论国际法与国内法的辨证关系

国际法与国内法的关系问题是国际法的一个基本理论问题,其实质是国内法在国际交往关系中占居何种地位以及国家如何在国内执行国际法。本文在回顾国际法与国内法关系的有关理论的基础上,论述了国际法与国内法的本质区别和相互联系,较客观地揭示了国际法与国内法的辩证关系。     

从国际金融危机的影响机制看扩大内需的必要性及其路径选择

国际金融危机对各国经济的影响机制不尽相同,相应的治理机制也会有很大变化。与美国相比,国际金融危机对我国经济的影响机制几乎完全相反,主要表现为从实体经济向金融系统传导,从下游产业向上游产业渗透,从国外向国内、从沿海向内地扩散。相应地,应对国际金融危机,我们不会以金融治理为重点,而是以实体经济为重点、重心下移。在应对的内容和措施方面,必须综合治理,出台扩大内需的系统化解决方案。     

反家庭暴力对策的比较研究

对家庭暴力的防治 ,必须建立完善的“配套工程” ,加强反家庭暴力的法治观念教育 ,提高国民对家庭暴力的认识 ,维护正确的家庭观念 ,并将其渗透至社会生活的方方面面。针对我国现阶段的国情 ,只有立法、社会救助与普法相结合 ,才能真正做到预防与消除家庭暴力。     

Towards identifying and ranking selected types of violence against women in North India

ABSTRACT

The paper is aimed at identifying and ranking different types of violence against women (VAW) in states of Delhi and Haryana in Northern India. Examples of gender-specific violence were selected through an extensive review of the literature. The types of VAW reviewed include the lower economic value of daughters at birth (females being considered a liability rather than an asset), rampant female feticides aided by proliferation of often illegal prenatal diagnoses, maternal morbidity, and mortality rates, physical and emotional abuse and neglect of female children, “honour” killing of women, exclusion and deprivation of women from medical treatment and nutrition, their subjection to assaults and rape (including marital rape), insufficient compliance to women’s legal rights of inheritance, arranging early marriages of girls, dowry deaths, female sexual harassment, and intimidation in community and workplace, female trafficking and prostitution, and so forth.

The conceptual frame of reference used for the study was provided by the culturally sanctioned legitimation of the patriarchal system of Indian family as well as by people’s perceptions and attitudes. Data were collected through the survey method in two phases. A preliminary survey was conducted during the first phase for developing the questionnaire items to be used for data collection in the phase two of the study. The findings of the study are presented and reveal participants’ rankings of selected types of VAW by degree of relative importance. Data, based on secondary sources as well as a non-random sample of respondents, were analysed to assess the various areas which demand immediate redress. We also interpret data based on selected criteria and suggest few optimistic future trends in regard to addressing and preventing VAW.

本文就图书馆如何适应学院的发展,顺应新的形势,为高职教学和科研服务,以及图书馆面临着的困难和“藏”与“用”的矛盾,从提高文献采购质量、强化图书馆内阅功能、调整和延长开放服务时间、改进读者服务工作、认真做好新生教育工作等几个方面联系实际,阐述了图书馆如何适应学院教学工作和科研的发展,紧紧地围绕学院的中心工作,更好地发挥图书馆功能的方法和措施。     

Mitochondrial DNA sequencing of cat hair: an informative forensic tool

Approximately 81.7 million cats are in 37.5 million U.S. households. Shed fur can be criminal evidence because of transfer to victims, suspects, and/or their belongings. To improve cat hairs as forensic evidence, the mtDNA control region from single hairs, with and without root tags, was sequenced. A dataset of a 402-bp control region segment from 174 random-bred cats representing four U.S. geographic areas was generated to determine the informativeness of the mtDNA region. Thirty-two mtDNA mitotypes were observed ranging in frequencies from 0.6-27%. Four common types occurred in all populations. Low heteroplasmy, 1.7%, was determined. Unique mitotypes were found in 18 individuals, 10.3% of the population studied. The calculated discrimination power implied that 8.3 of 10 randomly selected individuals can be excluded by this region. The genetic characteristics of the region and the generated dataset support the use of this cat mtDNA region in forensic applications.     

PROTECTING LIVES,CAREERS, AND PUBLIC CONFIDENCE: FLORIDA'S EFFORTS TO PREVENT OFFICER‐INVOLVED DOMESTIC VIOLENCE

Florida's innovative Law Enforcement Families Partnership (LEFP) was created to reduce and prevent officer‐involved domestic violence in the state. Administered by the Institute for Family Violence Studies at Florida State University and supported by the criminal justice and victim's advocacy communities, the LEFP is the first statewide project of its kind. It includes several components, the cornerstone of which is an online curriculum that teaches officers about the dynamics and consequences of domestic violence perpetrated by officers. This article describes the project and early data from the surveys attached to the curriculum.     

ATTACHMENT PERSPECTIVES ON DOMESTIC VIOLENCE AND FAMILY LAW

Lieberman and Zeanah are specialist clinicians, researchers, and prolific publishers in the areas of infant mental health, attachment development in high‐risk environments, and treatment of infant–parent relationship trauma. In this article, Lieberman and Zeanah discuss the impacts of domestic violence on the attachment security and development of infants and children and address a number of implications for the family law context. Conundrums for parenting visitation and living arrangements are considered, together with the need for multidisciplinary, early response and the pivotal role of family courts in directing this response.
