Cohabitation and the Law Commission’s Project

In 2004, the U.K. parliament passed the Civil Partnership Act which provides a scheme to enable same-sex couples to obtain formal recognition of their relationships through the registration of a civil partnership. When the Civil Partnership Bill was making its way through parliament, attempts were made in the House of Lords to derail the Bill through amendments seeking to extend the Bill to certain familial relationships of care and support. In order to counter these attempts and to facilitate the removal of the amendments, the government gave the assurance that the matter of the economically vulnerable cohabitant would be referred back to the Law Commission for England and Wales for review. Consequently, in July 2005, the Law Commission commenced its project on cohabitation. This paper seeks to examine models of reform (such as the one proposed by the Law Society of England and Wales in its 2002 Cohabitation report) as well as those introduced in other Commonwealth countries. The aim is to identify some of the crucial questions that the Law Commission will need to give careful consideration to if they are to make recommendations that will provide a more radical approach to this area of the law, rather than adopt the more conservative approach of including cohabitation in ‘piggy back’ mode on the marriage model.

社会保护政策框架下的城市反贫困战略与传统的“安全网”政策最大的区别是：将贫困的暂时性救济与彻底摆脱贫困的长期性努力结合起来，兼顾社会公平与经济增长，因此被视为适合发展中国家的反贫困政策框架，并在国际非营利机构的影响下在世界范围内传播，中国经济、社会转型产生的城市贫困人群，面临多重风险。在“改善民生”的政策主题下，深化改革社会保障政策体系的实践正在各个领域展开，社会保护政策框架不仅能够透视这一系列实践的本色，也为款来的改进与完善指明了路径。     

The Insurance Act 2015: Rebalancing the Interests of Insurer and Assured

The Insurance Act 2015 is the first piece of legislation since the eighteenth century to seek to lay down new principles governing the formation and operation of insurance contracts. Exactly 250 years after Lord Mansfield articulated the routinely‐cited principle of utmost good faith in insurance law in Carter v Boehm (1766) 2 Burr 1905, that principle has been recast, with important implications for both the pre‐ and post‐contractual duties of the parties. The Insurance Act has also imposed important restrictions on the enforcement of policy terms by insurers, and clarifies the law affecting fraudulent claims. The Marine Insurance Act 1906, a codifying measure, looks increasingly outmoded.     

Explaining Levels of Local Government Involvement in Service Delivery: The Dynamics of Cross‐Sector Partnerships in Malawi

This study explores how local governments and their development partners—that is, donors, non‐governmental organisations and private companies—structure their partnerships as they work together to provide services to communities. Cases of collaboration between four organisations working in the rural water supply sector and six local governments in Malawi are studied. Using a cross‐case qualitative methodology, we illustrate how power and control translate into practices, leading to different levels of local government involvement in service delivery. This study contributes to the literature on cross‐sector partnerships in particular by developing empirically‐based propositions that help explain the dynamic trajectories that partnerships between local governments and their development partners can take. 城市“两不靠”老年群体养老保障问题研究——以福州市为例

"两不靠"指靠不上享受退休金,又不符合低保条件,依靠自己年轻时积蓄或子女提供经济支持养老的老年人群体。本文围绕这一群体社会保障的现状进行讨论,提出解决思路:养老保障拟制订一次性缴款设立个人养老账户,通过政府补贴方式发给养老金;医疗保障拟单列管理,提高补贴额、放宽门诊报销范围。通过以上办法解决两不靠群体的社会保障问题,使他们共享改革开放成果。     

我国多层次社会保障体系内部影响:促进还是抑制?

习近平在党的十九大报告中做出了全面建成多层次社会保障体系的战略部署,各层次之间的影响机制值得研究。基于政策反馈理论发现,一个层次可以通过两个平行的中介机制影响另一个层次,具体表现为:解释效应,行动者对层次Ⅰ的认知影响他对层次Ⅱ的认知,继而影响行动意愿;资源效应,行动者在层次Ⅰ的资源变化影响他在层次Ⅱ的预算,继而影响行动能力。以2008-2015年A股上市公司为样本,检验社会保险影响补充保险的双重中介机制。结果显示:基本养老保险通过解释效应促进企业年金参保和缴费,通过资源效应抑制企业年金参保;基本医疗保险通过解释效应促进补充医疗保险参保和缴费,没有显著的资源效应;社会保险对补充保险既有推动作用也有抑制作用。建议科学评估社会保障体系各层次之间的解释效应和资源效应,规避相互挤出,从解释效应和资源效应两面着手推动多层次社会保障体系的完善。     

强制汽车责任保险之保险人责任性质探讨——兼评《机动车交通事故责任强制保险条例》第21条之不足

强制汽车责任保险中的保险人承担的是何种责任,学术界一直争论不休。实际上,保险人的责任应为合同义务,保险人责任一词本身并不科学。而产生这一用语并导致诸多争端的正是我国刚实施不久的《机动车交通事故责任强制保险条例》中的相关规定。解决这一问题的办法是借鉴他国先进立法,将侵权制度与责任保险制度明确分离。     

海外投资保险制度立法的思考

海外投资保险法是对海外投资进行保护、促进和规范的有效法律手段,我国应当借鉴他国经验尽快建立海外投资保险法律制度。结合海外投资保险的性质特点、国外的经验和我国的资本发展的现状和趋势,我国应以海外投资保险体制、保险范围、投资承保的条件和海外投资保险机制等四个方面加强海外投资保险方法。
