The consideration of ecological safety in judicial practice — also on the ecological safety legislation

Ecological safety has been one of the hot issues of environmental law in recent years. The maintenance of ecological safety has become one of the legislative principles, as exemplified by the revision of the Law of Sand Prevention and Sand Management and the Law against Solid Waste Environmental Pollution, and the relevant rules that will be established. However actual cases will still happen, whether the legislators have made the statutory law or not. While scholars and legislators are debating, the judges have to handle cases and render judgments. Through the analysis of a case, this article will discuss the feasibility for judges to make ecological safety considerations in the judicial process by applying the principle of good faith and will also discuss the legislative issues related to ecological safety.

从环境问题引起法律调整的成因入手,分析现代环境观的价值取向,进而阐明对环境问题予以刑事法律保护的必要性.针对环境刑法所保护的客体,从环境刑法的价值理念分析角度,阐述环境刑法的法益内涵.最后,提出进一步完善我国环境刑事立法的几点建议.     

Nemesis of ‘market fundamentalism’? The ideology,deregulation and crisis of finance

Although the global financial crisis is deepening and becoming increasingly unresponsive to ‘management’, most academic analysts still give priority to the technical aspects of the problem, while governments continue to act as though solutions can be found that will result in a return to ‘normality’. Such functional approaches may be necessary for understanding elements of the crisis and dealing with immediate issues, but are insufficient in the context of what is now revealing itself as a systemic failure: a process that is negatively affecting the economy and society, obliging people to give greater consideration to the kind of world in which they live. This article will seek to address the shift from objective problem to subjective question by examining the political economy of the crisis and the ensemble of factors, ideology, the history of deregulation and politics as well as technical matters, which have led us to this juncture.

当今社会,各种公共安全危机事件频频发生,严重影响了社会稳定。而谣言作为舆论的一种畸形形态,无疑诱发和加剧了这种危机状况,其危害后果不言而喻。因此对公共安全危机情景下谣言的研究是十分必要的。本文分析了公共安全危机下谣言产生的机理和影响因素,并提出了有针对性的抑制谣言的建议和对策。     

我国金融危机的可能性及危机管理

在中长期内中国具有发生金融危机的可能性,面对可能爆发的金融危机,仅仅做到事前防范和预警是不够的,需要在危机的事中和事后管理上进行系统性的研究,从而做到临危不乱,将金融突发事件如金融危机等带来的损失降到最低。     

Optimal transfers and participation decisions in international environmental agreements

The literature on international environmental agreements has recognized the role transfers play in encouraging participation in international environmental agreements. However, the results achieved so far are overly specific. Therefore, we develop a more general framework that enables us to study the role of transfers in a systematic way. We propose transfers using both internal and external financial resources for making “welfare optimal agreements” self-enforcing. To illustrate the relevance of our transfer scheme, we use a stylized integrated assessment simulation model of climate change to show how appropriate transfers may induce almost all countries into signing a self-enforcing climate treaty.      

The Other Side of the Coin: Reading the Politics of the 2008 Financial Tsunami

In the spring of 2009, long months after the September 2008 financial tsunami had begun its destructive journey around the financial machineries of the global system, the governing party of the United Kingdom, one of two countries whose financial centres had precipitated all the trouble, is still in place, notwithstanding the almost audible sound of a population tapping its collective foot as it awaits an electoral opportunity to wreak a measure of revenge. But the electorate is condemned to wait upon the convenience of the government and administrative machineries that are responsible for the debacle. This seems unreasonable. One might ask how is this possible and what—speculatively—could happen to improve matters; that is, one can ask how the elite's insulating machineries might be reduced in order to bring them more routinely within the reach of the judgements of the electorate.     

Toxicant Exposure and Mental Health—Individual, Social, and Public Health Considerations

Abstract:  Thoughts and moods are the result of biological processes; disordered thoughts and moods may be the result of disordered biological processes. As brain dysfunction can manifest with emotional symptoms or behavioral signs, the etiology of some mental health afflictions and some abnormal conduct is pathophysiological rather than pathopsychological. Various studies confirm that some chemical toxicants which modify brain physiology have the potential to affect mood, cognitive function, and to provoke socially undesirable outcomes. With pervasive concern about myriad chemical agents in the environment and resultant toxicant bioaccumulation, human exposure assessment has become a clinically relevant area of medical investigation. Adverse exposure and toxicant body burden should routinely be explored as an etiological determinant in assorted health afflictions including disordered thinking, moods, and behavior. The impact of toxicant bioaccumulation in a patient with neuropsychiatric symptoms is presented for consideration as an example of the potential benefit of recognizing and implementing exposure assessment.
