血液乙醇检测内外标法比较研究

目的通过比较内标法和外标法对血液乙醇含量检测结果,探讨外标法在法医学实践中的应用价值。方法通过收集2005年10月~2006年12月间本中心符合检测要求的血液样品263例,每例分别采用内标法和外标法进行血液样品乙醇含量检测,比较其检测结果。结果外标法检测时间短(2.5min),用量0.5ml,而内标法检测时间长(6.5min),样品量1.0ml;外标法检测血乙醇平均浓度为89.30mg/100ml,内标法检测血乙醇平均浓度为92.37mg/100ml,P=0.001。结论外标法检测时间短(2.5min),用量少,节约检材,可作为大量待测血液样本的筛选检查手段。     

西部生态农业的外部性损害与国家补偿法律制度片论

生态农业作为一个农业生态经济复合系统 ,反映了两种具体的社会关系 ,一是农业内部及农业与其他产业间的关系 ;二是农业与生态环境的关系。针对西部农业明显的外部经济性 ,应当依法创建国家补偿法律制度 ,依照可持续发展原则、依法补偿原则和效率与公平兼顾且侧重于公平的原则加以补偿。     

论公司对外担保若干问题--兼评我国《公司法》第60条第3款

公司为他人提供担保,本质上是公司之经营行为.早期,因为强调对股东等投资人的保护,各国多对公司对外担保予以严格限制.在现代,各国对公司对外担保的限制日益放宽,甚而不再对其加以特别限制.公司对外担保应当由公司董事会自主决定.公司对董事会权限的限制,不得对抗善意第三人.同时通过对董事责任的追究来避免公司滥设担保之风险.我国<公司法>第60条第3款对公司对外担保的规定因为用语模糊,多有歧义,且不能适应公司法之现代发展,应予废除.     

Housing Voucher Take‐Up and Labor Market Impacts

Low participation rates in government assistance programs are a major policy concern in the United States. This paper studies take‐up of Section 8 housing vouchers, a program in which take‐up rates are quite low among interested and eligible households. We link 18,109 households in Chicago that were offered vouchers through a lottery to administrative data and study how baseline employment, earnings, public assistance, arrests, residential location, and children's academic performance predict take‐up. Our analysis finds mixed evidence of whether the most disadvantaged or distressed households face the largest barriers to program participation. We also study the causal impact of peer behavior on take‐up by exploiting idiosyncratic variation in the timing of voucher offers. We find that the probability of lease‐up increases with the number of neighbors who recently received voucher offers. Finally, we explore the policy implications of increasing housing voucher take‐up by applying reweighting methods to existing causal impact estimates of voucher receipt. This analysis suggests that greater utilization of vouchers may lead to larger reductions in labor market activity. Differences in take‐up rates across settings may be important to consider when assessing the external validity of studies identifying the effects of public assistance programs.

日美经济关系失衡与日元国际化政策

日本的日元国际化政策并非是日本政府出于维系经济增长熨平经济波动而做出的自主性决定,而是在美元汇率走高、美国贸易赤字激增的背景下,迫于美国要求开放金融市场的压力而采取的政策措施。对日本来说,日元国际化只是追求金融大国地位的一环,而且货币国际化对货币发行国来说是一把"双刃剑",因此在实际执行中被排在其他政策目标之后。     

外在机缘与内在理路——当代日本的中国法制史研究

在法史学危机的背景下,当代(主要是战后)日本的中国法制史研究具有重要的参考价值,其在资料性、传承性与方法论上对中国学界有重要的借鉴意义。借用余英时关于清代思想史研究的分析框架,以仁井田陞和滋贺秀三等代表的学人为例,我们可以发现,其研究虽然受到外在机缘的一些影响,但在内在理路上仍恪守了学术本位的"虚学"立场,这种为学术而学术的精神是其成功最重要的因素。     

论基层警察行政执法行为的外部控制及其反思

本文认为,对行政执法行为的控制途径有两种方式：内部控制和外部控制.以法律法规、组织制度、组织结构等外部控制方法对基层警察行政执法行为进行管理存在许多不足之处,同时还易造成警察执法自主性的流失.所以,应培养基层警察行政执法的自主性,以形成基层警察行政执法行为内部控制和外部控制两个向度的合力.     

Challenges for EU governance through Neighbourhood Policy and Eastern Partnership: the values/security nexus in EU–Belarus relations

Whereas the European Union (EU) has had some effect on political and economic reforms in the Ukraine and Moldova, it almost completely failed to impress the regime and population of Belarus. Despite growing consensus at the EU level that the Union's policies for Eastern Europe cannot succeed without Belarus, few attempts have been made to account for the failure of EU governance in Belarus. Having recalled the current legal and institutional set-up of EU–Belarus relations, this article introduces the notion of the ‘values/security nexus’ to explain the limited impact of EU governance in Belarus. It argues that the highly contradictory normative objectives in the Union's current Neighbourhood Policy towards Belarus effectively undermine the EU's credibility in the country: idealist values of ‘winning the hearts and minds’ of the Belarusian population increasingly collide with traditional realist goals of protecting EU interests and the stability of the Belarusian state. By way of conclusion, the article highlights the challenges facing the EU's new Eastern Partnership, including Belarus.     

Predictors of an Effective Performance Measurement System: Evidence from Municipal Governments in Turkey

The study examines the predictors of effective performance measurement in the context of Turkish municipalities. Theoretical guidance of context-design-performance model has been utilized to examine the contextual and design factors which have influenced the effective use of performance measurement systems in Turkish municipalities. It is hypothesized in the study that external support and organizational support for the use performance measurement, and technical capacity for the performance measurement are associated with quality of performance measures and effectiveness of performance measurement systems in general. The results of the study supported the hypotheses of the study regarding the relationships among organizational support, technical capacity, quality of performance measures, and effectiveness of performance measurement. Although the results confirmed that external support has an indirect effect on effectiveness of performance measurement via technical capacity and quality of performance measures, the hypothesis regarding the direct effect of it on effectiveness of performance measurement was not supported.
