在罪犯矫正的认识论上,主要有矫正否定论、可改造论和层次矫正论三种观点。大多数学者认为矫正否定论的倡导者应是世界上有着很大影响的犯罪学家龙勃罗梭,他提出了重要理论“犯罪天生论”.认为“天生犯罪人”是不可矫正的。我们认为龙勃罗梭的理论被学界曲解了,只看到了其强调天生犯罪人不可矫正的一面,而忽略了其理论对矫正犯罪人的积极意义。可改造论主要是新中国建立以来所秉持的一种观点,认为罪犯是可以改造的,罪犯具有矫正的可能性,但罪犯矫正是有条件的。从逻辑意义上来讲,对罪犯一定条件下的可以改造并不是都能够改造。层次矫正论认为,罪犯中有的是可以矫正的,有的则是不可能矫正的。因此,只有树立矫正有限论的理念,才能对不同层次的罪犯,运用不同的策略。  相似文献

A method has been developed for the visualization of latent fingerprints on fabrics, which is based upon cyanoacrylate (superglue) fuming followed by imaging using an infrared microscope. Results show that imaging on smooth, shiny fabrics such as polyester, silk, nylon, and acetate of different colors and patterns can give an improvement over existing enhancement methods. Results for cotton and polycotton were less successful and it is thought this may be due a combination of the presence of the carbonyl functional group in these fabrics as well as their absorbency to fingerprint sweat. The carbonyl peak (1700 cm?1) provided the optimum spectroscopic feature to map and image a fingerprint. Comparisons between infrared mapping at a specific frequency range and principal component analysis showed that improved imaging was obtained with principal component analysis.  相似文献

The need to detect fentanyl and its analogs in the field is an important capability to help prevent unintentional exposure or overdose on these substances, which may result in death. Many portable methods historically used in the field by first responders and other field users to detect and identify other chemical substances, such as hazardous materials, have been applied to the detection and identification of these synthetic opioids. This paper describes field portable spectroscopic methods used for the detection and identification of fentanyl and its analogs. The methods described are automated colorimetric tests including lateral flow assays; vibrational spectroscopy (mid-infrared and Raman); gas chromatography–mass spectrometry; ion mobility spectrometry, and high-pressure mass spectrometry. In each case the background and key details of these technologies are outlined, followed by a discussion of the application of the technology in the field. Attention is paid to the analysis of complex mixtures and limits of detection, including the required spectral databases and algorithms used to interrogate these types of samples. There is also an emphasis on providing actionable information to the (likely) non-scientist operators of these instruments in the field.  相似文献

Sealing wax is used for maintaining the integrity and authenticity of a document or physical evidence. Any tampering with the seal calls into question the overall integrity and authenticity of the tangible evidence or document. In these circumstances, determining the authenticity of the sealing material (physical and chemical) becomes imperative. In this study, ATR-FTIR spectroscopy supported by chemometrics has been used to differentiate sealing wax samples belonging to 12 different brands available across India. All the samples were first melted, cooled, and then analyzed using ATR-FTIR spectroscopy in the mid-infrared region (4000–600 cm−1). The obtained spectra were first examined visually for the presence of different functional groups. Principal component analysis (PCA) and principal component analysis-linear discriminant analysis (PCA-LDA) were employed to analyze the sample clustering patterns and to categorize them into their respective groups, respectively. For classification, a PCA-LDA training model was applied, and it demonstrated 95.83% accuracy. The validation test resulted in an accuracy of 83.33%. PCA-LDA model offered 100% accurate prediction for samples on various substrates, including cloth, cardboard, and paper. A blind study was also performed using five unknown samples, which were accurately classified into their respective groups. PCA-LDA model will be helpful in providing investigative leads by linking a questioned sealing wax sample with its respective group.  相似文献

In the second part of this survey, the ability of micro‐Raman spectroscopy to discriminate 180 fiber samples of blue, black, and red cottons, wools, and acrylics was compared to that gathered with the traditional methods for the examination of textile fibers in a forensic context (including light microscopy methods, UV‐vis microspectrophotometry and thin‐layer chromatography). This study shows that the Raman technique plays a complementary and useful role to obtain further discriminations after the application of light microscopy methods and UV‐vis microspectrophotometry and assure the nondestructive nature of the analytical sequence. These additional discriminations were observed despite the lower discriminating powers of Raman data considered individually, compared to those of light microscopy and UV‐vis MSP. This study also confirms that an instrument equipped with several laser lines is necessary for an efficient use as applied to the examination of textile fibers in a forensic setting.  相似文献

Evaluating traumatic axonal injury remains challenging in clinical and forensic sciences as its identification is difficult using routine diagnostic methods. This study used Fourier transform infrared microspectroscopy to detect TAI within the corpus callosum in an animal model. Protein conformational analysis revealed significantly increased β-sheet and β-turn contents paralleled by a decrease in α-helix content at 24 h postinjury, while the antiparallel β-sheet content was decreased at 12 h postinjury. Compared with the control group, the lipid/protein ratio was significantly reduced in all of the injured groups. At 24 h postinjury, there were increases in the olefinic=CH and CH3 group of lipids accompanied by the decreased CH2 group, but the results at 12 and 72 h were contrary to that at 24 h. Our study showed that FTIRM could differentiate injured from normal white matter at different time points following TBI via examination of these infrared spectral parameters.  相似文献

目的运用新型粉末状荧光502可一步显现非渗透性光滑客体表面潜手印。为了选择最佳的激发光源和滤光镜来观察熏显后荧光效果,本文对该粉末的荧光性能进行研究。方法使用荧光光谱仪对新型粉末状荧光502进行激发光谱和发射光谱的测试,进而选择合适的激发光源及滤光镜来进行观察和拍照。结果新型粉末状荧光502的光谱范围较宽,在波长为235nm~580nm范围内均可进行激发,具有广谱性,其中对波长在530nm附近的激发光具有最大峰值,即荧光强度最大,对450nm和360nm附近的光也具有很高的吸收峰值,斯托克斯偏移量为45nm。宏观验证实验表明,在仪器分析所得的范围内,显现出的手印效果均较好。结论运用该粉末在熏显手印后可以在紫外、紫光、蓝光、黄光、绿光范围内进行激发,斯托克斯偏移大,荧光亮度高,在观察荧光效果时能够很好的消除背景荧光的干扰,也便于选择滤光镜。手印荧光效果除了受到熏显物质荧光性能的影响外,还与激发光源的品质、滤光片的透过性能以及检材固有的发光特点、客体表面性质有关。  相似文献

Raman spectroscopy has proved to be a promising technique in forensic examinations, where optical microscopy, micro‐infrared spectroscopy, and microspectrophotometry in the visible and UV range are used for identification and differentiation between paint traces. Often no organic pigments are detected using Fourier transform infrared spectroscopy, because their content in a trace is usually undetectable. Application of a micro‐Raman spectrometer equipped with several excitation lasers helps forensic experts in paint analysis enabling identification of main pigments. Three cases concerning comparative examination of car paint are discussed in detail. The comparison of Raman spectra of paint chips found on clothing of a victim or smears found on body of a damaged car to these of paint chips originated from the suspected car enabled us to identify the car involved in the accident. When no comparative material is available, the method can be useful in establishing the color and make of the car.  相似文献
