International assistance to democratic reform in Ukraine: an opportunity missed or an opportunity squandered?

The article examines the impact of international expert advice on efforts to introduce democratizing reforms in Ukraine’s system of public administration following independence in 1991. The focus of the analysis is on an area which has particular resonance in the light of recent events in Ukraine, the relationship between Kyiv and the regions. The article argues that the effectiveness of external assistance has been compromised as much by institutional factors affecting the behaviour of international donors as by corresponding factors on the Ukrainian side, and that an opportunity to contribute to the democratic transformation of Ukraine has been needlessly wasted.

内部交易指金融企业集团内被监管实体直接或间接地与集团内其他实体履行契约性或非契约性、支付性或非支付性债务所进行的任何交易,在有积极意义的同时也带来潜在风险。金融控股集团内部交易的规范有赖于内控机制建设、外部监管、市场披露三个层面的共同作用。我国目前正在制定的《金融控股公司监管条例》正是通过对金融控股公司施加内部控制的法律义务来实现对金融控股集团内部交易的有效监管。     

Deep Frustration of the Egyptian "Dream to Build a Powerful Nation"

For many years,Egypt sought to become a powerful nation,but failed in its efforts,because its ruling foundation has deviated from the majority of the broad masses,its development path has strayed from its goal of industrialization,and its extemal strategy has gotten away from the line of non-alignment.The lessons of Egypt should be learned by other nations.     

Enforcing and disrupting circular movement in an EU Borderscape: housingscaping in Serbia

ABSTRACT

This article examines Western Balkans/EU bordering and debordering practices through a borderscape method in the context of the geopolitical positionality and (de)institutionalization of migrant housing in Serbia. From this perspective, a new ‘border variation’ can be seen emerging after the securitarian turn, transforming the external borderscape of the EU into a space of circular movement. The article sheds light on discourses, practices and places that constitute these spaces of circular movement within the EU external borderscape. In particular, the Western Balkans borderscape is investigated with reference to Serbian migrant housingscapes emerging at the intersection of state-run camps and migrant collective self-organized squatted housing. The focus on migrant housingscapes points to the interconnectedness of camps and squats in the process of facilitating circular movement by the state, the production of mobile commons as a debordering practice, and the production of visual representations of the external border as stabilized ‘scape’ for the EU.     

论环境法的调整对象

按照传统的法学观点 ,制定和实施环境法的目的是为了利用环境的外在价值 ,确认和保护人类自身的利益 ,因此 ,环境法的调整对象只能是人与人之间关于环境的社会关系。但是 ,环境的内在和外在价值是统一的 ,两者存在共损共荣的关系。承认和保护环境的内在价值对于保护人类自身的利益、维护其他物种在自然法则面前的平衡发展是非常必要的。人类作为地球上唯一具有理性思维的人应该用法律来确认和保护这种价值。用法律来确认和保护这种价值的最好方法是承认环境法可以调整人与环境的关系。

公司治理结构是产生会计政策选择的内在动因,公司内部和外部治理结构是影响会计政策选择的重要因素。根据我国公司治理结构的特点,我国公司会计政策选择当务之急是完善公司治理结构,规范会计政策选择,从而有效提高会计信息质量。

在业主的建筑物区分所有权中，确定外墙、屋顶平台、停车位、停车库、地下室等，是属于共有部分还是专有部分，抑或单独所有权的客体，需要综合考虑以下因素：（1）它是否被单独登记为一个独立之物。如果尚未被单独登记为一个独立之物，则应为共有部分；反之，可以成为专有部分或单独所有权的客体。（2）建筑物区分所有权的本质属性。我们确定外墙等部分的性质和所属，不得违背建筑物区分所有权的本质属性。（3）法律、行政法规的强制性规定。如果法律、行政法规的强制性规定就此作了专门规定，该规定应为我们确定其性质和所属的依据。当然，此类强制性规定不应违反前述原理。（4）有关当事人的约定。如果有关当事人在不违反前述（1）（2）的前提下，就此作了约定，应依其约定。
