论中国劳动争议处理机制的完善

当前，中国劳动争议处理机制的完善问题面临着两方面的挑战：全球“强资本、弱劳工”的整体性劳资格局，加剧了中国劳动者的弱势地位；以跨国公司为代表的强资本消解了主权国家对资本的中立性及国家对资本的有效约束能力，构成了对国家的主体性侵害。由此决定了我国原有的劳动争议处理机制的立法初衷无法实现。《劳动争议调解仲裁法》的出台，标志着国家为应对全球化挑战而在劳动争议领域实现了调整策略的的自我转变——由国家主导劳动争议解决的“统治型”（government）向引导多元社会力量共同参与的“治理型”（governance）转变。

运动技术风格是现代运动竞技取胜的关键因素,传统意义的认识存在一定的片面性,影响运动训练实践。本文从项群、竞技能力联合作用机制等多角度探讨运动员技术风格的形成因素,从而为改进和提高运动训练质量服务。     

The Rational Mastery in the Work of Cornelius Castoriadis*

In this article, I make the claim that the notion of rational mastery in the work of Cornelius Castoriadis is of outmost importance for fully understanding his philosophy. Yet, this notion has largely been ignored by the literature thus far. For this reason, I intend to highlight here the importance it assumes in Castoriadis’ philosophy. To this end, I argue that the notion of rational mastery in Castoriadis’ philosophy consists in an imaginary signification of progress that develops from modernity onwards in the form of unlimited expansion of technology and economy. I continue by presenting Castoriadis’ criticism of rational mastery. I then expand his criticism into the broader context of what I claim to be the social-historical perspectivism of Castoriadis’ logic-ontology of Magmas. Finally, I conclude with the demonstration of Castoriadis’ project of individual and collective autonomy as the counterweight to rational mastery of unlimited expansion of technology and economy against nature and society.     

中国公务员绩效薪酬改革前瞻

为提高公务员和行政组织的效率,中国有必要实施公务员绩效薪酬改革。实施绩效薪酬符合功绩制的要求,可以有效破除官僚主义、提高行政效率以及革除"官本位"思想观念,但在实施过程中,也面临着绩效考核指标难以准确界定,绩效考核过程和结果难以做到客观公正,不利于团队协作精神的发扬以及损害公务员的内在工作动机和行政机构的公共使命等一系列困难和问题。可以通过准确确定绩效薪酬改革的方向,合理限定绩效薪酬实施的范围,恰当规定绩效薪酬实施的比例与方式等措施,妥善处理和有效克服上述困难和问题。     

Citizen Advisory Committees: A Tool to Remedy the Shortcomings of the Contingent Valuation Method Within the System of Multi-Level Governance

The Contingent Valuation Method (CVM) is an economic analysis tool used to measure the utility of producing of public goods, based upon individual’s declared preferences. The public decision-maker is thus able to arbitrate between the expenditure to be made. The approach has been deployed in a centralist conceptual plan, leaving little room for citizens in the decision-making process and it has been undermined by the rise in power, notably in Europe, of multi-level governance. The decision-maker is no longer alone in this process and public decision-making must operate on the basis of common views adopted by various levels of government that should also establish much stronger links with the citizen-users of public goods. This article analyzes the operational impact of Citizen Advisory Committees (CAC) as participative tools of CVM that result in an effective cooperation between the various public actors and the civil society in public decision-making.     

Asset Ownership and Future Orientation of Youth and Their Parents: Evidence From Ghana

Although future orientation influences a variety of desirable behaviors, few studies have examined the relationship between economic resources and future orientation. In this study, we investigated whether and how asset ownership influences future orientation. We analyzed survey data collected from 3,007 Ghanaian youth and their parents. We used factor analysis to determine the psychometric qualities of our instruments, and propensity score analysis to examine the relationship between asset ownership and future orientation. Results suggest that asset ownership influences future orientation of youth and their parents. However, the direction of the relationship depends on the type of asset. Ownership of household possessions, including televisions contributes to higher levels of future orientation, but livestock ownership has a negative effect on future orientation. We discuss implications for future research, as well as programs for youth and their families.     

多发性街面犯罪新动向及其因应策略

以抢劫、抢夺、盗窃、扒窃、拎包、诈骗等为内容的多发性街面犯罪,近年来呈现高发势头,特别是犯罪主体与波及区域扩大以及危害程度加深动向,令人触目惊心,已经构成城市社会和谐的严重威胁。导致街面犯罪高发的因素是多方面的,既有社会转型期城乡、贫富差距等一些本源性问题促使,也有法律制约和警务管理等外在因素影响。因此,重视民生、完善制度、发展经济、充分就业、健全社会保障是根本的解决办法,而健全法律体系、强化警务防范与打击力度,则可以压缩街面犯罪空间,促使不法分子放弃犯罪并走向合法道路。

从罪过情感看理论与实践的脱节

尽管传统罪过理论阙如情感因素,但它并没有严重影响到刑事立法的合理诉求和刑事司法的现实运行,却表明了刑法的罪过理论已经落后于刑事实践.一方面,罪过情感在刑事立法和刑事司法中有所体现或得到了适当的考虑;另一方面,情感因素在罪过理论之中却没有任何名分,或者没有取得应有的地位.只有充分认识这一问题,才能在刑事实践中走向自觉,也才能够明确完善罪过理论的方向.
