It notes the limitations, as well as the possibilities,of wikis and explains how they work in practice. It outlinesthree recent examples of wikis in the IP world, explaining howthey work and the significance of their overall objectives. Practical significance: The adoption of this technology by official bodies suggestswider future use and the appearance of unofficial sites showsthat current developments have already reached a stage wheremany IP practitioners can begin to interact and share knowledgein a way that has not been considered previously. It is conceivablethat developments in this area will be rapid and it is in theinterests of users to familiarize themselves with the use ofthis new ‘social software’.     

论保险代位求偿权行使的权利限制

保险代位求偿权虽然为保险人的一项法定权利,但并不意味着其行使该权利不受任何限制.首先,保险人因为弃权在行使代位求偿权时权利受到一定限制及至丧失该权利;第二,第三人可依法定事由或约定事由向保险人行使抗辩权;第三,对第三人加以限定会使保险人的代位求偿权受限;第四,保险人的代位求偿权不绝对排斥被保险人对第三人的损害赔偿请求权;最后,被保险人在代位权诉讼中优先于保险人受偿.     

THE GOODS AND SERVICES DIRECTIVE: LIMITATIONS AND OPPORTUNITIES

The Goods and Services Directive adopted in December 2004 is the very first European Community instrument to implement the principle of gender equality outside the workplace. As such it has the potential to close an important gap in European Union law. This note, however, contends that the limited scope of application of the Directive, together with doubts surrounding its legal base and position within the overall gender equality framework of the Union, have significantly undermined its potential. Nevertheless, it is suggested that for the future, should these criticisms be adequately addressed, then the Directive may provide an important platform for the wider diffusion of the gender equality principle beyond the sphere of European employment law. Council Directive 2004/113/EC of 13 December 2004 implementing the principle of equal treatment between men and women in the access to and supply of goods and services OJ L373 (2004) 37     

交通事故社会救助基金立法的若干问题

今年初国务院法制办发布《机动车第三者责任强制保险条例(草案)》,向社会公开征求意见。该草案用四个条文规定了交通事故社会救助基金,但这些规定的立法科学性尚需斟酌,并且许多重要问题未作规定。应就基金的性质、法律地位、运行模式、来源、补偿、代位追偿及竞合关系处理等问题,系统、科学地进行立法。

基金收支按照筹资模式和养老金计发模式的不同组合,可以组成9种基金收支模式.利率对某种基金收支模式的基金平衡的影响取决于利率对基金收入的影响和利率对基金支出的影响的和的影响.在我国"统账结合"和部分积累的基金收支模式下,按平均工资一定比例计发的养老金和按个人账户储存额一定比例计发的养老金的适当组合,可以把利率对基金收支平衡的影响减到最小.     

论保险合同的成立

本文针对我国保险领域里对保险合同的成立问题所存在的一些模糊认识 ,运用合同法的基本理论 ,论述了保险合同 (包括海上保险合同 )的成立要件 ,并提出了判定保险合同是否成立的三项原则。文章还就当前我国所出现的保险营销员的特殊现象 ,阐述了此种现象对保险合同成立的影响 ,并发表了自己的意见。
