审理存单纠纷案件若干问题探讨

最高人民法院公布的《关于审理存单纠纷案件的若干规定》司法解释施行八年来,全国法院依据该司法解释审结了大量的存单纠纷案件,取得了丰硕的成果,但是在适用该司法解释时各地法院的认识却不尽相同,特别是在存款的所有权归属、存单的法律特征、以存单为表现形式的借贷纠纷案件的认定、公款私存问题等方面的认识仍存在分歧,本文将对上述问题进行分析。     

Childhood Abusive and Supportive Experiences, Inter-Parental Violence, and Parental Alcohol Use: Prediction of Young Adult Depressive Symptoms and Aggression

Issues in both the children of alcoholics and child abuse literatures were addressed in an attempt to disentangle the effects on young adults of growing up in alcoholic homes versus abusive homes. Using multiple regression, retrospective reports of parental abuse (emotional, physical, and sexual) and parental support (love/support, independence, and fairness), witnessing violence between parents, and parental alcohol use were used as predictor variables for outcomes noted by both literatures. When the effects of all other predictors were statistically controlled, parental alcohol use was not significantly related to depressive symptoms or aggression. Different abusive and supportive behaviors, depending on sex of parent and sex of participant, were significant predictors of both depression and aggression. Results underscore the importance of including and controlling for inter-parental violence and for different types of child abuse (especially emotional abuse) and parental supportive behaviors in investigations of outcomes related to abusive and alcoholic families. Implications for treatment of individuals from these families are discussed.

The fair process effect and procedural criteria in the resolution of disputes between intimate same-sex friends

This series of studies extended procedural justice research to the informal domain of dispute resolution in intimate same-sex friendship. The first study identified the types of disputes that occur between friends and the concerns that friends have when choosing dispute resolution procedures. Seven dispute types and 11 procedural criteria were found relevant to dispute resolution in friendship. Study 2 assessed the importance of procedural criteria for resolving several dispute scenarios. As expected, ratings of criterion importance were affected by subject and disputant sex. Females rated four criteria as more important than did males, and one criterion was rated as more important in disputes involving a male and a female than in disputes involving two females. The importance of procedural criteria was also influenced by the type of dispute, but this effect was qualified by an interaction with the dispute version. It was suggested that the importance of procedural criteria is generally defined by the context of friendship and specifically defined by the dispute topic. In Study 3, the relations among subject sex, traditional fairness variables, and criterion-based measures of process control were examined. Consistent with studies in other domains, process control predicted procedural justice, and decision control predicted distributive justive. Moreover, the hypothesized fair process effect emerged as a function of speed, a criterion-based measure of process control.

Violence in Police Families: Work-Family Spillover

This article uses a path model to examine the relationship between violence exposure and domestic violence among police officers with the expectation that the relationships would be both direct and mediated. The mediation factors included burnout, authoritarian spillover, alcohol use, and department withdrawal. The model was tested through an analysis of data collected from 413 officers. Four mediation chains were identified; the most powerful of these was burnout and authoritarian spillover. Suggestions for future research include understanding violence in the context of unique workplace cultures, classifying violence types, and clarifying how this population defines violence and control.     

医院未征得患者同意使用自费药纠纷初探——从社会法“倾斜保护”理论的视角出发

在基本医疗保险制度施行中,医保定点医院未征得患者同意使用自费药的行为构成对患者的一般侵权或侵权违约的竞合;针对医患双方实质地位的不平等,应运用民法及有关社会法的“倾斜保护”理论处理自费药纠纷且应授权执法者考虑个案的具体情况,决定医患双方间如何分担自费药费用,以实现公平正义的法律追求及维护医保患者的利益。

如何提高机动车交通事故责任纠纷案件调解率

目前,机动车交通事故责任纠纷日益增多,交通事故受害人因种种原因不能得到救助。为此,笔者以辽宁省某市交通事故处理方式为研究对象,探讨了交通事故理赔过程中存在的问题及原因,并从审判的视角提出建议和对策,以期能够引起关注,对进一步搞好涉及保险公司机动车交通事故赔偿纠纷的调解工作。
