家庭暴力与法律规制

家庭暴力是世界公害 ,也是我国一个严重的社会问题。我国现有法律法规在预防和制止家庭暴力方面起了很大的作用 ,但也存在诸多不足之处。进一步完善立法 ,加强对家庭暴力的法律规制 ,是遏制家庭暴力 ,切实维护家庭暴力受害者合法权益的必然要求

新婚姻法的进步性与缺陷

修改后的婚姻法具有极大的进步性:体现了法律与道德的融合,克服了原有婚姻法的一些弊端,完善了法律体系。修改后的婚姻法仍存在缺陷:内容不够全面,有些制度不够完善,法律条文存在逻辑上的错误。本文对修改后的婚姻法的进步性与缺陷进行了分析,并希望立法机关制定单行法或最高人民法院作出司法解释弥补缺陷。     

Family violence and depressive symptomatology among incarcerated women

This study examines the potential association between witnessing parental violence as a child and later adult depressive symptomatology within a population that has received limited attention in the scientific literature, namely, incarcerated women. The Conflict Tactics Scale and the Center for Epidemiological Studies Depression Scale were administered to 60 women incarcerated in a maximum security prison in North Carolina. A majority of the women reported that they had witnessed verbally aggressive or physically violent interactions among the adult members in their families. Seventy percent of these women suffered from clinically relevant levels of depressive symptomatology. Stepwise multiple linear regression analysis revealed that increasing levels of reasoning conflict resolution strategies used in the women's families of origin were associated with decreasing levels of depressive symptomatology of the women, whereas increasing levels of physically violent conflict resolution strategies were associated with increasing levels of depressive symptomatology.     

Toward the Assessment of Procedural and Distributive Justice in Resolving Family Disputes

The first phase of this study focused on the development of comprehensive, conceptually integrated measures of procedural and distributive justice in the context of family decision making. In the second phase, these measures were used to examine older adolescents' justice appraisals of specific family disputes and the relation of these justice appraisals to family systems functioning along dimensions of conflict and cohesion. A Family Justice Inventory was constructed, which included two global indices (one for procedural justice and one for outcome fairness) and 13 subscales: 9 measuring specific facets of the procedural justice construct and 4 measuring specific dimensions of the distributive justice construct. Factor analysis revealed that the 13 Family Justice Inventory subscales could be reduced to 5 interpretable procedural justice factors (personal respect, status recognition, process control, correction, and trust) and 4 interpretable distributive justice factors (decision control, need, equality, and equity). Using procedural justice factor scores in regression analyses, personal respect, status recognition, correction, and trust each accounted for unique variance in family conflict and family cohesion. Additionally, equity also accounted for unique variance in family conflict but not family cohesion and the direction of the relationship was positive, that is, more equity in resolving specific family disputes was associated higher levels of general family conflict.

家庭教养方式是儿童社会化的重要因素，受到国内外心理学家的重视。该文综述了中外心理学家在儿童社会化研究中对家庭教养方式研究的成果，概括了近20年来，中国学者在家庭教养方式研究中呈现的诸如教养方式与儿童社会关系的探讨从宏观系统走向微观、具体，进一步探究教养方式的内在结构，尝试从更多方面寻找教养方式的影响因素等特点。家庭教养方式研究成果的取得，受到三方面因素的推动，首先，它与人类对自身探究的好奇心分不开。其次，它与儿童发展观念及理论的进展所产生的影响分不开。再次，它与心理学研究的现场化，研究手段的综合化、数学化所带来的影响分不开。     

现阶段我国家庭暴力现象浅析

家庭暴力日益成为严重的社会问题,我国家庭暴力有其自己的特征.我们可以从功能主义、冲突论、交换/控制论和女性主义社会学视角几方面审视家庭暴力的成因,并对反家庭暴力的对策进行初步的思考和探索.     

Cave Jurisdictionem – Recent Cases on Family Law and Conflicts in Australia

This article examines some recent decisions of the Family Court of Australia as they relate to matters of private international law in family law matters. Although the notion of forum non conveniens is considered, a major focus remains on the approach of the jurisdiction to the Hague Convention on Civil Aspects of International Child Abduction. In the various issues which have appeared before it, the Family Court of Australia has demonstrated a degree of confusion which suggests that other jurisdictions should be cautious in their dealings with Australia in the areas which the article discusses.Professor of Law, University of Newcastle (NSW).     

Preventing relapse versus “stopping” domestic violence: Do we expect too much too soon from battering men?

Given the deeply entrenched habit patterns that characterize domestic violence, the author questions the enormous demands for change that are immediately placed on both abusive men and the clinicians treating them. Battering men are not only required to abruptly and permanently halt overt physical violence, but they are also expected to stop all expressions of dominance and intimidation, and to abandon all their exploitative attitudes and sex-role expectations as well. While it is feasible and necessary to insist upon the cessation of physical violence in order to protect the spouse and family, to what degree can the clinician also demand a total revolution in the abusive male's attitudes, social behavior, and values? To better demonstrate the excessivity of these demands, the author makes a comparison to the treatment of substance abusers, where the features of relapse and enduring cognitive distortions are expected and permitted as part of the normal extended course of recovery. Instead, the author proposes a more realistic and humanitarian set of therapeutic expectations for change, emphasizing relapse prevention and supportive maintenance.
