Migrants and their families in the home country: a bi-directional influence on voting behaviour

ABSTRACT

The voting behaviour of migrants has been studied extensively but limited attention has been paid to how the discussion with families in the home country can be important. This article analyzes under what circumstances migrants influence or are influenced by their families in voting decisions. The analysis uses individual-level data from a survey conducted in 2018 on a sample of 1,839 Romanian migrants. The results indicate that most migrants are not engaged in acts of persuasion about voting. Those who influence their families have a direct interest in the election results, are informed about what happens in the country and are politically active. The migrants who are influenced by their families have limited experience in the countries of residence and strong ties to their home country.     

The Ethic of Care, Female Subjectivity and Feminist Legal Scholarship

The object of this essay is to explore the central role played by the ‘ethic of care’ in debates within and beyond feminist legal theory. The author claims that the ethic of care has attracted feminist legal scholars in particular, as a means of resolving the theoretical, political and strategic difficulties to which the perceived ‘crisis of subjectivity’ in feminist theory has given rise. She argues that feminist legal scholars are peculiarly placed in relation to this crisis because of their reliance on the social ‘woman’ whose interests are the predominant concern of feminist legal engagement. With the problematisation of subjectivity, the object of feminist legal attention disappears and it is in attempts to deflect the negative political consequences of this that the ethic of care has been invoked, the author argues, unsuccessfully. The essay concludes with suggestions as to how the feminist project in law might proceed in the wake of the crisis of subjectivity and the failure of the ethic of care to resolve it. Out-of-Home Care Programs in Argentina: Contradictions Between Effective Protection and Long-Term Permanency

According to UNICEF, in 2011 nearly 14,700 children lacking parental care were attended by public protection measures, such as out-of-home care devices. The aim of this work is to account for the operating conditions of such interventions in Buenos Aires province. Our approach agrees with methodological perspectives guiding current interventions aimed at childhood, which consider children as subject-bearing rights and request all social institutions watch their well-being. The analysis exploits documentary and primary sources of information based on interviews with actors involved in public special protection devices. Our focus is directed towards the analysis of suggested and effective conditions of permanence in special protective measures and, therefore, in exiting from such devices. One of the main conclusions is that bureaucratic requirements aimed to establish an explicit time horizon for public cash transfers face conflicts with more general guidelines that should guide interventions with childhood.     

Trends in Residential and Community Care for Dependent Children and Youth in Israel:

Policy trends and their underlying ideologies are reviewed for Youth Aliyah, the Ministry of Labor and Social Affairs, and the Ministry of Education and Culture. On this basis, the current status of research and evaluation, differential diagnosis and program assignment, and planning accountability are presented with recommendations for needed policy initiatives.

2012年刑事诉讼法修改过程中新增的“依法不负刑事责任的精神病人强制医疗程序”具有深刻的立法需要,但这一新增程序的法律规定仍显粗放,一系列解释学问题需要予以分析.强制医疗本身是保安处分性质的预防性措施,强制医疗程序是刑事司法程序且为独立于定罪程序的独立程序.在强制医疗程序实施过程中,迫切需要解释强制医疗的适用条件、临时的保护性约束措施、申请期间与管辖以及执行等方面问题,方可确保法律规定的真正贯彻落实.     

强制医疗理论问题研究

以强制医疗的基础概念"精神病"和"精神障碍"作为逻辑起点,结合理论发展和最新立法规定,提出概念应统一于"精神障碍"。厘清基础概念之后,分别对"强制医疗"和"强制医疗程序"进行了法律分析,明确强制医疗为一种保安处分,强制医疗程序为一种特别诉讼程序,应当具有诉讼化的构造,并对强制医疗程序的必要性进行分析。强制医疗程序作为一种特别程序,其建立具有重要意义:在实体法意义方面,对关于保安处分的研究及立法形成了倒逼;在程序法意义方面,对刑事诉讼目的进行了拓展。
