社区矫正的中国传统元素——和合文化在轻刑执行中的缺失与补正

任何制度都是民族历史传统的自然言说，法律制度也不例外。当今世界三种模式的社区矫正都与各自民族特色紧密相连，而我国社区矫正制度则较多地体现了共性而忽略了民族特性。作为中华民族最．-j-~贵的精神财富之一，和合文化理应且能够在我国社区矫正的制度构建中被浓墨重彩。     

基于无缝隙政府的社区警务战略研究

无缝隙政府理论是以满足顾客无缝隙的需要为目标,以顾客、竞争和结果为导向,是一种为顾客提供无缝隙的公共产品和公共服务的方式。社区警务战略正是无缝隙政府理论在我国的有效实现形式之一。该战略以预防及合作为其基本内涵,要求警力深入社区,以社区为导向开展工作;强调以社区民警为主的各警种与社会化力量之间的互动。但在执行中,社区警务战略还存在种种问题。应按照无缝隙政府理论的要求,对社区警务战略作进一步的完善。     

The Good Companions and Community Building

Although Ina Habermann, a Swiss scholar, has drawn attention to the fact that The Good Companions preserves the tradition of condition of England, she has failed to point out the inner relationship between the tradition and the symbolic forms of the novel. It is “The Good Companions” the troupe, together with the way it operates (including its theatrical performance), rather than “music hall entertainment” as argued by Ina, that is the crucial symbol of community life in The Good Companions. It is true that Ina’s “music hall entertainment” symbolizes community life but the image of “The Good Companions” not only reveals the breadth of community life indicating a way of life beyond the category of theatrical performances, but also sheds light on the depth of community life by suggesting the spirit of community and the ways of work in which community is rooted.     

北京城市社区媒体的发展现状及居民期待调查

针对北京城市社区媒体的状况,课题组从居民和居委会两个层面,对六个典型社区进行了调查。发现居民普遍对社区媒体概念陌生,缺乏热情和关注,但社区居民的群体结构及角色认同,居民之间缺乏日常交流的现状,以及获取新闻信息主渠道的变化等,都在客观上要求社区媒体的存在和发展。社区媒体的优势是服务性强,需要关注的主要问题是教育问题、养老问题和健康问题。多数居民仍期待街道社区成为媒体的主办方,但目前居委会工作人员的能力结构难以适应媒体建设的需要。     

Institutionalization of a Human Community with a Shared Future and Principles of International Law

The doctrine of building “a human community with a shared future” (HCSF) is a Chinese diplomatic strategy in the new era moving closer to the center of global affairs. It includes enriched ideas about international law and the essential elements of institutionalization. The emergence and development of modern international law have revealed the critical importance of the ideas about international law as guidance for institutions. It is necessary and possible to institutionalize the HCSF by setting its ideas as principles of international law. The principles of international law for the HCSF are those of durable peace, universal security, common prosperity, coexistence of different civilizations, and sustainable development. The new five principles of the HCSF are integrated with the existing general principles of international law and Chinese proposals for the new era, which is not only the development of Chinese-initiated Five Principles of Peaceful Coexistence but also a new contribution to the contemporary international law. It will be the new guidance to advance the profound changes of international relations unseen in a century for the common interest of mankind.     

论“一带一路”倡议与亚欧命运共同体的构建

构建人类命运共同体是新时代中国对外工作的总目标,共建"一带一路"是推动构建人类命运共同体的重要的具体实践平台。亚欧大陆是地理上"一带一路"倡议的中心所在,也是决定中国未来国际地位的关键区域。共建"一带一路"需要重点布局亚欧大陆。亚欧大陆的发展要重点关注中心"洼地",它将决定丝绸之路经济带的成功与否,其中俄罗斯是重点国家。作为亚欧大国的中国,可以"一带一路"为抓手,以亚欧大陆为舞台,以新型国际关系为理念,以周边外交和睦邻外交为策略,以人类命运共同体为战略目标,促进亚欧命运共同体的构建。     

对新时期大学生理想教育的几点思考

培养有理想、有道德、有文化、有纪律的社会主义新人,是邓小平教育思想的一个重要内容,也是社会主义精神文明建设的重要目标之一。抓住了理想教育,就抓住了培养“四有”新人的关键和核心。理想教育应具有时代感和超前性。我们应采取多种符合实际而又行之有效的方法和途径培养一代又一代社会主义的“四有”新人。     

从认知失调的角度看未成年人的社区矫正

未成年人犯罪居高不下已成为一个社会性问题。从社会心理学角度,在未成年人社区矫正中引入认知失调理论,具有一定的理论和现实意义。在对未成年人进行的社区矫正中,应创造一个良好的有益于未成年人矫正和健康成长的环境,选派优秀的社区矫正工作者利用正确的方式有针对性地调整其失调的状态。同时,在使用认知失调法进行矫正的过程中还应注意灵活巧妙地激发矫正对象产生认知失调并及时妥帖地帮助矫正对象达到“心理平衡,”从而取得矫正的成功。     

滥用职权罪主体资格探析

司法实践中,社区基层组织成员滥用职权,致使公共财产和人民利益遭受重大损失,能否构成滥用职权罪,在司法实践和刑法理论界均存在争议。文章用真实的案例,对社区基层组织成员如何适用全国人大常委会的两个立法解释,以及是否具有滥用职权罪主体资格进行了分析。     

论“首要标准”背景下社区矫正工作者的能力建设

社区矫正质量的高低,关键看社区矫正工作者队伍综合能力的高低。由于当前诸多主客观条件的限制,使社区工作者队伍整体能力偏低,影响了罪犯矫治质量,不能适应"首要标准"的要求。落实"首要标准",全面提高矫正质量,必须积极采取各种措施,加强社区矫正工作者的常规管理能力、公正执法能力、教育矫正能力、创新能力建设。
