生态环境差异认可与环境保护建设 --以湖南小溪国家自然保护区为例

我国是一个幅员辽阔、地质结构复杂的发展中国家,不同的区域在自然禀赋上存在极大差异,承认生态环境的差异合理性并根据差异制定出不同的发展方略既是对自然规律的尊重,也是现代文明多种生活方式自主选择的必然要求.对生态环境的差异认可是更高层次的对现代化的理解以及更高层次的对现代人的尊重.     

Success and Failure in Environment Policy: The Role of Policy Officials

This paper reports on interviews conducted between 2010 and 2013 with senior officials involved in Australian federal environmental policies over the past 30 years. It examines whether they have a prior sense of whether an environment policy is likely to succeed and their experience of the key factors driving environment policy success. Most interviewees claimed a strong prior sense of policy outcomes, but their expression of the key factors indicating success (consultation, clear objectives, a clear mandate, and a strong evidence base) varies from the usual emphases found in the public policy literature. The research illuminates the ways in which the policy officials at times exert a greater role than that suggested by the Westminster conventions or the policy theory literature. Not emphasised in the literature, yet pivotal for success in the vexed space of environmental policy, was the self‐directed yet at times skilful policy ‘agency’ exhibited by officials.

突发性水环境污染事故法律责任追究探析

目前,我国已进入环境污染事故高发期,形势十分严峻,这给保障环境安全带来了巨大压力。强化法律手段是实现水环境质量转变的重要内容之一,充分运用经济、技术和必要的行政办法有赖于强有力的环境法律、法规作为保障和依据。建立突发性水环境污染责任追究体系,刑事责任、民事责任是其中不可或缺的重要组成部分,二者的相互补充,对水环境污染和生态破坏的行为人具有惩罚与震慑作用。     

Functional anonymisation: Personal data and the data environment

Anonymisation of personal data has a long history stemming from the expansion of the types of data products routinely provided by National Statistical Institutes. Variants on anonymisation have received serious criticism reinforced by much-publicised apparent failures. We argue that both the operators of such schemes and their critics have become confused by being overly focused on the properties of the data itself. We claim that, far from being able to determine whether data is anonymous (and therefore non-personal) by looking at the data alone, any anonymisation technique worthy of the name must take account of not only the data but also its environment.This paper proposes an alternative formulation called functional anonymisation that focuses on the relationship between the data and the environment within which the data exists (the data environment). We provide a formulation for describing the relationship between the data and its environment that links the legal notion of personal data with the statistical notion of disclosure control. Anonymisation, properly conceived and effectively conducted, can be a critical part of the toolkit of the privacy-respecting data controller and the wider remit of providing accurate and usable data.     

Challenging Heteronormativity: Creating a Safe and Inclusive Environment for LGBTQ Students

Lesbian, gay, bisexual, transgender, and queer/questioning (LGBTQ) youth face hostile and exclusionary learning environments. A qualitative phenomenographic method involving semistructured interviews of seven secondary school administrators was conducted to identify perceptions of experiences creating a safe and inclusive environment for students who identified as LGBTQ. The findings of the study were examined from a conceptual foundation that a heteronormative culture dominates the U.S. school system that perpetuates the marginalizing of nongender conforming students. The three emergent perceptions identified included: (a) providing safe spaces while working to create an inclusive environment; (b) promoting student awareness and acceptance of diversity; and (c) challenging heteronormativity within the context of formal policies and procedures.     

Issues and crisis management in a convergent environment

Increasingly issues and crisis management are occurring in an interactive environment in which activists use online communications and networks to attack organisations and promote campaigns. This paper outlines examples of such developments and suggests that there is a still a need to consider them within the context of the overall social and economic environment as well as from a technological viewpoint. 区域协调发展与资源、环境可持续发展动力机制探究

实现区域协调发展与资源、环境可持续发展是构建区域整体和谐发展的要求。要实现区域整体和谐发展必须要解决动力机制不足问题。目前存在的资源、环境可持续发展激励机制不健全,区域生态补偿机制缺失,区域协调发展体制机制不完善,区域资源、环境纠纷解决机制不健全等,需通过建立和完善政府主导力、市场引导力、公众监督约束力、环境文化推动力、区域生态补偿力、纠纷化解保障力来实现我国区域协调发展与资源、环境可持续发展。     

通过民事合同的农村环保监管——约束条件下农村环保监管的实现方式

过去以工业和城市为中心的环保监管夸大了城乡生态环境问题的同质性,没有建立起适应农村生态环境真实情况的环保监管制度。农村环保监管面临三个基本的现实约束,制约着农村环保监管制度的实效。民事合同在农村环保监管中具有普遍性和源头治理地位。借助民事合同的约定可构建农村环保内部监管,通过政府(法院)、社会公众的外部监督可达致农村环保外部监管,从而形成了通过民事合同的多中心农村环保监管模式。
