对完善我国短线交易归入制度的法律思考

短线交易是内幕交易的一种典型形态。各国立法上对短线交易行为的控制主要是通过归入制度实现的。我国现行立法上对短线交易的规定非常匮乏且不尽合理。今后的改革途径应当是适当扩大短线交易规制主体的范围;从立法上明确规制主体的身份界定标准;完善公司管理者和大股东的持股报告制度以及有关部门的信息披露制度;完善短线交易归入制度中的豁免适用规定;明确短线交易归入制度中的利润计算方法等。     

论我国外贸代理制的“权责均衡化”

外贸代理作为国际上通用的商事代理行为,在我国经过了二十多年的垄断历程。2004年我国放开外贸经营权后,外贸代理业虽遇挑战,但作为一种贸易趋势仍不失魅力。外贸代理法律制度的完善有助于外贸代理业的规范化管理,能有效协调当事人权责关系,促进我国外贸发展。我国外贸代理制度须借鉴国际外贸代理经验,明确外贸代理人的法律地位及职责,实现我国外贸代理制的真正"和谐利益"。

本文以中国与东盟5国为研究对象，运用面板数据计量分析方法研究了金融发展对于温室气体排放的影响。结果表明，金融开放程度的提升会降低温室气体排放，金融中介的发展有助于降低温室气体排放，但金融市场的发展对于温室气体排放的影响不确定。榻应的政策建议足：提升中国与东盟各国的金融对外开放与合作程度，发挥金融对低碳产业的支持作用，建立起资本市场对环境信息的披露合作机制，促进中国与东盟碳金融市场一体化发展，推进中国与东盟的清洁能源投资合作等。
