国际组织的自主性行为:两种理论视角及其比较

20世纪60、70年代曾经出现过一次国际组织的研究浪潮。通过大量的案例分析,一些学者发现了国际组织具有不受其成员国意志掌控的自主性行为这一经验现象。冷战结束后,随着经济全球化的突飞猛进和国际组织治理任务的日益增多,针对国际组织的自主性行为这一经验现象,学者们运用了委托-代理理论和社会学制度主义两种分析工具对其进行了学理解析。本文对委托-代理模式和社会学制度主义在国际组织自主性行为的发生基础、行为动力和实践表现等问题上的主要观点进行了梳理和概述,并对两种理论视角进行了简要的比较。文章指出,委托-代理模式对国际组织的行为偏好认识不足,社会学制度主义对外部环境压力对国际组织的影响有所忽视,在对具体问题的分析中,需要将两种理论视角有机地结合起来,这样才能更加全面、深刻地认识和理解国际组织自主性行为的根源和本质。     

困难职工群体的成因、现状和发展趋势

当前困难职工已构成了城镇困难群体的主体、困难职工有贫困扩大和加深的趋势、在同样符合低保条件的情况下,特困职工比其他群体更难享受到最低保障,因此应该引起深切关注。同时文章分析了困难职工贫困成因,指出就业和社会保障不足是他们陷于贫困的最主要原因,因此对他们救助的最主要途径,就是为脆弱人群创造更多的就业机会和构筑社会安全网。     

独立学院大学生人际交往状况的调查研究

为了解独立学院不同群体大学生人际交往的现况及差异,作者选取529名独立学院大学生作为被试,采用《大学生人际关系综合诊断表》对他们的人际交往状况做了调查。调查发现,独立学院大学生的人际交往方面存在一定的困扰,需要引起重视,应该针对不同亚群体的特点给予一定的教育和训练,以提高他们的心理健康水平。     

The man who envied women

Boredom is a permeating, trespassing force – an intensity not necessarily recognized as such. This essay approaches the aesthetics of political failure, and in particular, the cinematic intensities of boredom as affective expressions of post-traumatic malaise. Lou Ye’s Summer Palace (2006), one of only three Chinese narrative films to represent the 1989 Tiananmen Incident, draws upon an aesthetics of banality to dramatize the epistemological limits and resultant trauma of 6/4, a historical event subsequently repressed in mainland Chinese media. Refusing melodramatic catharsis, the film’s stalling and stupefying effects perform both the amnesiac circumstances surrounding 6/4, as well as the compassion fatigue that followed. Even more surprisingly, Lou’s overuse of sex, a dull instrument by the film’s end, constitutes Summer Palace’s privileged sight/site of boredom. Indeed, sex, rather than constituting the censored obscene act, stands in for something far more offensive. Summer Palace frenetically pivots around an open secret, the historical memory of Tiananmen, as nervous sensation is composed within and without the text, centering on women’s bodies. Drawing on close textual analyses, this essay contends that the excessive contours and shapes of the memorial wound in Summer Palace take on the particularly anxious forms of dull sex in a messy Square.     

社会工作在居家养老服务中的介入研究——以山东省为例

我国已进入老龄化社会,养老问题也成为社会关注的焦点。目前,我国已形成了家庭养老、机构养老、居家养老服务的基本养老模式。其中,居家养老是一种符合我国实际情况的养老模式。调查显示：山东省作为我国第一老龄人口大省,目前急需发展的是居家养老服务体系,山东省居家养老还存在诸多问题,需要社会工作的介入。     

Las funciones de los consejeros independientes de las sociedades en México: Recomendaciones para el cambio a partir de las asimetrías existentes entre la práctica y la ley

The legal notion of an independent board member was introduced to the Mexican legislation in 2005. The goal was to improve the corporate governance of the corporations listed on the stock exchange. It was thought that including the independent board members would help to better represent the interest of the minority holders, as well as to increase the level of accountability. This article challenges these ideas based on 10 interviews carried out with independent board members. It finds that what the law says is far from what actuatly occurs: they lack of an adequate level of knowledge to perform their tasks, their degree of independence is severely limited by the criteria used to appoint them and they usually ignore essential corporate information, which impede them from participating effectively in the board sessions. The article suggests the creation of an independent board member’s association, a mechanism that, along with a mandatory certification system, would improve the way in which they perform their duties.     

妇女和婚姻从此就失去保护了吗？——评婚姻法解释三第七、第十一条

媒体和学界对《婚姻法解释三》第七条、第十一条等条文的诟病甚多，认为它们弱化了对妇女的保护，违反甚至冲击、摧毁我国传统婚姻家庭文化、婚姻家庭伦理和婚姻家庭价值取向；另外还认为婚姻家庭领域与物权、合同领域殊有不同，这两条司法解释是将后者的原理粗暴地适用于前者，甚为谬误。笔者认为，这些抨击是对婚姻法解释三的误读。本文试图从对这些抨击作出辩驳的角度论证婚姻法解释三第七条、第十一条的正当性。     

推而行之存乎人——谈法官行为与司法独立机制的实施效果

司法独立机制的实现受多方面因素的影响,缜密的司法制度,合理的权力配置体制,完善的法律法规等,都对司法独立起着不容忽视的作用.其中起着决定性作用的一环应为人的因素,在假设其他影响因素都达到完善的情况下,法官在执法工作中的法律信仰、专业素质等各种行为都对司法独立机制的实施效果产生着一定的影响.

独立学院思政教育作为高等教育的重要组成部分,面临着一系列的挑战。特别是母体高校的模式影响、社会环境的冲击以及自身的弱点,使独立学院思政教育面临较大困境。只有在思想政治教育中激发学生的内在激励,发挥外在激励的作用,运用各种手段创设长效机制,才能促使独立学院的思想教育工作健康开展,有效提升独立学院学生的综合素质,切实增强其培养的应用型人才的核心竞争力。
