Maritime security and the common interests of India and China

The world has changed dramatically over the years, and being two of the world’s largest and most populous developing countries, India and China should remain in close touch on issues concerning developing nations. Today’s challenges to maritime security increasingly comprise more non-traditional threats, such as terrorist acts against shipping, trafficking in weapons of mass destruction, piracy and armed robbery at sea, illicit transportation in narcotic drugs, psychotropic substances and nuclear substances, and smuggling of people and arms. It is therefore important to intensify cooperation at all levels to address threats to maritime security and safety in a comprehensive manner through bilateral and multilateral instruments and mechanisms aimed at monitoring, preventing and responding to such threats.     

北京地区人群(汉族)人血清备解素因子B分布频率的调查及其在血痕中的检出

作者采用琼脂糖凝胶高压电泳、PAGIEF及免疫固定技术测定了北京地区234份健康人(汉族)血清Bf的分布。其表型频率为SS171人,FS49人,FF8人,SS07 4人,FS07 1人及SS045 1人;基因频率为Bf~S=0.8462,Bf~F=0.1410,Bf~(S07)=0.0107,Bf~(S045)=0.0021。Bf表型分布与Hardy-Weinberg定律相吻合。经测定室温保存的已知Bf型的22份血痕,其可检出时限为3周。并将Bf型测定用于检案的血痕分析及亲权鉴定。     

Beliefs About Wife Beating Among Arab Men from Israel: The Influence of Their Patriarchal Ideology

Despite the recent increase in public and professional interest in the problem of wife beating in Arab society, in Israel, and in the rest of the Arab world, there is a serious lack of empirical research on different dimensions of the problem in those societies. This paper presents the results of a survey conducted among a systematic random sample of 362 Arab husbands from Israel, in an attempt to examine the contribution of patriarchal ideology toward explaining their beliefs about wife beating. Although about 58% of the participants indicated that there is no excuse for a man to beat his wife, 15–62% still justified wife beating on certain occasions (e.g., adultery, failure to obey husbands, disrespect for parents and relatives). In addition, although the participants tended to perceive abusive and violent husbands as responsible for their behavior, 52% still expressed understanding of that behavior and, on some occasions, 23–43% even blamed the wife for violence against her. Regression and multiple regression analyses revealed that over and above the participants' age and level of education, their masculine sex-role stereotypes, negative and traditional attitudes toward women, nonegalitarian marital role expectations, and familial patriarchal beliefs were the most significant predictors of beliefs about wife beating. Implications of the results and limitations of the study are also discussed.     

论经营判断原则在欧洲反收购立法中的运用--兼"严格中立原则"之检讨

通过对欧洲反收购立法中采用的严格中立原则中存在的忽视股东集体行动和董事对于非股东利益相关者的义务、经验主义、为政府强制性反收购措施所不容等非理性状况的分析,提出了在欧洲反收购立法中采用经营判断原则的建议,认为这样可以为敌意收购行为提供更统一的运作环境,保护股东利益,减少成员国在建立反垄断屏障的压力,并且为企业在采取反收购行动时提供更丰富的选择。     

银行法中的私人自治原则与国家监管

银行法应当区分为银行私法和银行公法,私人自治是其中的基本原则,银行法许多规范都表现了私人自治原则。通常所提及的国家监管原则只不过是私人自治原则的补充。     

Corporatism packaged in pluralist ideology: the case of Slovenia

Corporatism has been an influential doctrine in the Slovenian polity since its beginning. After the onset of democratization in the early 1990s, its influence remains strong. Forms of corporatism are embodied in the National Council as the second chamber of parliament, in the chamber system, the system of social partnership and the RTVS (Public Television of Slovenia) Council. It is also present in certain socio-political priorities such as a higher value being placed on partnership over competition, on fairness over human rights, on community over individualism. Social pluralism has always been a part of Slovenian public life. Political pluralism emerged at the end of the 19th century and was never fully developed. There has always been a strong inclination in the political life of Slovenia to organize around interest groups and editorial boards of various publications, a tendency that reveals a plurality of voices but a general unwillingness to fight for political power. It could also be concluded that the development of pluralism in Slovenia relies heavily on corporatism because of the general lack of liberal foundations.     

THE PRIVATIZATION OF VIOLENCE*

Norbert Elias's (1939) work on “the civilizing process” highlighted the long‐term decline in violence within Western societies. A substantial amount of more recent anthropological and historical evidence suggests that violence has evolved not just quantitatively but qualitatively as well. In particular, the social characteristics of the parties to violence have changed over time. Drawing on Donald Black's (1976, 1993a) theoretical ideas on conflict management, the present paper proposes that as intimate social ties weakened and the state strengthened, collective and nonintimate forms of (nonpolitical) violence declined significantly. Consequently, violence increasingly became less public, more private. Pockets of residual public violence can, however, still be found within modern state societies. Privatization varies, then, across time and social space.

《治安管理处罚法》第六十七条规定了引诱、容留、介绍卖淫的行为,正确理解其客观表现形式,解决认定中的棘手和难点问题,对正确区分违法与不违法、违法与犯罪有着重要意义。

行为能力是自然人以自己独立的行为参加民事法律关系,设定权利、义务的必要条件。然而在实践中,一些成年人由于存在生理上或心理上的疾病、障碍,使他们的行为能力产生缺陷,无法正常参加民事活动。为使这部分成年人的合法利益得到有利的法律保障,维护交易活动的安全,大陆法系各国均以行为能力限制制度,对他们参加民事活动进行了制约。

依法执政是中国作为执政党的中国共产党在新形势下执政方式的重大调整和深刻转变,是在依法治国、建设社会主义法治国家的时代背景下执政党执政理念法治化的根本体现,也是顺民心遂民愿的明智之举。依法执政理念要作为指引执政党执政实践的正确航标,本身需要从法治而非人治的视角进行明确的梳理和辩思。
