对比研究中外部分国家警察执法保障相关立法规定。在借鉴国外警察执法保障相关立法经验和我国警察执法保障现状的基础上,探索完善我国警察执法权益保障的对策。其中包括:建议单独增设袭警罪;建议修改《人民警察法》第三十第五条规定,加大对侵犯警察执法权力的处罚力度:规范合法警用暴力的使用标准。完善警察执法保障的其他建议是:建立完善人民警察维权的机构;充分发挥警用装备的作用;提高民警自我防护意识;强化民警执法素质和执法活动效能的训练。 相似文献

This article explores the possibility of measuring the impact of law enforcement on organized crime in a reliable and accountable
manner, both in general terms and with a practical focus on the Canadian context. In considering measures to combat organized
crime, a focus on process measurement has obscured the more substantial question of progress as regards the dependent variable
itself: the bottom line of reducing the impact of organized criminal behaviour. While outcome measures are more challenging
to identify than process measures, this fact alone does not minimize the need to demonstrate the connection between organized
crime enforcement and its presumed outcomes to a greater degree of certainty. To date, this has not been realized to any significant
degree, as revealed by a review of existing international approaches to measuring the impact of enforcement activity. The
article argues that a multidisciplinary focus on community level indicators of crime, if initially less accessible than process
measures of impact on organized crime groups, offers promise as a measurement of absolute and relative impact of state investment
in enforcement.

Organised crime, due to its intricate nature, is a very challenging as well as less accessible research field. Although difficult
to conduct a methodical research on this topic, organised crime, nevertheless, offers a unique opportunity to utilise an interdisciplinary
research methodology. This paper describes (multiple) triangulation as an appropriate method for researching the role of culture
in the advancement of ethnic Albanian organised crime groups in Europe. Triangulation, for the purpose of the described project,
has been used to obtain confirmation of findings through convergence of different perspectives. Interviewing offenders is
one of the research methods more thoroughly explained in this paper. The paper too explores some advantages of snowball technique
used for interviewing less accessible research subjects. It also discusses various dilemmas, security-related or not, researchers
are faced with when intending to interview serious offenders.

There is broad consensus in the literature on regulatory enforcement and compliance that politics matters. However, there is little scholarly convergence on what politics is or rigorous theorization and empirical testing of how politics matters. Many enforcement and compliance studies omit political variables altogether. Among those that address political influences on regulatory outcomes, politics has been defined in myriad ways and, too often, left undefined. Even when political constructs are explicitly operationalized, the mechanisms by which they influence regulatory outcomes are thinly hypothesized or simply ignored. If politics is truly as important to enforcement and compliance outcomes as everyone in the field seems to agree, regulatory scholarship must make a more sustained and systematic effort to understand their relationship, because overlooking this connection risks missing what is actually driving regulatory outcomes. This article examines how the construct of “politics” has been conceptualized in regulatory theory and analyzes how it has been operationalized in empirical studies of regulatory enforcement and compliance outcomes. It brings together scholarship across disciplines that rarely speak but have much to say to one another on this subject in order to constitute a field around the politics of regulation. The goal is to sharpen theoretical and empirical understandings of when and how regulation works by better accounting for the role politics plays in its enforcement. 相似文献

Regulators and other governors rely on intermediaries to set and implement policies and to regulate targets. Existing literatures focus heavily on intermediaries of a single type – Opportunists, motivated solely by self-interest. But intermediaries can also be motivated by different types of loyalty: to leaders (Vassals), to policies (Zealots), or to institutions (Mandarins). While all three types of loyalists are resistant to the traditional problems of opportunism (slacking and capture), each brings pathologies of its own. We explain the behavioral logic of each type of loyalty and analyze the risks and rewards of different intermediary loyalties – both for governors and for the public interest. We illustrate our claims with examples drawn from many different realms of regulation and governance. 相似文献

The European Union has some of the world's most ambitious and highly developed environmental laws on its books, but their effectiveness is severely compromised by non-compliance. With the UNECE Aarhus Convention (1998), Europe launched an innovative legal experiment, democratizing environmental enforcement by conferring third party citizens and environmental non-governmental organizations (ENGOs) with legal rights of access to environmental information, public participation, and access to justice in environmental matters. Based on some 2000 surveys and over 150 interviews with stakeholders from three Member States – France, Ireland, and the Netherlands – we adopt a holistic, 360° perspective, capturing the views of regulated parties, NGOs, and the general public on this private governance experiment. Our data provide important new insights into the practical effectiveness of Europe's laws enabling private environmental enforcement, its (intended and unintended) effects on farmers' compliance decisions in the vital area of nature conservation, and how law might be used to stimulate pro-environmental predispositions. 相似文献

Our paper examines how street-level drug markets adapt to a macro-level disruption to the supply of heroin, under three experimental
conditions of street-level drug law enforcement: random patrol, hot-spot policing and problem-orientated policing. We utilize
an agent-based model to explore the relative impact of abstractions of these three law enforcement strategies after simulating
an ‘external shock’ to the supply of heroin to the street-level drug market. We use 3 years of data, which include the period
of the ‘heroin drought’ in Melbourne (Australia) that commenced in late 2000 and early 2001, to measure changes in a selected
range of crime and harm indicators under the three policing conditions. Our results show that macro-level disruptions to drug
supply have a limited impact on street-level market dynamics when there is a ready replacement drug. By contrast, street-level
police interventions are shown to vary in their capacity to alter drug market dynamics. Importantly, our laboratory abstraction
of problem-orientated policing is shown to be the optimal strategy to disrupt street-level injecting-drug markets, reduce
crimes and minimize harm, regardless of the type of drug being supplied to the market.
