THE FOSTER CARE OMBUDSMAN: APPLYING AN INTERNATIONAL CONCEPT TO HELP PREVENT INSTITUTIONAL ABUSE OF AMERICA'S FOSTER YOUTH

Children today are often abused while in foster care, undermining the theoretical goal of the modern foster care system: to create a temporary, safe, homelike setting to protect and nurture children who are unable to live with their biological parents due to various reasons such as abuse, neglect, or abandonment. Often this abuse is worse than the type for which they were removed from their parents’ care in the first place. First examining the reasons why this complex problem exists, this Note recommends an internationally based, innovative concept as a partial solution: the foster care ombudsman. This Note explains the concept of an ombudsman and demonstrates how it can be particularly helpful to foster children, highlighting existing child welfare ombudsman offices in California, Rhode Island, and New Jersey, as well as international approaches. It also illustrates how a foster care ombudsman can complement class action litigation of foster care abuse claims.

海德格尔对现代性理论的特殊贡献在于他对西方现代形而上学的彻底颠覆和对"存在"问题的追根溯源.通过对黑格尔、尼采的形而上学观的剖析及超越,海德格尔提出以"诗意的栖居"来克服现代技术的危险并回归人类本真存在的"反现代性"思路.在整个现代性发展和现代性批判的历史中,海德格尔的"返乡之途"具有彻底性、悖论性和审美性等特点.     

论欧盟金融服务法中的母国控制原则

在欧盟金融服务法中,母国控制原则是指跨境金融服务应主要遵循母国的监管规则,相应的监管责任也主要由母国监管当局承担。母国控制原则不能适用于未经金融服务指令协调的领域。相互承认原则是母国控制原则的前提和基础,母国控制原则又是实施相互承认原则的必然要求和具体体现。这一原则的形成与欧盟金融服务市场一体化方法的转变有着密切联系,其发展也是这种新的一体化模式广泛推行的必然结果。立法和司法实践表明,母国控制原则的适用范围尚不明确,其价值没有得到充分的体现。为了消除跨境金融服务的法律壁垒,推动金融服务市场的一体化进程,欧盟金融服务立法应向协调行为规则、进一步明确划分监管责任并扩大母国控制范围的方向发展。     

What does recovery mean to a forensic mental health patient? A systematic review and narrative synthesis of the qualitative literature

This is a systematic review and narrative synthesis of qualitative literature for forensic mental health patients’ perceptions of recovery. Relevant databases were searched and a total of 11 studies that fit the inclusion criteria were identified. Thematic Synthesis was applied to synthesise the collated themes into six superordinate themes: connectedness, sense of self, coming to terms with the past, freedom, hope and health and intervention. Two superordinate themes were particularly prevalent: connectedness and a sense of self. It is argued that a focus on increasing opportunities for forensic mental health patients to develop a sense of self and connectedness could help improve recovery. Future recommendations to expand on these findings include using grounded theory methods to develop theoretical understanding of the data.     

Embedding the Notion of Child- and Family-Centered Care into Organizational Practice: Learning from Organizational Visioning

Child- and family-centered care has permeated the practices of child welfare as a means to address fragmentation. Case management appears promising, but the approach is still in its infancy. This article aims to provides an understanding of the emergent organizational vision of a new approach to case management at multiple organizational levels. The authors conducted a case study on the implementation of Intensive Family Case Management in a Dutch organization that provides child and youth protection services. The focus is on the continuous and bottom-up process of visioning, which has helped to define the shared organizational vision. The key finding was an emerging, widely shared vision that is congruent at many organizational levels and that contrasts starkly with the old work approach. The conclusion is that innovative child- and family-centered approaches to case management are inherent to a multi-level organizational system that is consistent with the approaches it advocates, being embedded in organizational structures and embodied in practitioners’ mindsets.     

Cognitive Dissonance in Social Work

Cognitive dissonance is a state of tension occurring when a person holds two psychologically inconsistent cognitions. For this study, 21 social workers who facilitate transracial adoption plans for Aboriginal children in British Columbia were interviewed: 1) Do social workers who facilitate transracial adoption plans for Aboriginal children experience cognitive dissonance? If so, in what ways? 2) How does cognitive dissonance impact them? 3) In what ways do social workers reconcile a sense of dissonance? Findings suggest that social workers do experience cognitive dissonance, that they are adversely impacted, and that they find ways to reconcile the cognitive dissonance.     

LGBTQ Youth in the Child Welfare System: An Overview of Research,Practice, and Policy

LGBTQ youth are largely overrepresented in the child welfare system. The experiences of LGBTQ youth have largely been overlooked. LGBTQ youth often encounter a number of challenges and disparities as they navigate the child welfare system. Many report experiences of discrimination, marginalization, and an overall lack of acceptance. The permanency and placement options have historically been limited for many LGBTQ youth, often leading to an over reliance on congregate settings and aging out of foster are. The current article provides a synthesis of the existing research on the experiences and outcomes of LGBTQ youth in care, as well as an exploration of the policy and practice initiatives aimed at creating a more inclusive system of care.
