大学教师聘任制的合约性质、制度功能及其政策含义

大学教师聘任制就是大学组织与作为知识生产要素所有者的教师(教师应聘者)之间的一种合约安排,具有一般劳动交易合约的基本特征,但由于信息难题和知识产品的特性,教师聘任合约的性质更为复杂。我国的大学教师聘任制承担了人才筛选、生存激励与改革的政策工具等功能。聘任合约中的岗位设置、聘用程序控制与期限设计等三个主要结构性因素在节约相关交易成本方面具有改进教师聘用效率的政策激励效应。     

司法鉴定特性及鉴定体制改革的构想

随着科学技术的迅猛发展和法制力度的增强,繁重的司法鉴定与我国目前鉴定体制出现了诸多不相适应的问题,迫切需要改革和完善。需要我们从本质上认识和思考司法鉴定的特性和特点,建立一套符合司法鉴定规律的鉴定体系。

技术创新生态化有保护生态环境和促进经济发展的双重使命 ,是技术创新的方向。本文在论述技术创新生态化概念的基础上 ,提出并比较详细地论述了保障和促进技术创新生态化的四种法律制度安排即政府推动制度、市场拉动制度、公众参与制度和国际合作制度。     

The two Koreas’ societies reflected in stamps

The stamp is “an arena for conveying every possible kind of message through pictures”. Since stamp motives are not chosen arbitrarily, this study considers what stamps issued by North and South Korea since their foundation in 1948 tell about these states. Firstly, the number of stamps made by each state from 1948 until 2002 is investigated. This time is divided into ten-year periods. Conclusions are drawn from the number of stamps made. Secondly, the motives are investigated in detail. Eight motives—commemoratives, history, famous persons, culture, politics, economics, nature and miscellaneous are identified. Quantitative data on the motives are presented in tables that are followed by facts about the issues. Thirdly, the main findings are presented on a general level and under the motives identified. Implications of the motives on North and South Korean stamps are discussed and similarities and differences are highlighted.

论新闻监督司法的制度设置

为了将新闻监督司法的负面影响降低到最小的限度,应该从制度上对新闻媒体监督司法加以完善:首先,健全新闻舆论的监督环境,畅通新闻监督司法的渠道;其次,为新闻监督司法设置合理的界限,明确规定新闻媒体在报道案情、发表评论时应该遵循的相关规则;最后,如果新闻媒体的报道和评论确实可能妨碍案件的公正审理的,法院可以作出延期审理、异地审判、发布禁止报道的命令以及启动审判监督程序等措施予以补救。     

我国政治文明建设的制度取向

我国政治文明建设应该以制度建设为着力点和目的导向。因为,政治文明在本质上就是人类对有规则的、公正的社会生活的追求,政治文明建设的实质是政治制度文明的建设。而且,我国已开始进入“制度建设主导型政治发展”时期。因此,我国政治文明建设就必然是以民主宪政建设为核心的各项政治制度的建立与健全。

大陆第一个志愿团体--深圳市义务工作联合会的发展对社会转型具有重要的意义,包括志愿服务的协调功能、培育功能、扶持功能等.志愿服务的创新发展包括法制创新、体制创新、服务创新和网络创新.这些经验不仅对中国内地发展志愿服务具有借鉴价值,而且成为全世界义务工作发展中的一个特色,具有参考意义.     

行政程序法治观与行政许可透明度——从制度创新努力看建设阳光政府的方向

必须摒弃神秘主义行政文化传统观念,树立阳光行政和行政程序法治观念,推动提升行政透明度的民主化转型;《行政许可法》、《政府信息公开条例》等法律文件对行政程序透明和阳光政府建设提出了要求、创造了条件;在实践中,许多地方和部门积极开展行政程序公开、政府信息公开、公众参与管理、完善监督救济和创设服务中心等方面的探索创新,天津、成都、邯郸等地的改革经验值得研究借鉴;建设阳光政府的进一步努力,需要充分发挥地方的主动性、积极性和创造性。     

Worth Restoring? Taking Stock of the Northern Ireland Assembly

The ongoing and almost record‐breaking hiatus in devolved government in Northern Ireland has brought the sustainability of the region's Assembly into sharp focus. As parties in Northern Ireland consider their options for restoring (and possibly reforming) the devolved institutions, this article takes stock of the Northern Ireland Assembly's merits and demerits. It is argued that, amidst the public's understandable exasperation with the current stalemate, it is easy to forget that the Assembly operated for a decade without suspension (2007–2017) and performed some functions reasonably well. This, of course, is not to detract from the institution's serious shortcomings, though it is argued that the worst of these could be mitigated via institutional reform. Crucially, institutional inertia is not an option. Should parties fail to address the need for institutional reform, commentators may well be right to question whether the Assembly is worth restoring.
