Exploring a New View： Judicial Activism of Justice Attestation Quantitative Analysis fromPerspective of Procedure

随着社会经济的迅速发展，司法实践对法官能力提出了更高的要求。赋予法官司法能动权，改变传统的司法运行模式，不仅需要在刑事诉讼中营造有助于法官能动性发挥的外部环境，还要探寻激励法官能力提升的内在因素。刑事认证程序是法官发挥司法能动性的重要领域，通过对这一阶段法官心证的定量化分析，可以直观掌握不同因素影响法官司法能动性发挥的现状，进而采用合理搭配各学历层次法官比例、优化法院内部考核及选任方式、培养法官整体性思维等方式提升法官能动性的发挥。     

不同纸张上浓重红色印泥手印减薄的技术研究

目的建立有效的显现纸张上浓重的印泥手印方法。方法对普通材料纸和打印纸上的浓重红色印泥手印，通过指纹胶带提取转印、氧化漂白减薄、有机溶剂溶解减薄3种技术方法的减薄效果以及它们在减薄过程中的优缺点进行比较，得出适合于各种减薄技术的最佳试剂。结果本研究发现3种方法均可以有效地使浓重红色印泥手印清晰化，进而达到有效显现纸张上浓重的印泥手印的目的。     

论法律理论的方法及其性质——基于分析法理学的视角

在从事具体的法律理论工作之前,我们必须澄清围绕在法律理论四周的种种误解,确立恰当的研究方法以及厘清法律理论的性质。从分析法理学的视角来看,法律的概念分析就是对法律之本质的探究。分析法理学这一方法论的基本论题需从以下四个方面来理解:一是法律的概念分析不是对法律概念的语义分析;二是概念分析是对法律之必然属性的探究,是对法律这种特定制度性类型的探究,从根本上讲,这是对属于我们的法律概念之自我理解;三是一种合格的法律理论只能是评价性或证立性的;四是法律理论的普遍性不仅不排斥地方性,而且要以地方性为出发点。

A Comparative Study of Nonprofit and For-Profit Web-Based Issue Advocacy

Abstract

Using the Web to advocate positions and actions on public issues is an emerging and potentially powerful means of shaping public opinion and action. Building on studies of Web advocacy in the political sector, this research employs content analysis to examine Web-based advocacy by U.S. for-profit and nonprofit organizations. For-profit organizations were found to engage in much more Web advocacy than nonprofit organizations. Those organizations that did engage in extensive advocacy, or were committed to multiple social values, appear to have come to adopt these postures or activities consistent with what a cost-benefit analysis of the impact on their enterprise would predict. With respect to region, the Northeast and South evidenced a higher and lower pattern of advocacy, respectively. Finally, greater financial resources predicted more extensive advocacy content generally; the particular issue areas this study examined were community focus, charitable causes, environmental issues, and diversity.     

有限责任内涵的实证分析——一种公司损失分摊的法律规则

有限责任既不是公司的法律责任,也不是股东的法律责任,而是一种公司损失的分摊规则。从实证角度分析,有限责任是股东分摊公司"有限损失"的一种制度设计。根据有限责任规则,股东对公司损失实行"定额分摊",而社会﹙主要但不限于债权人﹚则实行"余额分摊"。鉴于公司损失涉及到社会分摊问题,公司不仅是"利益共同体",也是"损失共同体",这是公司相关制度刚性设计的基础。

侵犯知识产权的损害赔偿责任中,学界对如何确定损害数额存在着一定讨论。通过供需曲线这一经济学的基本方法对损害进行确定,具有直观、明确、简洁等优势,同时我们也可以发现我国目前在界定侵犯知识产权损害过程中的各种不当之处。     

Underdevelopment,Urban Squatting,and The State Bureaucracy: A Case Study of Tanzania

This article investigates a part of the “story of the story” of the 1924 revolution, the first popular anticolonial uprising in Sudan to be framed by a nationalist ideology. Considering that the process that turns a past event into history is neither linear nor predictable, I draw on Trouillot's “catalogue of silences” to compare two sets of sources that correspond to two moments in the making of 1924 as history: first, the judicial records produced by the Sudan government during 1924, and second the Ewart Report, written in 1925, to “seal” the revolution. A comparison of these two sources reveals radical discrepancies in the narrative, as well as the silences imposed on and well-concealed fine-tunings of the various voices of the revolution. Of these two sets of sources, it is the Ewart Report that provides the most influential interpretation of the 1924 revolution.
