面对文化歧视的加拿大华人

加拿大华人社会从19世纪中叶至今,经历了巨大的社会文化变迁,老移民团体在制度性种族歧视下受到了各种限制与压迫。新移民团体在不平等法案法规废除以后,通过社会流动取得了一些改善与进步。“唐人街”(中国城)的产生、发展及加拿大华人群体面对文化霸权所进行的各种适应性改变,体现了他们在面对白人社会主流文化涵化与融合的过程。加拿大华人自身对于苦难的承受力也促使他们形成新的文化身份,争取到更加有利的发展空间。     

Character-building and freedom in education

Educators, parents, and policy-makers in the United States, as in other countries, are concerned about the apparent inability of many schools to contribute to the development of character and civic virtue in their pupils. The answer, experience shows, is not for government to require a pedagogy of state-defined character education which, in a pluralistic society, would inevitably create new conflicts. Instead, education policy should take advantage of the growing interest on the part of educators in creating autonomous, distinctive schools, and the continuing interest, on the part of parents, in being able to choose what school their children will attend. Schools which exhibit a distinctive character based upon a shared understanding of the goals of education are effective not only in teaching academics but also in developing positive character traits in their pupils. Charter schools and educational vouchers are two means of encouraging and supporting such coherent schools. The article concludes with a series of policy recommendations designed to balance the autonomy of schools against the need for public accountability. 艺术作品概念的开放性与同一性--对后现代艺术作品解答的一种尝试

20世纪西方艺术哲学对"什么是艺术作品"提出了种种无核心、无确定意义的"洋葱式"解答,而这表明西方艺术理论在不断精密化的同时也在不断地陷入枝节的缠绕,迷失中心和整体的感觉,最终丧失真正的解说能力。将艺术作品作为一个开放概念,从艺术作品中人的印证———技巧与意向,以及作品的同一性———变异与永恒等方面切入,可对后现代艺术作品进行一尝试性解答。     

文化性的缺失—论课程的文化锁定现象

课程起源于化传承的需要，传递、复制、再生产社会化是学校课程唯一不变的使命。在课程发展中形成了特定的化锁定现象。它造成了课程应具有的自的化品性及其所必然引发的内在的、独立的价值标准与宗旨的消解。课程成了现实社会主流化的“代言人”。它具有诠释、粉饰及原样传递的职责，却无反思、批判、创新的品质。学校教育的工具品性、灌输与训练机制、教育教学理论的学术品质等，都是课程化锁定现象所造成的化性缺失的必然结果。揭示课程化性缺失的病理表征，是使课程由化的工具存在转变为化的主体存在的重要前题。     

在通向自我认同的途中——中国现当代女性写作的主体性变迁

五四至新时期女性写作中的主体性变迁呈现为自我发现、自我失落、自我寻找和自我建构的认同过程,这表明女性写作中的自我认同是一个连贯性和永恒性的命题,是对外在奴役的挣脱和主体自由的寻求,其意义在于自我行动的动力过程.     

Understanding Russia’s energy turn to China: domestic narratives and national identity priorities

This study investigates whether, as part of a broader “Asian Energy Pivot,” Russia’s energy giant Gazprom refashioned its export strategy away from Europe, and what impact such a reorientation might have on the EU–Russia gas relationship. It uses four empirical cases to emphasize the domestic movers underlying Russia’s eastward shift in energy trade, developing a constructivist theory rooted in the dynamics of Russia’s dominant public narrative and the contours of domestic politics. It argues that Russia’s national interests changed as a result of how Russian policy-makers interpreted and reacted to the stand-off with Europe, in response to what they perceived as Europe’s attempt to isolate it economically and geopolitically. Russia’s Eurasianists, who had advocated the notion of a necessary turn to the East for a long time, positioned themselves as norm entrepreneurs and their new interpretation of the preexisting material incentives shaped the future course of action.     

“计赃论罪”的历史考察与现实变革

我国古代关于盗窃罪的立法有着"计赃论罪"的传统,而这一立法传统在近代经过短暂的断裂后,又在新中国的刑事立法中得以体现。新中国刑法中的"计赃论罪"在内涵上与古代刑法中的"计赃论罪"并不完全相同,主要表现在从定性分析模式到定性+定量分析模式的演变。这种演变,与盗窃行为社会危害性程度的变化、我国传统文化心理以及现实刑事政策密不可分。无论在理论上还是在实践中,纯粹的"计赃论罪"立法模式都已丧失了生存的空间,我国盗窃罪应当确立"双轨制"的立法模式。     

民族主义话语及其表述实质——19世纪上半叶俄国文化运动及其历史影响

19世纪上半叶是俄国社会思潮和文化运动发生多元剧烈变动的关键历史时期。自1836年恰达耶夫发表著名的《哲学书简》并引起俄国思想界的震惊时起,就在精英知识分子中展开了针对俄罗斯命运与前途的民族主义双重话语表述。这种表述的大方向,是在短时期内充分学习西方的前提下,确立俄国在欧洲乃至全世界的独立文化身份和精神优势。其间,俄罗斯传统文化意识在俄国和欧洲两种文化交流与激烈碰撞背景下的生存与发展问题,成为知识界普遍关注的共同话题。这一时期的俄国文化运动紧紧围绕知识分子的民族主义话语表述而展开。     

华南族群的互动与认同

华南地区少数民族族群来源复杂,结构多样.早在远古时代就有许多原始族群活跃在华南,族群之间不断互动、涵化,到清朝基本定型为三个层次.华南族群中既包括少数民族族群,也包括汉族族群.各族群的认同基本上都是从族源认同和语言认同两个方面来概定,其中,语言认同方面汉族族群的方言比少数民族族群的方言种类更多,内容更丰富.     

员工秘密取回老板拖欠工资行为之定性研究

电影《三枪拍案惊奇》中赵六陈七秘密取回老板拖欠工资的行为实乃当下社会现实问题的反映。在我国当前刑法语境下,此类员工秘密取回老板拖欠工资的行为不同于窃取本人财物的行为,形式上构成盗窃罪。因为欠缺情况紧迫这一时机条件,该行为不属于自救行为,因而无法得到正当化。在目前公力救济无法切实保障被欠薪劳动者的合法权益,而劳动者无奈采取的私力救济又涉及刑事不法的困境下,刑法第13条但书规定或可为其提供一条出路。
