单位犯罪集团初探

单位犯罪集团,是指包括单位在内的三个以上的人,为了共同实施犯罪而结成的较为固定的犯罪组织;单位犯罪集团的成立是我国有关规定及理论的必然结论;单位犯罪集团具有主体构成的复杂性、犯罪主体的独立性以及成立的限定性的特征;单位犯罪集团中的单位必须是合法成立的,其在犯罪集团中的地位不影响单位犯罪集团的成立;对于单位与自然人相勾结实施依法单位不能构成犯罪的情形,对此按照自然人犯罪集团处理;对于单位与自然人相勾结实施纯正单位犯罪的情形,可考虑按照刑法中身份犯的理论处理。     

社会关系网络在求职过程中的马太效应分析

社会转型期弱势群体在就业过程中使用社会关系网络并不会带来更好的工作我们称这种现象为社会关系网络的马太效应。它主要是由我国的历史文化背景、社会关系网络本身、人力资本等因素的影响造成的。文中对此进行了分析,并提出了相应的对策建议。     

Focus of attention and locus of control as moderators of fraternal justice effects

The influence of a colleague's performance outcomes on individual's own subsequent performance was investigated. Internal and external locus of control subjects were given information about another person's outcome which indicated two things about organizational standards: how easy or difficult they were to meet and how stringently they were applied. An attentional focus manipulation was employed to influence how subjects used this information. Half of the subjects received a group-focus manipulation and the other half a self-focus one. We proposed that perceived difficulty of standards and stringency of application would interact with attentional focus and subject locus of control to alter subject's own subsequent performances. This expectation was supported by the data. Theoretical and applied implications of this result are discussed.     

东北老工业基地企业中的“义家族”现象分析

义家族是企业组织内靠哥们儿义气联系在一起并按照家族方式行为组成的人际网络。通过义家族网络可以在某些情况下提高办事效率、降低企业治理中的道德风险、快速形成企业的统一价值观和增进人际关系的融洽程度,还能够快速地形成核心和骨干员工的网络,在义家族内部能够更有效地激励其成员,对义家族成员的选择提供了一种前馈控制的机制,等等,这些都是企业管理的有利因素。同时,义家族成员奉行的义气至上行为准则,会导致企业组织目标迷失,破坏企业秩序,还会产生排外意识,导致组织内政治行为泛滥,扭曲员工的价值观,这些是义家族对企业管理的消极影响。改善老工业基地企业的管理,需要对义家族实施扬长避短、惩恶扬善的对策。     

A silent minority: Battered American Indian women

Sixteen American Indian women requesting counseling for domestic violence at an urban Indian health center were interviewed using standardized measures. The majority of the women were not married, had low family incomes, and both the women and their partners abused substances. All of the women experienced increased depression and stress as a result of the battering. A mental health needs assessment survey of 198 American Indian women is presented for comparison. Women who reported a history of domestic violence on the survey were more likely to be separated or divorced and reported more problems with alcohol than the women with no history of domestic violence. The results of the domestic violence program interviews are compared to the mental health needs assessment survey and studies of battered women in shelters.     

中国公司法之构造缺陷及克服

作者认为 ,中国公司法在实践中存在以下缺陷 :有限公司与股份公司的组织机构之间区别模糊、国有独资公司定位不当、股份公司之董事会缺少有效约束、监事会的监督职能虚拟化以及对关联公司以及公司集团的约束不力。为更好地发挥公司在市场经济中的作用 ,实有改革有限公司制度以及重新塑造股份公司之董事会与监事会关系的必要。此外 ,还应当增加对关联公司与公司集团的法律规定。

论弱势群体的宪法权利及其保护

从宪法学视角看,"弱势群体"系"制度保护不足的宪法权利主体",其宪法权利体系由"自由权"、"社会权"等实体性宪法权利与"请求保护权"等程序性宪法权利组成。弱势群体享有宪法上一般权利主体和特殊权利主体之双重地位,由此而可能发生的"权利竞合"与"权利冲突"现象,须借鉴域外宪法学原理,而透过法律条款作妥适之处理。弱势群体之宪法权利可经由立法路径转化为法律法规上之具体权利,亦可通过"合宪性解释"方式经由"行政保护"与"司法保护"两种路径而予以实现。
