个人生活规则的探索与修正——韦斯勒之认知评价疗法的当代解读

认知评价疗法的核心概念是"个人生活规则",它是指个体的一种认知结构,代表个体对心理和社会性事件的法则化的看法和道德伦理的规定性。个体所产生的各种情绪和对自我的看法、评价皆与个人生活规则相关。个体心理问题之所以出现,在于个体所持有的个人生活规则缺乏一定的适应性,故心理治疗就是要对个人生活规则加以调整和修正。认知评价疗法吸收了诸多人文主义的观点,体现了心理疗法间相互融合的趋势。     

创建农村社会救助体系的新思维

本文从贯彻落实“三个代表“重要思想、全面实现小康社会目标的高度,针砭和整合传统的农村社会救助体系,提出了建立新型农村社会救助制度的思路.     

Party opportunism among local politicians after Taiwan’s power transition

This paper probes into a hypothesised opportunism towards political party affiliation among local politicians in Taiwan since the power transition from Kuomintang (KMT) to Democratic Progressive Party (DPP) rule began in 2000. Longitudinal changes in election candidates' party affiliation are analysed to see what happened to the KMT's supposedly strong base of local politicians after the change of governing party. The research finds a generally high propensity of election candidates' changing or dropping their party affiliation between elections, and an increased propensity among KMT candidates after 2000. However, defections to other parties are more common in higher elections. In grassroots elections, many candidates flow in and out of their party affiliation depending on the political circumstances, but they rarely change party. Several years after the DPP gained power in presidential elections, the new ruling party is still struggling to build a strong local party organisation.

“流动知青”并不是一般意义上的社会弱势群体,但由于某些现存社会制度内含的针对某些社会群体的社会歧视,该群体具有社会弱势群体的某些特征。随着市场经济的进一步发展和完善,目前尚处于边缘状态的“流动知青”将成为未来青年就业群体中的主流群体。中央政府应尽早着手建立不分城乡、不分区域、全国统一的社会保障体系。     

质疑独立董事制度

引入独立董事制度是为了改善目前我国上市公司的法人治理结构,制约内部控股股东利用其控制地位做出不利于公司和外部股东的行为,以保护广大中小股东的利益.但由于<公司法>没有明确规定上市公司必须建立独立董事制度,更没有相关的详细规定,导致了实际操作的困难.从实践的结果看,独立董事的独立性无法保证;独立董事和监事会在监督权力上重叠与交叉造成的权力冲突,导致资源浪费或互相推诿,增加监督成本,降低公司运作效率,影响公司治理的质量.当独立董事制度在我国还没有很好的成长环境时,对严重的内部人控制现象的频频发生,我们应当在现有的法律框架下寻找法律救济.

广西各世居少数民族在健康和文化素质这两个反映人口生活质量的最基本方面存在较大的差异 ,从总体上看 ,少数民族人口生活质量偏低 ,最主要的原因是其人口文化素质低下 ,因此 ,大力发展少数民族教育事业 ,努力提高少数民族人口文化素质 ,是广西少数民族人口进入小康生活质量行列的关键所在     

Surety Wives in the House of Lords: Time forSolicitors to `Get Real'?Royal Bank of Scotland plc v. Etridge (No. 2) [2001] 4 All E.R. 449

This note considers the recent House of Lordsdecision in Royal Bank of Scotland plc. v.Etridge (No. 2). It concerns the familiarscenario of a wife jointly mortgaging (orproviding a guarantee for a mortgage of) thefamily home in order to secure financialsupport for a business run by her husband. Ina landmark judgement, Lord Nicholls set out newand specific procedures to be followed bylenders and solicitors who are providingindependent advice, in order to counter anyargument by the wife that the charge should beset aside because her signature on the lender'scharge has been obtained by the undue influenceof her husband. This note considers the impactof the decision upon the parties involved insuch transactions. Special consideration isgiven to the surety wife and her chances ofdefending possession proceedings brought bylenders in the post Etridge era.
