achieved fame, it consists of
2,202 lines of satire denouncing the cant and hypocrisy he himself had witnessed and experienced in local village life. His
Parish was his settlement parish where he and his parents were subject to the power of the vestry and local officials. This piece
considers the text within the context of the legal history of the poor law. The value ofThe Parish as a primary source for that legal history is not merely in the simple narrative of biographical events allied to the poet's
words, evocative as they are. It lies in the subtleties of Clare's own ambiguity about being poor and in the way those ambiguities
assist us today both in understanding Clare's times and values and in hearing Clare mediating the universal experience of
poverty through his art.

This article starts from the observation that in classical Athens the discovery of democracy as a normative model of politics
has been from the beginning not only a political and a legal but at the same time a philosophical enterprise. Reflections
on the concept of criminal law and on the meaning of punishment can greatly benefit from reflections on Athenian democracy
as a germ for our contemporary debate on criminal justice in a democracy. Three main characteristics of the Athenian model
will be analysed: the self-instituting capacity of a democracy based on participatory and reflective citizenship, political
power as the capacity of citizens for co-operating and co-acting with others, and the crime of hubris as one of the key issues
in Athenian criminal law. These analyses will lead to the conclusion that one of the key issues of a democratic legal order
lies in its capacity of recognizing the fragility of the human condition and of developing workable and effective standards
of justice in that context. A relational conception of criminal law and punishment, based on proportionality, reflexivity,
mutual respect and responsibility fits best with a democracy under the rule of law.

China has been a major power for far longer than is typically acknowledged in the West. This paper seeks to redress established discourse of China as a 'rising' power which now enjoys common usage within Western policy-making, academic and popular circles, particularly within the United States; China can more accurately be conceived of as a 'recovering power'. A tendency by successive Washington administrations to view the world in realist terms has forced the label of 'rising' power onto China along with the negative connotations that inevitably follow. We should acknowledge the folly in utilising a theoretical approach largely devoid of any appreciation for the social and human dimensions of international relations as well as the importance of social discourse in the field. Finally, policy-makers in Washington must reconsider their realist stance and, with a fuller appreciation of world history, recognise that American hegemony was always destined to be short-lived. 相似文献
