浅议《侵权责任法》生效后如何履行预防接种告知义务

我国法律规定医务人员具有预防接种法定告知义务,以保护受种者的知情同意权和自主选择权。2010年7月1日起生效的《侵权责任法》对该法定义务做出了更为明确和丰富的要求,其中规定了替代医疗方案的告知义。因此,预防接种过程中医务人员应将疫苗的品种等向受种者方予以全面告知。     

单管一步甲基化可变位点分析技术

目的建立单管一步甲基化可变位点（methylationvariableposition,MVP）分析技术一单管消化后PCR链融解曲线分析（post—digestionPCR—meltingcurveanalysis,PDP—MCA）。方法以文献报道的差异甲基化区（differentiallymethylatedregion,DMR）为模型,在MVP两侧设计一组解链温度各不相同的引物。应用FastDigest甲基化敏感性限制酶（methylation—sensitiverestrictionenzyme,MSRE）,在同一反应管内顺次进行DNA的酶切、复合扩增和MCA检测．生成MCA图谱。同时用该方法和传统的MSRE—PCRMCA技术检测相同样品（外周静脉血、精液、阴道液各5份）,比较两种方法检测结果,验证其可行性,并分析比较不同样品的MCA／HRM图谱。结果解链温度相差2℃以上的片段,MCA峰分离良好,复合扩增后可以用MCA技术检测。应用单管PDP—MCA技术,可以集酶切、扩增和检测三步于一管,在2h内得到与传统方法一致的特异性图谱和数据,并实现样品的快速分类鉴别。结论单管PDP-MCA技术可以实现多个MVP的单管、闭管检测,具有简便、快速、易于自动化等优点,可用于样品DNA甲基化差异的检测。     

Singapore’s Phantom Workers

In 2009, the Singapore state prosecuted a string of businesses for listing fictitious local workers on their books in order to stretch their foreign worker entitlement. These “phantom” worker scams, prevalent since the 1980s, appear out of place in Singapore – a country with a strong international reputation for its government’s efficiency and strict legal enforcement. This paper examines the state’s prosecutions of the phantom worker scams in the context of the exceptional economic and political stresses in 2009, when Singapore was most severely affected by the global economic crisis, in order to address the employment regime in Singapore. It argues that the belated efforts to tackle the phantom worker scams reflected the pro-business state’s reluctance to tackle illegalities crucial to facilitating employers’ otherwise unlawful access to wealth and resources in Singapore.     

环境动态性对战略柔性与企业绩效关系的调节效应——基于浙江民营企业的实证研究

本文把战略柔性划分为资源柔性、技术柔性、结构柔性、文化柔性这四个维度,研究了环境动态性对战略柔性与企业绩效关系的调节效应。研究结果显示,战略柔性对企业绩效有显著影响,但资源柔性、技术柔性、结构柔性和文化柔性对企业绩效的盈利能力和成长潜力两个维度的影响有所差异;环境动态性对战略柔性—企业绩效关系存在调节效应。该结论有助于指导企业制定提升战略柔性的管理措施。     

论保险法上解除权与民法上撤销权之竞合

投保人违反保险合同告知义务时,保险人的合同解除权与撤销权可能发生竞合。对此,有两种解决方案：一为排除说,二为选择说。前者以保险法上解除权排除民法上撤销权,后者允许两种权利并存由保险人选择行使。选择说会导致保险合同关系长期不稳定,置投保人于完全被动而纵容保险人粗放承保,故不足采。从立法目的、构成要件和法律效果上分析,保险法上的解除权可以看作民法的特别规定,排除说较为可采。

High‐Resolution Melting (HRM) of Hypervariable Mitochondrial DNA Regions for Forensic Science

Forensic strategies commonly are proceeding by analysis of short tandem repeats (STRs); however, new additional strategies have been proposed for forensic science. Thus, this article standardized the high‐resolution melting (HRM) of DNA for forensic analyzes. For HRM, mitochondrial DNA (mtDNA) from eight individuals were extracted from mucosa swabs by DNAzol reagent, samples were amplified by PCR and submitted to HRM analysis to identify differences in hypervariable (HV) regions I and II. To confirm HRM, all PCR products were DNA sequencing. The data suggest that is possible discriminate DNA from different samples by HRM curves. Also, uncommon dual‐dissociation was identified in a single PCR product, increasing HRM analyzes by evaluation of melting peaks. Thus, HRM is accurate and useful to screening small differences in HVI and HVII regions from mtDNA and increase the efficiency of laboratory routines based on forensic genetics.     

论股东新股认购优先权的法律完善

在现代日益激烈的市场竞争中 ,股份公司欲在竞争中取胜 ,必须依靠源源不断的资金来源 ,在资金来源渠道中 ,发行新股充分发挥了股份制度聚沙成塔的功能 ,降低了公司成本与经营风险。如果在发行新股时不赋予原有股东以新股认购优先权 ,那么 ,在公司向第三人发行新股时 ,原有股东在公司原有资本总额中所占的持股比例必然萎缩 ,损害了原股东的权益 ,我国公司法应该完善此项权利的规定     

一定民主条件下司法审查制度设计的经济学分析

民主最大化是一种理想状态,立法和执法者的"经济人"本性和信息的不对称使得民主最大化无法实现,同时也为司法审查的产生提供了现实的基础.本文试以经济学的视角,在分析司法审查设计的供求关系和内部分配偏好的基础上,试图寻找一定民主条件下司法审查设计的最优结合点.     

Amelogenin locus typing using toehold-assisted fluorescent DNA melting analysis

The amelogenin gene is the locus of choice for gender identification in forensic science. Here we report on the use of fluorescent DNA melting curve analysis to genotype the amelogenin locus by means of a toehold-assisted DNA strand displacement reaction. The shape of the curves, or “polarity” of the melting peaks, allowed for visual discrimination between male and female DNA samples.
