月神是中华民族崇拜的神灵,也是艺术创作的原型,通过月神原型分析,可以烛见中华民族和东方文化的价值及其独特魅力。     

红水河流域文化艺术遗产保护及其衍生载体的建设

至今仍然传承在黔桂两省区交界处的壮、瑶等民族的铜鼓艺术、蛙神崇拜以及民间歌咏习俗,具有重要的作为人类口头与非物质遗产的保护价值,很有必要将其中的一些文化元素融入体现区域族群生存智慧和文化理想的现代生活空间的建构之中,让千百年来生生不息的民族文化艺术资源在新的衍生载体中焕发生机活力。     

查缉中的语言伪装艺术

查缉是民警一项经常性的危险性较大的工作,民警在查缉中运用一些合理的巧妙的语言伪装技巧可有效地迷惑、麻痹和稳定犯罪嫌疑人,起到隐蔽、保护自己及群众和寻找、制造战机,最后克敌制胜的作用。     

The Optimal Distance of the Electrode to the Lifting Film Surface when Lifting Dust Footwear Impressions Using an Electrostatic Dust Print Lifter

Footwear impressions are one of the valuable physical evidence encountered at crime scenes and its identification can facilitate narrowing down the suspects and establishing the identity of the criminals. The technique of electrostatic lifting (ESL) dust shoeprints at crime scenes is well established with scenes of crime examiners. And in the procedure, the recovery of the original item containing the impression should be made as good as it can and not damage the marks. In this study, the different particle sizes of SiO₂ were used to simulate dust and light soil residues, comparing different particle sizes and electrode positions were used to compare the adsorption ability on the surface of electrostatic lifting film in high‐voltage electrostatic field for the collection of shoeprints. The results indicated that lifting film in electrostatic field will be pressed down to the dust surface, the compaction and electrostatic adsorption force will vary with the distance between the high‐voltage electrode and film surface. Reducing the distance can increase the electric field strength near the lifting film, and the adsorption capacity of Mylar aluminum‐plating film to dusts can be improved significantly. Adsorption capacity of the lifting film was related to the size of dust particles and significantly improved with the increase of the particle charge. The optimum distance which can get the best adsorption capacity between the electrode and film surface is from 10 to 15 mm.     

On the “Economic Dilemma” within the Performing Arts

This article contributes to our understanding public art at the local level by providing analysis of local government public art programs. A survey was conducted with cities and towns in Arizona that have public art programs. The article begins by defining public art and explaining how government funding for public art began in the United States. Next, it highlights the benefits of public art. Public art program funding sources, budgets, maintenance, personnel, and promotion techniques are discussed for the cities/towns surveyed. Last, recommendations are provided for cities/towns seeking to create or expand their public art programs.     

Globaloney: Economic Versus Cultural Convergence Under Conditions of Globalization

Using the theory of the commons and social obligation theory of inclusion, this article critically examines current art museum fundraising practices in the United States that rely too much on traditional White, wealthy patrons. This leads museums to emphasize the limited interests of traditional donors, neglecting the needs of and potential support from their broader communities. This results in the tragedy of the anticommons, where museums are underused by diverse publics. The article advocates for more inclusive relationship-based fundraising practices that build relationships with local community members and include their perspectives on fundraising practices through diversifying fundraising leadership, understanding diverse giving patterns, and utilizing innovative fundraising methods while remaining sensitive to cultural differences.     

Democratic Practices in Arts Organizations

This article uses democratic political theory to compare three types of arts management practices. When art is treated as an elite status good, it is likely to have antidemocratic effects that largely reproduce status hierarchies. When art is treated as an exclusive group identity good, as in the case of identity politics, it is likely to contribute to democracy by giving voice to marginalized groups. Finally, when art is treated as an inclusive social good, it is likely to contribute to democracy by producing solidarity and encouraging commonality. The article concludes by encouraging an ecological approach that fosters multiple voices and multiple goals.     

论境外影视作品版权的二元保护

原《著作权法》第4条规定＂依法禁止出版、传播的作品,不受本法保护＂。该规定对境外影视作品未予以充分保护,不仅违背了＂版权自动取得＂原则,而且招徕版权国际纠纷。中美争端案让我们开始反思境外影视作品的保护模式,并加快了对境外影视作品保护的研究进程。本文对一元版权保护模式作出了反思,并以二元理论为视角对境外影视作品的版权及其保护作出论证。希冀在二元保护模式下提高对境外影视作品法律保护的能力,减少版权国际纠纷,促进我国版权国际化的发展。     

论专利申请人之现有技术披露义务

问题专利产生了严重的社会后果,提高专利授权质量具有迫切性。高质量的现有技术检索是提高专利授权质量的前提,这在专利申请数量巨大的背景下显得尤为重要。专利申请人及其代理人在专利审查过程中,应向专利审查部门依诚信原则披露其所知悉的、对申请案之可专利性具有关键性价值的参考资料。建立具有法律效力的现有技术披露义务符合专利制度的立法目的和利益平衡原则,节约现有技术检索的社会成本,从而保障专利审查中现有技术检索的质量。我国《专利法》第36条规定了该义务,但没有规定相应的法律后果。我国应通过立法和司法两方面来完善申请人的现有技术披露义务。
