FAMILY CARE COMMITMENT DISCRIMINATION: BRIDGING THE GAP BETWEEN WORK AND FAMILY

This Note discusses the pervasive problem of employment discrimination based on family responsibilities, or family care commitment discrimination. Employees with family care commitments often find themselves being pulled in opposing directions—between work and family. When an employee is forced to choose work, for financial reasons, over family, his or her family ends up suffering. The current state and federal statutes aimed at employment discrimination are insufficient to deal with family care commitment discrimination. This Note proposes a change to the current legislation and explains how this change will protect employees and families, while causing employers to internalize externalities by adopting more family‐friendly policies.     

权益保障视域下中外青年政治参与比较研究

青年作为未来的决定性力量，在其成长的历程中较容易形成自我的政治态度和政治行为，因而保障其能够依法参与到政治活动中并发挥参与的有效性，对维护青年的政治利益具有重要的意义。青年政治参与是青年政治利益的表达方式，为表达青年政治利益提供渠道，因而青年政治参与具有权益保障的天然属性。中外青年由于政治体制、社会文化等诸多方面的不同，青年政治参与的方式、作用又不尽相同，故而从这些不同的维度入手进行比较和分析，并在权益保障的视域下以期挖掘其中的理论和现实意义。     

农村“留守儿童”违法犯罪成因及对策研究

改革开放以来，我国农村经济、文化有了长足发展，农民物质文化生活得到了很大改善和提高。但是农村“留守儿童’’的安全、教育、情感、心理等一系列问题日益突出，农村青少年犯罪中“留守儿童”占了相当大的比例。应针对农村“留守儿童”违法犯罪的特点、成因，找出预防农村“留守儿童”违法犯罪的对策，以此来减少农村“留守儿童”违法犯罪，并得到社会各方面的关注。     

A CASE FOR REFORM OF THE CHILD WELFARE SYSTEM

There are more than half a million children in our nation's foster care system. While foster care is intended to provide a temporary safe harbor for abused and neglected children, too many of these youth spend years in foster care limbo—experiencing a turbulent life in motion as they move from placement to placement, community to community, and school to school. Youth in foster care commonly fail to receive basic health and psychological care, and nearly 20,000 youth age out of foster care every year to an adult path of homelessness, unemployment, and despair. Our entire community must work together to more responsibly parent these youth. This article will address how lawyers and child advocates can advocate for new approaches and enhanced support on behalf of the voiceless and most vulnerable members of our community. It will address existing hurdles and systemic challenges that have helped to create the current disheartening status quo. The article will then discuss strategies that advocates can employ to turn the corner on behalf of these youth at risk.     

《民法典·继承编》的人文观照与制度保障

我国《民法典·继承编》编纂几易其稿,民众对其抱有较大寄望与期盼。寄望其展现人文观照情愫,尊重生存价值、维护自主能力、推进实质平等;期盼其完善制度保障体系,彰显继承意愿、提供救济机制、维护继承秩序。人文观照路径,在于完善继承制度与规范配置,回应社会分层现实,彰显继承宗旨,协调继承利益;制度保障路径,在于融贯形式平等与实质平等,解决继承纠纷,回应社会需要。     

共同饮酒法律责任实证研究

通过对我国涉及共同饮酒的142个侵权案件的判决理由进行类型化分析发现,根据法院判决对注意义务的认定,可以区分为"危险防范义务"、"安全保障义务"、"法定附随义务"、"一般注意义务"等。通过在法理上对这些注意义务的来源进行辨析,其均存在一定问题。在与此相关的侵权案件审理中,法官通过扩大注意义务范围对社会交往规则进行调整,以司法政策为导向的过错认定有一定弊端,应当在侵权案件审理中坚持司法克制。     

Success on Their Own Terms: Youths' Perspectives on Successful Foster Care

Foster care is an integral component of the child welfare system. However, little is known about factors germane to conceptualizing successful foster care. This study utilized Concept Mapping (CM) to delineate a conceptual domain for what success in foster care means from the perspective of those most impacted: foster youth. CM couples multi-dimensional scaling with hierarchical cluster analyses to form factors relevant to an area of study. Pictorial representations of the data were generated using the Concept Systems software. Results indicate that youth conceptualize success based on several distinct domains. The final analyses yielded a multi-cluster solution, or Concept Map.     

论著作权集体管理组织的注意义务

著作权集体管理组织的注意义务的存在基础在于法律设置权利义务的公平性与公正性。著作权集体管理组织在与作者订立集体管理合同时,有义务审查该作者提供的作品的权利归属及作品的法律状态;在与作品使用人订立著作权许可使用合同时,有义务审查该使用者申请使用的作品是否属于著作权集体管理组织的会员作品;在已经授权作品使用人使用作品后,有义务审查作品使用人对作品的使用情况是否符合法律规定及合同约定。在法律中明确规定著作权集体管理组织的注意义务能有效降低法律成本,减少纠纷的发生。     

Surrogacy litigation in China and beyond

Chinese law neither generally prohibits nor expressly permits surrogacy. As there has been a massive underground surrogacy market in the country, surrogacy lawsuits have occurred from time to time. Chinese courts are called to decide a number of disputed issues regarding validity of surrogacy contract, parenthood of the surrogate child, and sole care and control of the surrogate child. This article examines the judicial solutions to these disputes through a case study, and analyses whether Chinese courts have adopted appropriate approaches in applying the existing law to surrogacy lawsuits. The article further discusses the inadequacies of Chinese law in solving surrogacy disputes and regulating surrogacy, and recommends a set of suggestions for improvement so that Chinese law may better adapt to the social demand of surrogacy.

文章总结了当代大学生这个特殊群体的家乡观念的表达特点和形式。提出高校应通过全面了解和加强管理等措施来引导大学生树立健康理性的家乡观念;在工作中要善于利用家乡观念的积极作用,限制和克服其消极作用,使学生教育管理工作更具有针对性和实效性。
