Chapter 12. Conclusion-Looking Ahead

Abstract

Attention is drawn to important themes thought likely to influence the continuing development of group care services for children and young people in the decade ahead. These include a poorly educated workforce, autonomous training, multi-disciplinary approaches, centres of excellence, diversified programs, new trends and issues shaping the future, and group care practice and the law.     

Other forms of conviviality: The best and least of which is our daily care and the host of which is our collaborative work

In this collaboratively written essay, artists Park McArthur and Constantina Zavitsanos take a queer materialist feminist approach to the entanglement of dependency and reproductive labor, disability, intimacy, and the impossibility of exchanging incommensurables. The text merges the authors' experiences receiving and providing one another care with their artistic practices, and includes instructive performance scores for past, rather than future, events.     

FROM THE INSIDE OUT: CALLING ON STATES TO PROVIDE MEDICALLY NECESSARY CARE TO TRANSGENDER YOUTH IN FOSTER CARE

It is well known that transgender youth in foster care often face egregious discrimination and victimization based on their gender identities. Unfortunately, transgender youth in foster care have also been deprived of transgender-specific medical care that is vital to their health and well-being. This Note advocates that child welfare agencies adopt legislation that will demonstrate their commitment to fulfilling their constitutional duty to provide medically necessary care to transgender youth in their custody. This Note examines recent case law on the topic and addresses counterarguments to the proposal, including risks associated with treatment, high cost, and the stigma of gender identity disorder. Ultimately, this Note concludes that adopting the proposed legislation is a necessary step toward securing health care rights for transgender foster care youth.

发展"家庭养老院"探索社区养老新模式

家庭养老院是一种新型的养老形式,是我国养老体系的重要组成部分.发展家庭养老院,必然在我国形成以机构养老院为龙头、家庭养老院为基础的适应全面建设小康社会的养老体系,必将产生一举多得的社会效果.     

对我国民法上非法人组织概念的质疑

我国民法典第102—107条对非法人组织的规范重点没有放在其"社团性"和"团体性"上,而是将其放在"不具有法人资格,但是能够依法以自己的名义从事民事活动"、"其出资人或者设立人承担无限责任"上,没有能够反映出非法人组织的本质特征。更为严重的是:(1)不区分经营性与非经营性非法人组织,一律让其成员承担无限连带责任。这不符合很多非经营性,甚至公益性非法人组织存在的宗旨,对其存在和发展不利,也不符合中国国情和比较法上的一般理论与实践。例如,中国法学会下属的许多学会都是典型的非经营性非法人组织,会员如何能够对学会的债务承担连带责任?无论从会员加入学会的愿意和内心、人们对学会的期望,还是习惯,都是不可能的。(2)明确把合伙企业纳入到非法人组织中去。这样一来,就彻底抹杀了非法人组织与合伙的基本区别,从而也就无从把非法人组织与我国法上的"两户"区分开来。另外,业主大会与业主委员会关系及主体性问题也应当在非法人组织的框架内得到妥善的解决。     

Understanding how foster families use humor within the resiliency process

Humor serves as a protective factor in the resiliency process for many, reducing stress and helping children and adults cope with difficult circumstances. Humor can lighten a situation and relieve tension but can also be misinterpreted in response to serious circumstances. Providing foster care can be a challenging process as families open up their homes to care for children who have experienced maltreatment. Despite challenges, many foster families are able to sustain fostering. The importance of humor was highlighted as a protective factor for foster families in the current study. Understanding the use of humor offers important implications.     

以共同育儿为业:跨越儿童抚育的家庭边界——以一个城市社区的“抱团养娃”实践为例

本文聚焦于城市化背景下的"抱团养娃"实践,深入探讨在抚育职责被"家庭化"的当下,抚育实践如何在一定程度上重新跨越"家庭"的边界。以社区共育为基点,妈妈们的努力既从私人层面上为在陌生城市中资源不足的小家庭找到更多社会支持,又在公共层面上带动孩子们以温度和情感重塑社区认同、黏合社会转型带来的制度缝隙,体现出独特的现实意义与支持力量。"以共同育儿为业"背后,是女性试图在既有的结构约束下找到被私人化的抚育照料重担与公共生活之间的连接点,在本研究中体现为共育支持网络的形成、共育友好空间的营造、亲子活动内容的生产和共育文化的建构四个方面。这为思考如何将"社会"重新带回抚育实践中提供了想象,也拓宽了对女性主体性的理解。     

新形势下建设“职工之家”工作的思考

要把工会建家工作真正落到实处,扎根于职工,须不囿于企业建家的思路,从区县乃至市一级地方总工会层面考虑"建家";同时,要更新服务理念,创新评价方式,全面提升质效。"建家"过程中要抓住工作重点,获取最大社会效益。工会应将推动企业民主管理作为建家工作的重点,积极作为,为职工之家争取最优化的资源。     

Federalism,Physicians, and Public Policy: A Comparison of Health Care Reform in Canada and Brazil

Abstract

This article uses comparative historical analysis to explore physicians’ involvement in health care reform in Canada and Brazil. Drawing on historical institutionalism, the analysis stresses how, beyond partisanship, physicians build consensus around and promote specific policy ideas, and how federal institutions shape physicians’ mobilization. In both countries, physicians’ mobilization shaped the emergence of universal health care coverage, but in quite different ways, because of the differing federal institutions. Although the Brazilian medical lobby was far more heterogeneous than the Canadian profession, one faction was able to mobilize at the local level to pursue policy ideas favorable to universal health coverage.
