刑事追诉机关在初次讯问犯罪嫌疑人或对其羁押时,应当告知其享有的诉讼权利.这是受刑事追究者获得告知的权利,也是刑事追诉机关的告知义务.现代人权保障制度的发展,不仅要求侦查、检察机关履行告知义务,而且应当依法允许犯罪嫌疑人行使其诉讼权利,并为其权利的实现提供保障.以侦查阶段的初次讯问为对象,对告知义务进行考查,比较美英加法德等国以及我国台湾刑事诉讼法对初次讯问时的告知义务的规定,剖析我国相关法律规定的问题所在,进而对完善我国侦查阶段初次讯问时的告知义务提出了建议. 相似文献

如何促进员工的创新行为对组织的发展至关重要。本研究通过多源、多时点调研方式,对我国技术型企业的人力资源部门负责人及其下属员工进行问卷调查,探讨了组织实施的高绩效人力资源管理系统对员工创新行为的影响,并检验了促进性建言与抑制性建言的竞争性中介作用及心理安全感的调节作用。研究结果表明:组织实施的高绩效人力资源管理系统对员工创新行为有显著正向影响;促进性建言和抑制性建言在高绩效人力资源管理系统与员工创新行为间表现出部分中介作用;心理安全感调节了高绩效人力资源管理系统与促进性建言之间的关系;同时,心理安全感还调节了促进性建言对高绩效人力资源管理系统与员工创新行为关系的中介作用。 相似文献

Abstract This study aims to advance understanding of social workers’ perceptions of the circumstances necessitating and preventing the placement of children with disabilities (CwDs) in institutions. This retrospective study involved thematic analyses of one focus group (n?=?7) and semi-structured individual interviews (n?=?12). Participants included social work professionals with experience providing welfare services for CwDs and their families. In effort to prevent separation of CwDs from their families, results suggest a need for continued monitoring of deinstitutionalization of CwDs alongside increased availability, accessibility, and quality of childcare, alternative child welfare and family support services. 相似文献

Although forensic examiners operate in a stressful environment, there is a lack of understanding about workplace stress and feedback. These organizational and human factors can potentially impact forensic science judgments. In this study, 150 practicing forensic examiners from one laboratory were surveyed about their experiences of workplace stress, and the explicit and implicit feedback they receive. Forensic examiners reported that their high stress levels originated more from workplace-related factors (management and/or supervision, backlogs, and the pressure to do many cases) than from personal related factors (family, medical, and/or financial). The findings showed that a few (8%) of the forensic examiners sometimes felt strong implicit feedback about what conclusions were expected from them and that some (14%) also strongly felt that they were more appreciated when they helped to solve a case (e.g., by reaching a “match” as opposed to an “inconclusive” conclusion). Differences were found when comparing workplace stress and feedback levels across three core forensic science fields (forensic biology, chemistry, and latent prints) and across career stages (early, mid, and late). Gaining insights into the stress factors within a workplace and explicit and implicit feedback has implications for developing policies to improve the well-being, motivation, and performance of forensic examiners. 相似文献

中国的英语教育近年来受到越来越多的重视。无论是国家还是个人都投入了大量资源用于英语教育,如此巨额的投入所带来的劳动市场回报值得关注。英语教育的劳动市场回报可以分为人力资本投入回报和信号作用回报。研究发现,英语在实际工作中使用越多,工资收入越高,是为英语教育作为人力资本投入回报的证据。但在工作中很少用到英语的人,通过英语四六级考试对其工资也有显著影响,反映了英语教育具有信号作用的功能。调查显示,英语教育的信号作用是英语教育劳动市场回报的主要方面。因此,中国的英语教育有过度教育从而导致资源配置低效率之嫌,建议及时调整国家的英语教育政策。 相似文献

人口老龄化是中国当前及今后很长时期都必须面临的重要问题,充分认识到老年人力资源开发的重要意义,挖掘老年人口红利将成为经济社会发展的新动力。中国拥有规模庞大的老年人力资源,但老年人口实际就业率并不高。影响老年人力资源开发和利用的因素既有社会观念、强制的退休年龄制度等宏观因素,也有老年人的就业意愿、健康状况、受教育程度等微观因素。促进老年人就业,实现老有所为是中国积极应对人口老龄化的重要举措。研究提出如下政策建议:转变社会观念,营造老年人力资源价值观念;重点开发低龄健康老年人力资源;加强对老年人的教育和培训;重视对老年就业的法律保护;改革现有的强制退休年龄制度,实行弹性退休制度。 相似文献

ABSTRACTThe main objective of this study is to investigate the factors affecting the use of social networks towards recruiting human resources for organizations. Through an in-depth review of the relevant literature, a questionnaire was designed and distributed among the sample and collected data were analyzed using PLS-Software. Results revealed that 50?75% of organizations use social networks in their organizations and all the identified effective factors in the use of social networks for human resources recruitment were confirmed, except for “hope for performance”. “Facilitating conditions” have the highest impact on the usage of social networks in recruiting, “Social influence” identified as one of the most important factors in people’s behavioral intention for the usage of social networks in recruitment and “Effort expectancy” had the least impact on behavioral intention. ABSTRACTStudies have demonstrated the efficacy of the Scharff technique for gathering human intelligence, but little is known about how this efficacy might vary among different samples of practitioners. In this training study we examined a sample of military officers (n?=?37). Half was trained in the Scharff technique and compared against officers receiving no Scharff training. All officers received the same case file describing two sources holding information about a terrorist attack. University students (n?=?74) took the role of the semi-cooperative sources. Scharff-trained officers adhered to the training as they (1) aimed to establish the ‘knowing-it-all’ illusion, (2) posed claims as a means of eliciting information, and (3) asked fewer explicit questions. The ‘untrained’ officers asked many explicit questions, questioned the reliability of the provided information, pressured the source, and displayed disappointment with the source's contribution. Scharff-trained officers were perceived as less eager to gather information and left their sources with the impression of having provided comparatively less new information, but collected a similar amount of new information as their untrained colleagues. The present paper both replicates and advances previous work in the field, and marks the Scharff technique as a promising technique for gathering human intelligence. 相似文献
