民法总则在实务上的最新发展( 上)———台湾地区“最高法院”九○及九一年度若干判决的评释简

民法总则系关于民法的基本原理，适用于私法全部，其理论的变迁攸关民法的发展及进步。查阅台湾地区“最高法院”民国九。年度以来的相关裁判，发现了若干具有价值的指标性判决。所谓“指标性判决”，其意义有二：（1）法院提出了具有原则性的重要法律见解；（2）在法学方法论上有启示性。从这些判决，我们可以看见实务上为适应社会发展，实现法的价值理念，持续不断地致力于阐释补充民法的基本原则，丰富了法律的生命。

一般行政监督 ,是行政系统进行自我监督的方式之一。世界各国的行政机关内部 ,都普遍存在这种监督制度。但在不同国家结构形式的国家中 ,这种监督呈现出不同的形式及特点。本文选取部分典型国家 ,分别论述其一般行政监督制度。     

Marching to the Left? Programmatic Competition and the 2017 Party Manifestos

This article analyses the content of the 2017 general election manifestos, and introduces the latest estimates from the Manifesto Project to explore recent ideological movements in the British party system. It reports the changing policy emphases in Conservative and Labour manifestos and the ideological positions of the major political parties in 2017. It finds that Theresa May's party produced its most left‐wing manifesto since 1964, and that Jeremy Corbyn's party produced its most left‐wing manifesto since 1992 and the election before the advent of New Labour. The article also finds that the ideological space between the Conservatives and Labour opened up in 2017, and that Northern Ireland's Democratic Unionists published the most right‐wing manifesto.     

论情报主导警务中的警务参谋制度构建--源于德军参谋部建设经验的启示

考察德军参谋部建设历史,其成功经验在于：一是建立专门独立的辅助决策机构;二是坚持以科学理论指导实践;三是以数学为主要手段确保情报分析高效科学;四是以实证方法确保理论和实践统一;五是及时推广应用新的科学技术;六是打造知识化、专业化参谋队伍。我国公安机关应借鉴德军参谋部建设之经验,在情报主导警务机制建设中,以规范的组织体制、科学的工作理念及专业化的参谋队伍为主题,构建警务参谋制度,完善辅助决策机制,提升警务决策科学化水平。     

How Valid Is Negotiation Research Based on Student Sample Groups? New Insights into a Long‐Standing Controversy

Although a considerable amount of research has examined the impact of experience on negotiation behavior and performance, we still know very little about the usefulness of student samples in negotiation research because most studies have compared the performance of inexperienced students with those who had received some kind of extensive negotiation training or with experienced professional negotiators(s). Against this background, we investigate whether the results obtained from trained student samples are generally similar to those of professional negotiators. Generally, our data confirm our hypotheses that students with some negotiation training and experience perform better than untrained student negotiators and that they are not significantly outperformed by professional negotiators. From this, we conclude that many questions in the field of negotiation research can be effectively tested by using trained students as experimental subjects.     

新时期党校期刊的改革进路探讨

在全球化、网络化的大背景下,我国的学术期刊面临新的发展机遇,呈现出期刊的发布与传播方式更新、期刊的出版模式更新和"优先数字出版"成为最新的出版模式、期刊的国际化趋势等发展特点。同时,学术期刊也面临着网络化和新兴媒体的发展带来的严峻挑战,改革已经成为新时期学术期刊发展的新命题和新焦点。新一轮改革将推动学术期刊向优质化发展、出版方向与定位向特色化发展,期刊之间的竞争还将是出版手段的竞争。作为哲学社会科学学术期刊重要构成部分的党校期刊,同样面临着改革要求,上述改革的方向也将是党校期刊的改革取向,而特色构建则将是党校期刊的改革进路选择。     

NO MORE CASEBOOKS: USING SIMULATION‐BASED LEARNING TO EDUCATE FUTURE FAMILY LAW PRACTITIONERS

Teaching family law using the traditional casebook method provides students with marginal knowledge and skills. To practice family law, one needs to know how to interview and counsel clients, negotiate with opposing counsel, file pleadings and supporting documents, draft agreements, and understand tax consequences. Moreover, ethical issues abound in the practice of family law, such as confidentiality, conflict of interest, and fee arrangements. Critics of traditional pedagogies in legal academia have included the MacCrate Report, the Carnegie Report, and Best Practices for Legal Education. The Family Law Education Reform Project has focused its attention on the failure of law schools to keep pace with the ever‐evolving nature and requirements of family law practice. This article offers one answer to those who seek to educate law students in a manner that will better prepare them for the practice of family law. The author, who is the director of Vermont Law School's General Practice Program, describes a family law course she has developed and taught for many years. The course is taught in an integrative fashion, and includes substantive law, practice skills, and ethical and professionalism issues. She offers the course as a response and antidote to the ongoing criticisms of tradition a methods of teaching law.

行政判例制作中的法律解释

行政判例的法律解释是法院包括法官在制作行政判例时就需要明确的法律问题所作的说明,以期对后来的案件予以约束指导的活动。为了维护法制的统一性,保证法制改革的有序进行,创制行政判例的主体应该只限于最高人民法院。法律解释最终归宿点应该以判例这样的载体出现。行政判例制作中除一般法律解释方法的应用外,还有构成性、合法性、合理性、利益衡量等具有行政法特点的法律解释方法。     

目前我国宏观经济运行态势与主要问题分析

目前我国宏观经济运行呈现出经济增长速度较快、物价增长较低、经济效益较好的局面,投资、出口活跃,拉动了经济的高速增长,工业企业销售利润增加,经济效益提高。物价水平略有上涨,基本保持稳定。但经济运行中仍存在较为突出的矛盾和问题不容忽视,工业生产耗能多、污染重,投资增长速度较快、产能过剩,贸易顺差超常增长等等,都是经济运行中的不稳定因素。面对宏观经济高位运行及不稳定因素的存在,我们仍应继续实行稳健的财政货币政策,加强宏观调控,保持经济持续稳定增长。
