我国金融业反洗钱现状及政策建议

实践证明,现代金融系统正成为洗钱的主要渠道,特别是随着金融全球化、网络化、一体化趋势的不断加强,利用金融系统进行洗钱的活动会日益增长。因此,防止利用金融系统洗钱就成为法律制度建设的重要任务和亟待研究的课题。     

论东亚货币基金的创建

亚洲金融危机使得东亚地区的货币合作提上日程。《清迈协议》的达成 ,即“10 +3”(东盟 10国加中、日、韩 )框架下的双边货币互换协议的陆续签定 ,标志着东亚区域货币合作迈出了具有历史意义的第 1步。然而 ,货币互换只是货币合作的最初形态 ,随着东亚区域经济一体化的进展 ,货币互换合作必将向更高层次的货币基金合作的方向发展。东亚货币基金的创建不仅是必要的 ,也是可行的。不久的将来EAMF一定会展现在世界人民面前

近百年不遇的世界金融危机在骤然冲击宁夏经济社会生活的同时,对宁夏人的发展信心也形成了巨大的压力,自治区第十次党代会提出的跨越式发展的目标与蓝图仅仅实施了一年多就遇到了未曾预料到的严重挑战,宁夏人的勇气和智慧面l临着严峻考验。宁夏人增长了见识,经受住了考验,不仅经济保持了平稳较快发展,而且其精神世界进一步丰富,自信自强更加显现。     

The Organisational Culture of the Chaebol and Workplace Inequality: Stunted Mobilities of Korean Chinese Employees in a Beijing Subsidiary

The chaebol’s organisational culture was the target of much criticism when the Asian financial crisis hit the Korean economy in 1997. Despite much research on the topic over the past two decades, there continues to be a lack of consensus on the efficacy of reforms implemented since then. While some have focused on persisting patterns of paternalism, others have highlighted the structural changes implemented. This article revisits this debate by analysing the ways in which culture influences the implementation of structural reforms as a legitimating ideology. By analysing ethnographic data of a chaebol subsidiary in Beijing, the article demonstrates how cultural tropes of the company as a family and women as caretakers, popularised under the Park Chung Hee regime, have continued to shape perceptions of competence in the workplace. In particular, despite the crucial role that Korean Chinese employees have played in helping the chaebol penetrate Chinese markets, their bilingual and bicultural skills are devalued. Instead, the feminisation of their labour has justified their continuing marginalisation in the firm.     

我国P2P平台准入制度的检讨与重构

目前,我国P2P平台准入制度尚存在准入方式不当、准入条件混乱和准入标准模糊等不足,导致P2P市场出现野蛮增长、良莠不齐、鱼目混珠的乱象。重构P2P平台准入制度,应遵循"理念--模式--制度"的路径,以"适度"为理念设置控制与激励双重标准,选择差异化准入监管模式,具化准入方式、条件和标准等实质性要件。     

全球金融法的诞生

全球金融业长期以来由作为国际软法的国际金融监管标准而非国际公约予以规范,但多次金融危机反映了不完善的全球金融治理下产生的国际金融监管标准难以预防金融危机的发生。2008年后随着以20国集团首脑峰会为核心的全球金融治理的重构,首脑峰会承认的国际金融监管标准具有了作为法所需要的国家意志性、正当性和强制性,这些国际金融监管标准也成为了全球金融法。     

骗取银行信用罪之立法解析

《中华人民共和国刑法修正案（六）》着重补充和修改了经济领域的四类犯罪,其中尤其以惩治金融领域与证券领域犯罪为显著特色,并相应地加重了对这些经济领域犯罪的刑罚。该修正案第10条新增罪名可以定为“骗取银行信用罪”：本罪的主观方面为直接故意;本罪的客观方面表现为采用欺骗手段取得银行信用,在结果上给银行造成重大损失或者有其他严重情节：关于重大损失的数额认定应截止到人民法院一审判决前。     

西部大开发中的财政投资问题及发展策略

财政投资是政府调控经济运行、缩小东西差距的一种重要手段。对西部的财政投资政策应遵循市场导向、对内对外同时开放、可持续发展、物质资源与人力资源并重、政策性与有偿性相结合等原则。要提高中央财政在西部地区投资的比重 ,对西部地区企业实行适度的投资补贴 ,加大国家财政贴息和信贷支持的力度 ,充分发挥国家财政投资的诱导作用 ,引导民间资本参与西部开发。     

论经济法在防范金融风险中的价值功能

2008年美国金融危机的爆发,更加凸显了经济法的价值理念,同时也是对经济法价值理念的一次实践检验。经济自由与经济秩序的统一,决定了政府与金融企业行为应纳入法治轨道,并保持各自的行为边界。对金融业的监管要体现经济法的安全与效率价值,并视经济环境的需要而突出重点。实质公平公正是社会分配的基准、拉动内需的前提、引领＂效率与公平并重＂的分配原则。金融安全是经济社会发展的基础,经济法的发展理念是金融业稳健运行的支撑和保障。我国应进一步弘扬经济法的价值理念,充分发挥经济法制度的前瞻性和预防性功能。     

Generational Poverty Transmission and the Feasibility of Intervention of Children Development Policy——Based on the Empirical Evidence from Baishui County in Shaanxi Province

Generational poverty transmission is one of the most critical challenges in the anti-poverty policy practice and intervention by strengthening and innovation of the children development policy plays a positive role in poverty alleviation. Based on the questionnaire data of the survey in Baishui county of Shaanxi province, this paper analyzes the family asset, characteristics of financial capability and the effect of children self-development perceiving from the perspective of asset-based social policy. Meanwhile, with the project of children development accounts as the main policy intervention form, the paper discusses the feasibility of assets policy for children. The results show that currently anti-poverty practice in the rural area is in urgent need of more positive intervention policy to integrate the family and children development.
