性犯罪药物防治入刑的正当性及本土形塑

近年来,我国性犯罪出现的一些新情况令人堪忧,需要探索新的治理政策。有的国家采取性犯罪药物防治作为性犯罪的治理手段,值得借鉴。性犯罪药物防治是利用口服或者注射药物方式减少罪犯的雄激素、降低其性欲,达到控制性犯罪目的。有人认为这是残虐、不人道的,侵犯身体健康与性权利。而性犯罪药物防治相比起物理阉割更具人道主义精神,有利于保障基本人权,其尊重受者自由意志,具备一定的社会容忍度,执行方式高效经济。但此种手段需要加以本土化改造,需要规范法律术语,明确刑法性质与适用对象,细化执行程序。     

家庭决策、孝道与农民工家庭养老--基于夫妻视角的分析

利用2014年“农村流动人口发展状况”调查数据,基于夫妻视角对现代家庭决策与传统孝道观念行为对农民工家庭养老的影响进行分析的结果表明,农民工夫妻在父母经济支持和日常照料方面不存在显著差异,但在情感支持方面差异显著。影响因素分析结果表明：在经济支持和情感支持方面,对丈夫而言,平等的家庭决策和孝道观念是重要因素;对妻子而言,影响因素主要体现在孝道行为。在日常照料方面,影响因素仅仅体现在家庭决策方面,丈夫表现在现金支配决策方面,妻子表现在子女教育和自己外出打工决策方面。     

《唐律》别籍异财之禁探析

禁止别籍异财是中国古代法律规范家族财产、维护家族制度的一项重要规定,但长期以来人们往往将其视作一个整体,忽视别籍和异财的相对独立性及其相互关系。根据《唐律》和其他原始资料,我们可以看到别籍和异财实际上是两个问题而又紧密联系,法律禁止的重点是别籍而不是异财。

Family Processes and Delinquency

Abstract

This paper examines the relationship between family processes and delinquency. A multiethnic sample was utilized to determine whether the impact of parental attachment, involvement and supervision on delinquency is consistent across Latino, White and African American youth. Analysis of two waves of data from the 1997 National Longitudinal Survey of Youth indicates that relationships are not identical across ethnic and gender groups. Group differences uncovered by the current study are consistent with earlier research on family processes and suggest that both ethnicity and gender are important considerations when estimating the influence of the family on delinquent behavior. Theoretical and policy implications of group differences are discussed.     

Narrative Therapy and Peacebuilding

Dealing with trauma and loss in a post-conflict environment demands nuanced responses that take into account individual-level healing work and avoid standardized, statist, institutionalized solutions which tend to prioritize national unity by subordinating disparate individual memories. This article explores how narrative therapy advances the use of local initiatives, skills and values, challenges notions of therapeutic governance and generates possibilities of experiencing an increased sense of agency. Further, it introduces a range of collective narrative methodologies that open up the space for diverse meanings and alternative stories that can contribute to peacebuilding and recovery from the effects of trauma.     

Stressful Life Experiences and Peer Externalizing Behaviors Mediate the Relation Between Reduced Family Support and Externalizing Symptoms in Low-Income Urban Youth

Family support, urban stressors, and peer behavior were examined in relation to externalizing symptoms in 605 predominantly low-income urban sixth through eighth grade adolescents. Mother and father support were each associated with lower levels of externalizing symptoms in both males and females. For males, father absence was associated with increased peer externalizing behavior and heightened rates of youth externalizing symptoms. Stress (in the form of major life events, daily hassles, and exposure to violence) and peer externalizing behavior were examined as mediators of the relation between parent support and youth externalizing symptoms. Increased stress exposure mediated the relation between weak mother and father support and youth externalizing symptoms. Additionally, for females, peer externalizing behavior mediated the relation between weak mother support and youth externalizing symptoms.
