Isotopic signatures used in the georeferencing of human remains are largely fixed by spatially distinct geologic and environmental processes. However, location-dependent temporal changes in these isotope ratios should also be considered when determining an individual’s provenance and/or trajectory. Distributions of the relevant isotopes can be impacted by predictable external factors such as climate change, delocalisation of food and water sources and changes in sources and uses of metals. Using Multi-Collector Inductively-Coupled Plasma Mass Spectrometer (MC-ICP-MS) analyses of 206Pb/207Pb in tooth enamel and dentin from a population of 21 ± 1-year-old individuals born circa 1984 and isotope ratio mass spectrometry (IRMS) of δ18O in their enamel, we examined the expected influence of some of these factors. The resulting adjustments to the geographic distribution of isotope ratios (isoscapes) found in tooth enamel and dentin may contain additional useful information for forensic identification, but the shifts in values can also impact the uncertainty and usefulness of identifications if they are not taken into account.

Whereas anti-apartheid social movements engaged collectively against a repressive regime, especially in actions against social injustices, post-apartheid civil society has witnessed fragmentation when it comes to engaging jointly against neoliberal risks such as poor/no service delivery, privatisation, and environmental pollution. Civil society has not linked struggles into a coherent ideology to comprehensively challenge neoliberalism and associated risks. Research has not explored the underlying elements that contribute to reinforcing fragmentation. This article reviews the literature on key social and environmental struggles in order to draw out common elements and differences that reinforce fragmentation. The paper highlights the need for social and environmental activists to engage collectively both within their respective arenas, as well as across the social and environmental divide, if an environmental justice framework is to emerge. Social movements advocating social justice could serve as a platform to incorporate environmental discourses into their struggle to assist in formulating an environmental justice framework. 相似文献

作为正在制定过程中的新兴环境立法,自然保护地法、国家公园法等自然保护地立法与环境法体系中的其他法律存在发生规范冲突和赘余的可能,有必要明确其价值定位以及相应的规范表达。在生态文明入宪、入环境基本法的背景下,环境基本法的保护优先原则和综合治理原则内含对优先保护生态整体性的价值期待,需要自然保护地立法予以表达。相较于污染防治法与资源保护法,自然保护地立法以生态环境保护为根本调整目标,且具有调整对象的系统性和调整方式的调适性,契合优先保护生态整体性的需要。为落实这一价值期待,自然保护地立法需构建以分区定保护级别制度、总行为控制制度为核心的制度体系,并采用“自然保护地基本法+各类自然保护地特别法”的总分结构。 相似文献

生态环境损害赔偿涉及私法与公法的协动。从比较法来看,私法在生态环境损害赔偿中的作用有两种解释路径:一是依托既有权利(如所有权、健康权等)受侵害,扩张损害概念,从责任范围层面涵盖生态利益;二是创设环境权或环境秩序权,从责任成立层面涵盖生态利益。两种进路的背后反映了对于公私法关系的不同认识,前者认为公法、私法并行救济,后者则认为私法救济优先。我国环境法学说传统上采第二种进路,而《生态环境损害赔偿制度改革方案》和“民法典草案”则有采扩张损害概念的整合进路的趋势。我国目前立法与司法实践仍存在体系上的龃龉。应当贯彻扩张损害的思路,在构成侵权的情况下,在责任范围中考虑生态利益。在不构成侵权的情况下,具体考量生态环境损害赔偿能否类推适用民法的规则。 相似文献

A great number of organisations and actors are participating in a plethora of international and regional fora geared towards the forest issue. Are there inherent traits about how these fora interact that can increase understanding about why the forest issue seems largely to be at a standstill? In this article I focus on the final meeting of the Intergovernmental Forum on Forests (IFF-4) and examine the overlap with the Convention on Biological Diversity (CBD) and the overlap with the Climate Change Convention (UNFCCC). How have the overlaps between these international fora been dealt with and why has one led to linkages while the other has not?

We present a review of theoretical and methodological advances in the social scientific literature on environmental inequality/racism and argue for new directions in research efforts that pay more attention to (1) the historical forces driving environmental justice conflicts; (2) the complex role of stakeholders in these struggles; (3) the role of social inequality, particularly the trade-offs between environmental protection and social equity; and (4) the impact of social movement activity on the state of environmental protection. Drawing on a case study of an environmental justice conflict in the United States, we find that environmental inequality impacts many actors with often contradictory and cross-cutting allegiances. These struggles therefore become a moving drama—a process—rather than a cross-sectional outcome. We conclude with an analysis of environmental inequality on a global scale and argue that the role of transnational capital remains largely untheorized in the literature.
