沉默权之赋予与证明标准之转型

口供之必取是支撑我国"符合说"之证明标准理论成立的关键。在赋予被追诉者沉默权之后,我国的证明标准必将面临转型。对于那些被追诉者不予供述的案件,应当实行内心确信的证明标准;对于那些被追诉者自愿供述的案件,可实行高度盖然性的证明标准。     

Working with sex offenders: Best practice in enhancing practitioner resilience

Abstract

The systematic and widespread treatment of sex offenders is a comparatively recent innovation in the human services field. Consequently, research considering the impact of such work on providers and organisations is still in its infancy. The first swathe of international research, published throughout the 1990s, identified a range of deleterious effects for treatment providers, ranging from mild anxiety to severe psychological morbidity. More recent findings indicate a considerably more optimistic psychological future. This paper seeks to provide the reader with an overview of the relevant literature, together with its shortcomings, and introduce the Model of Dynamic Adaptation (MDA), a framework through which variables associated with both positive and negative outcomes may be grouped and managed. It is proposed that understanding and managing the MDA can support both individuals and organisations in achieving their goals in good psychological health, through the development and implementation of informed, evidence-based, best practice strategies.     

印油印迹中色料成分的UHPLC方法研究

目的对红色印油印迹色料成分进行分析,研究确定印油印迹的种类区分方法,为侦查破案提供依据。方法采用超高效液相色谱法分析,以保留时间为主进行定性,对35种不同品牌的印油产品中色料成分进行区分。结果将印油印迹分为普通印油（印泥、原子印油等）、水性印油及光敏印油三类,建立了统一的UHPLC分析方法,其种类区分率达85%以上。结论通过印油印迹成分研究,最终区分印油印迹种类,可满足实际案件中对不同类型印油的鉴别区分。     

Dimensions of American SHRM＂ Human Capital, HR Systems and Firm Performance

American scholars identify strategic human resource management （SHRM） with human resources （HR） system and firm performance. Major definition of SHRM is human resource management （HRM）-firm performance relation. HR system is important to set HRM-performance link, because HR system includes interrelated HRM practices. Most prominent set of SHRM is interrelated HRM practices, because it establishes the link between individual performance and firm performance. There is a debate in SHRM theory what factors set relationship between HRM and performance. This study argues that individual performance is a moderator between HR and performance. Interrelated HRM practices are important to enhance individual performance. Therefore, interrelated HRM practices are crucial to SHRM. Finally, American scholars view that HR system is important in SHRM, because it establishes high performance work system （HPWS）, and HPWS is expected to increase individual performance and then firm performance. Therefore, American model of SHRM might be HPWS, individual performance, and firm performance. HR systems establish HPWS. Therefore, scholars tend to system approach in SHRM, because it includes interrelated HRM practices in SHRM.     

Violence and Sexual Minority Youth

Abstract

Among the most maligned and harassed students in high schools are those who are perceived not to fit the norms for sexual behavior. These include gay and lesbian students, bisexual students, transgendered students, effeminate heterosexual males, and masculine-acting heterosexual females. Together these students are the targets of a wide range of negative behaviors from subtle exclusion to physical assault. In addition, many develop negative attitudes towards themselves which put them at increased risk for self-harm and suicide. The origin of these attitudes and behaviors is societal homophobia that fuels social aggression against this stigmatized group. Although challenging, educators can assist in undermining the effects of homophobia on sexual minorities through teaching tolerance, sponsoring support groups that address these issues, and providing educational opportunities about sexual minority youth.     

高校管理权力配置的失衡与规避

随着高等教育的发展,国家包揽办学的局面已经改变,办学主体多元化成为趋势,政府从对学校的直接行政管理转变为运用立法、拨款、规划、政策等手段进行宏观管理,国家控制变为国家监督,高校自主管理权在加大。但高校内部管理仍处在历史的惯性作用下,行政化了的管理行为仍在继续, 学术权力与行政权力失衡。如何解决失衡并建立现代大学制度,本文试作初步的探讨。     

An anthropological analysis of gunshot wounds to the chest

This analysis of gunshot trauma to the bony thorax examines 87 handgun and rifle wounds from documented cases in an effort to corroborate an earlier report and to provide the forensic community with additional literature in this area. Specifically, this study tests whether the trauma signatures associated with gunshot wounds in the bony thorax are useful in determining the direction of fire. Because the ribs occupy a significant portion of the bony thorax, they are struck more frequently than other bones and, consequently, they are the focus of this report. This study confirmed that bullets can leave distinctive markers on ribs that indicate the direction of fire, including depressed fractures, bone fragments displaced in the direction of the bullet's path, and beveling. Although forensic anthropologists can determine the direction that a bullet was traveling when it struck a given rib, they cannot give a definitive statement about the number or sequence of gunshots without supporting soft tissue evidence.     

Comparative analysis of gamma-hydroxybutyrate and gamma-hydroxyvalerate using GC/MS and HPLC

This paper describes two analytical techniques used to separate and quantify gamma-hydroxybutyrate (GHB) and gamma-hydroxyvalerate (GHV). The first technique was a N,O-bis(trimethylsilyl)triflouro-acetimide-trimethylchlorosilane derivatization, followed by gas chromatography/mass spectrometry analysis using an HP-5 capillary column at a rate of 1.0 mL/min with a run time of 9.25 min. This technique was found to be sensitive (LOD 1 pg on column) and gave a low average error (5%) in a beverage study. When supplemented by a surrogate spike, the method yielded 97% analyte recovery from beverages. The second technique was high-performance liquid chromatography/UV (HPLC/UV) using a C-18 column with a (20:80% v/v) methanol:dibasic phosphoric buffer (10 mM, pH 3) at a rate of 1.00 mL/min with a run time of 7.5 min. UV detection occurred at 254 nm. This method was found to be less sensitive (LOD 0.05 microg on column) for direct analysis of aqueous samples. To remove interferences seen in the beverage study, a liquid-liquid extraction before HPLC analysis was tested. However, a decreased sensitivity (LOD 100 microg on column) and irreproducible peak profiles resulted.
