I first offer an account of serious crime that goes beyond victimizing crimes committed by individuals against other individuals. This approach extends the well-known framework offered by von Hirsch and Jareborg to include crimes undermining welfare-producing institutions. I then consider how the seriousness of crime justifies preventive measures, including the criminalization of acts preparatory to the commission of serious crime. I shall defend preventive measures, including highly intrusive ones, for the most serious crimes, such as terrorism in the form of mass killing, but I shall take issue with very expansive conceptions of serious crime that include what are intuitively much less serious offenses than terrorism or murder. In England and Wales, the Serious Crime Act (2007) lists relevant types of serious crime in its Schedule 1. This and other pieces of serious crime legislation in the UK are discussed critically. 相似文献

东亚共同体是东亚合作的必然趋势,是东亚各国的长期目标。然而,在小泉政府期间,因日本不与中国讨论东亚共同体,在双边自由贸易方面孤立中国,中日关系冷淡,中日两国一直未能共同推进东亚共同体。日本民主党实现政权轮替后,表示了与中国合作共同推进东亚共同体的新姿态,受到了中国的欢迎,出现了中日合作共同推进东亚共同体的新局面。以此为契机,中日两国应该根据推进东亚共同体的前提、原则与途径,加强合作,共同推进东亚共同体。 相似文献

Risk is a projection of a specific temporality performed by the observer. However, this projection is doomed to impossibility because of the prohibiting problems of time, causality, subjectivity and relativity of risk. The observer is left only with a castrated projection that defies the role of science as a pedestal for the projection and institutes negation as its driving force. This projection is materialised within the Law in the form of the Precautionary Principle. Risk evokes undesired dualisms, especially the one between Idealism and Operationalism. The essay attempts to bring the two together by extrapolating the hard appearance of the legal system as seen through Luhmann’s autopoiesis and the need for critical openness of a contextualised environmental law. Evidentiary adjudication is one of the important signs of progress of litigation and judicial civilization. There are three key concepts under the principles of evidentiary adjudication: facts, evidence and fact identification. They form a kind of logic relationship among proposition, the argument and conclusion. As a logical starting point of judicial proof, the case facts have legal determinacy which is different from the facts in philosophical sense, and also different from the fact that as a foundation for the judicial judgment. As the basis of the facts, the evidence emphasizes more the relevance and legitimacy in form. As a logical end point of judicial proof, fact identification is a rational, rigorous proof, but the case facts happened in the past, the fact-finder can only see the evidence, and can only use the evidence to find the facts, which determines the uncertainty of fact identification. 相似文献
