人性视阈中政治制度设定的合法性问题分析

伴随着公民政治人格的发展与完善,制度建构的合法性问题日益凸显,并成为政治学研究的重要问题之一。对历史上中西传统人性观进行研究,以便揭示出人性本质,并为政治制度建构提供人性根源的依据,导正政治制度安排中合法性缺失的偏差,具有重要的理论及现实意义。

The Frontiers of Legal Analysis: Reframing the Transition in Northern Ireland

British constitutional legal discourse is structurally limited in its capacity to capture the complexity of the Good Friday Agreement. Rather than assessing the Agreement in narrow devolutionary terms, it should be seen as a hybrid domestic and international law instrument, making an important contribution to accepted international law norms in relation to self-determination. The Agreement transforms and partly transcends the Northern Ireland conflict by substituting political contestation for violent conflict, and by defining the modalities of conducting that contestation. This analysis complements classical international law perspectives, and opens up the application of legal discourses associated with 'transitional justice' to the legal and political transformation in Northern Ireland. These discourses focus on the problem of reconciling the demands of peace with the imperatives of justice. The Agreement sits squarely in this terrain with its provisions on 'dealing with the past' and 'institutional legacies'. The insights gained here challenge orthodox thinking about conflict-management and the ongoing political process.     

解读“国家尊重和保障人权”——析宪法修改对刑事诉讼法再修改的影响

修改后的宪法确立了“国家尊重和保障人权”原则。从修宪的背景、修宪的精神以及立法机关的解释可以解读出 ,该原则强调人权的个体性、非工具性和非功利性。我国现行刑事诉讼法的目的具有极强的功利性 ,对权利保障的规定具有浓厚的工具色彩。因此 ,刑事诉讼法再修改时 ,应当以修宪所确立的人权保障内涵和要求为检视标准 ,重新界定刑事诉讼法的目的 ,确立或修改相关的诉讼原则、制度和规则。     

刑事诉讼强制措施的适用应遵守比例原则——兼论相关检察监督

刑事强制措施作为刑事诉讼的重要手段和保障措施长期以来得到了充分的运用,但法律有关强制措施强度及其适用的规定存在着明显不足,客观上导致其在实践中被不正确适用甚至滥用。引进比例原则,对强制措施的适用加以合理限制,使其与被追诉人适用的刑罚相谐调,有利于其在刑事诉讼中发挥合理效能。     

中国在消除对妇女的暴力方面所面临的新挑战--对女童和青年妇女以劳动剥削为目的的拐卖

人口拐卖是1995年第四次世界妇女大会以来国际社会所关注的重要的性别平等问题,是消除对妇女的暴力方面所面临的新挑战。人口盲目流动造成被拐卖的风险,以各种形式的劳动剥削(包括性剥削)为目的拐卖问题正在中国逐渐增多,女童和青年妇女的多重脆弱性,使她们成为以劳动剥削(包括性剥削)为目的的拐卖的最大的受害者。本文针对既往在人口拐卖问题上的政策空白和认识盲区,结合对女童和女青年的多重脆弱性的分析,提出综合性的防止以劳动剥削(包括性剥削)为目的的拐卖的政策建议。     

ENTER THE DRAGON: INSIDE CHINESE HUMAN SMUGGLING ORGANIZATIONS*

This paper examines the inner workings of Chinese human smuggling organizations. Contrary to widely held conceptions about Chinese organized crime, most alien smugglers are otherwise ordinary citizens whose familial networks and fortuitous social contacts have enabled them to pool resources to transport human cargoes around the world. They come from diverse backgrounds and form temporary alliances to carry out smuggling operations. With the exception of a shared commitment to making money, little holds them together. The smuggling organizations mostly resemble ad hoc task forces and are assembled for specific operations. These organizations have clear divisions of labor with limited hierarchical structures. We discuss the theoretical implications of their unique organizational characteristics.

女大学新生思想状况调查表明:在适应环境方面,其自主独立意识增强,但对环境的主动适应能力有待提高;在学习方面,其学习态度端正,欲望强烈,但压力较大;其人生价值积极向上,但价值取向上表现出自我化、实效化、短期化的特点;人际关系是当代大学生面对的最难适应的问题之一。我们应针对女大学新生思想状况中存在的问题采取有效的处理对策。
