程序性辩护是与实体性辩护相对应的一种辩护权行使方式,它是针对公安司法机关在刑事诉讼中的诉讼行为的合法性向中立的裁判者提出申请或者质疑,请求其作出权威的程序性裁判,使被侵害的权利获得司法救济,进而间接地证明被追诉人无罪或者罪轻的一种辩护方式.当前程序性辩护在我国法律中有所体现,但尚未形成完整的体系,且现有规定存在诸多不足...     

犯罪概念的"但书"规定理论基础探讨——以可罚的违法性为基础

在我国刑法理论中,学者们对于犯罪概念中“但书”的规定有很多论述,但是对于它的理论基础问题却大都置之不论,难以对“但书”的立法规定形成理论支撑。以“可罚的违法性”为基础,探讨其作为“但书”理论基础的可能性,则利于为“但书”提供较为充足的理论支持。     

Epistemic Reasoning and Adolescent Egocentrism: Relations to Internalizing and Externalizing Symptoms in Problem Youth

This investigation addressed the question of how two forms of social cognitive reasoning – epistemic reasoning and adolescent egocentrism – interface with externalizing and internalizing forms of psychopathology during adolescence. Adolescents’ epistemic reasoning (i.e., types of belief entitlement, or degree of doubt, held by an individual when confronted with contradictory sides of an issue), and imaginary audience and personal fable ideation, were assessed in a sample of 29 adolescent boys with behavioral problems and 30 of their peers without behavioral problems. To assess internalizing and externalizing symptomatology, teachers completed the Child Behavior Checklist (CBCL-TRF). Results revealed that, compared to those without behavior problems, boys with behavioral problems were lower in epistemic reasoning. Further analyses revealed consistent relations between dimensions of social cognitive reasoning to specific forms of psychopathology. These findings suggest that social cognitive reasoning, particularly epistemic doubt, is important in understanding problem behaviors among typical and atypical adolescents.

民事诉讼司法认知对象范围探讨

司法认知是世界上许多国家证据法上所普遍适用的就某些特定的案件事实由法官直接加以确认 ,从而免除当事人举证责任的一种诉讼规则。我国关于司法认知的立法与研究同外国相比差距较大 ,在民事诉讼中如何客观地界定司法认知的对象范围 ,尚需深入研究。笔者认为 ,民事诉讼司法认知对象有事实和法律两方面。事实范围包括众所周知的事实、司法事实、政府事实、易于获知的事实 ;法律范围包括本国法、国际条约和惯例、外国法。

犯罪故意成立：违法性认识还是社会危害性认识

犯罪故意的成立究竟要求违法性认识还是社会危害性认识备受争论。中国刑法语境下的违法性认识指的是刑事违法性认识，社会危害性认识指的是行为人对自己实施的行为是否符合社会主文化群体利益、需要的主观认知。普通老百姓几乎不懂法是一个不容争辩的客观事实，行为人在行为时不可能准确判断行为的违法性；违法性认识作为故意的内容不利于实现刑法保护包括犯罪人在内的全体公民基本人权的目的，违法性不是故意的认识内容，社会危害性认识才是故意成立的必备要素。     

运用项目反应理论分析不同认知特点的题目

项目反应理论和认知心理学是两个不同的研究领域 ,把它们结合起来可以得到更多的题目信息。通常人们只是利用了项目反应理论提供的项目难度、区分度等统计指标 ,本研究发现对于具有不同认知特点的题目 ,它们的项目特征曲线和差异性系数是有显著差异的。高分组和低分组在认知结构上的差异 ,也可以通过项目特征曲线反映出来     

语义模糊的认知探索及对英语教学的启示

将认知语言学中的原型范畴理论应用于语义模糊当中,一个非典型成员与典型成员之间的距离越近,它的隶属度就越高;距离越远,隶属度就越低,人们对其成员地位的认识就越模糊,也越容易产生分歧,进而导致语义模糊,这为英语教学提供了若干启示。     

论环境侵权责任不以“行为违法性”为要件

环境侵权责任是私法调整手段在环境保护领域的运用。构成要件是确定环境侵权责任的依据，通观目前我国学界对环境侵权责任构成要件的争论，其聚焦点主要是污染环境的行为是否必须具有违法性。从我国相关法学理论、现有法律规定及司法实践中可以看出：“行为违法性”不应成为环境侵权责任的构成要件。     

A Theory Matrix for Mediators

The author uses a behavioral perspective to survey theory that may be useful in mediation. He notes the lack of diffusion of knowledge of theory among practitioners and argues that mediators should pay more explicit attention to theory. He presents a matrix comprising the behavioral factors of perception, emotion, cognition, communication, and intervention at the micro, meso, and macro levels of conflict and uses this matrix to organize and review some mediation theories. Several types of intervention theory are identified: integrated, generic, dialectical, developmental, and dialogical. The article closes by posing some outstanding theoretical issues and questioning whether current mediator training programs are adequate to bridge the gap between theory and practice.
