我国法官角色实际上是一个复杂的角色丛。法官角色多元性导致了法官常会同时受到多种社会角色规范的调整与制约,导致其裁判行为往往围绕着“了断纠纷”展开,努力以“案结事了”结束,而不过分在乎是不是能够呈现完美的“规则之制”。这一法官角色视野下的裁判现象所呈现出的裁判理性,彰显了一种正在东方与西方的法律文化之间穿行超越的裁判理性,表现为裁判文化的融合;揭露了一种仍在传统模式与现代格式之间彷徨徘徊的裁判理性,表现为裁判方式的转变;昭示了一种正艰难地在工具理性与价值理性之间选择取舍的裁判理性,表现为裁判价值的重构。 相似文献

Suicidal insulin overdoses are an under‐recognized and uncommon cause of death, often relying on scene and nonspecific autopsy findings. Here, we present a case report of a fatal exogenous insulin overdose in a patient with type 1 diabetes. In our case, there were no contributory autopsy findings; however, serum analog aspart insulin levels were c. 10× the predicted therapeutic upper limit (4000, reference 6.6–55 uU/mL), which correlated with scene findings. This was specifically determined by a newly developed immunocapture liquid chromatography–tandem mass spectrometry assay, able to discriminate between various synthetic insulin analogs. Total insulin levels by immunoassay were highly elevated on the Siemens Advia Centaur, but not the Roche platforms (4741 vs. 5.2 uU/mL, respectively), showing variable sensitivity of detection within the same analog depending on assay. We discuss the prevalence and features to look for at autopsy in these types of cases. Additionally, analytical options for testing insulin levels, including new methodologies, guidance on collection of samples, as well as an outline of available historical reference range data are discussed. 相似文献

During the European debt crisis, numerous states launched austerity programmes. The International Monetary Fund (IMF) evaluates and forecasts the likelihood of member states’ success in implementing these programmes. Although IMF evaluations influence country risk perceptions on capital markets, little is known about their reasoning. This article uses fuzzy‐set qualitative comparative analysis (fsQCA) to explore on what grounds the IMF evaluated the success prospects of austerity programmes during the European debt crisis. Results reveal that IMF evaluations are heavily influenced by the programme's implementation credibility. They require a tractable policy problem, a country's institutional capacity to structure implementation, and favour expenditure reduction over revenue measures. By acting as a strict guide on the road to fiscal adjustment, the IMF indirectly influences member states’ scope of policy making through its surveillance activities. Extensive austerity programmes that need to be implemented swiftly are evaluated negatively if the country is not involved in an IMF programme. 相似文献

With the recession in full swing and a declining global economy, the Court of Appeal in Myerson v. Myerson [2009] EWCA Civ 282 was asked to consider whether significant changes in the value of matrimonial assets, following the onset of the credit crunch, should be seen to be a sufficient reason for setting aside a divorce settlement and dealing afresh with financial matters. In their much-anticipated judgment, the Court made it resoundingly clear that a reduction in the value of assets as part of what was described as the ‘natural processes of price fluctuation’ did not satisfy the legal test for a change in a settlement. Thereby, they failed to provide relief to those who, in more stable times, had formed settlements involving risk-laden assets. The Court restated current law under which judges are reluctant to reopen orders in all but the most exceptional of circumstances and preserved the obscure nature of the successful Barder, showing determination to adhere to the principles of certainty and finality even in these difficult times. This commentary will proceed to examine the Court's reasoning for adopting such an approach and the cautionary message that their ruling sends out to credit-crunched individuals attempting to reopen their divorce settlements. 相似文献

将35只Wistar大鼠随机分成高血压组(10只)、牛磺酸组(12只)和对照组(13只)。高血压组大鼠饮水中加入200g/L果糖使其成为胰岛素抵抗高血压模型,牛磺酸组大鼠饮水中加入200g/L果糖和10mL/L牛磺酸,对照组大鼠饮用自来水。测量各组大鼠血压、血糖水平及血浆胰岛素、一氧化氮、血管紧张素Ⅱ、内皮素1、总胆固醇、高密度脂蛋白含量,并用李氏法计算胰岛素敏感指数。结果表明,果糖使高血压组大鼠血压升高,血糖、胰岛素血管紧张素Ⅱ、内皮素1、总胆固醇含量显著增加,一氧化氮和高密度脂蛋白含量显著降低;牛磺酸可明显逆转上述改变,提高胰岛素敏感指数。 相似文献
