Judicial Power Evolution in the Era of Artificial Intelligence

The judicial power in the era of artificial intelligence is facing major stimuli and influences from the results of the information revolution such as big data, cloud computing, and blocks chain. Chinas judicial power theory urgently needs to construct a new ideal picture in the era of artificial intelligence. With regard to the application of laws and the determination of facts, artificial intelligence introduces the thinking method of related relations into the decision-making of judges, and realizes the “same judgment with the same case” through a large database, and leads to the judicial power from passive exercise to active appearance. In the pursuit of justice value and efficiency of justice, the application of artificial intelligence will bring a sharp reduction in judicial costs, an exponential improvement in judicial efficiency, a re-examination of judicial justice, and an intelligent construction of the main body of referees. In the judicial system and technical constraints, the hard constraints of information technology will replace the soft norms of the judicial system. We can use block chain technology to upgrade the witness protection system and try to construct the pre-trial risk assessment system.

“Internet plus social work” as a new way to enhance social governance capability is changing the traditional paradigm of social governance. It responds to the new demand of improving social governance ability and realizes the organic fit with the new demand of social governance. Internet plus social work can expand the field of multi cooperation, seamless links of various service resources, rich and varied welfare service carriers, intelligent upgrading of professional help means, and continuous improvement of social governance performance. In the face of the new challenges in the intelligent era, social work departments need to timely reshape their behavior patterns and change their professional roles: first, they should highlight co construction and co-governance and sharing, and turn from individual to collaborative innovation; second, they should emphasize fast, flexible and accurate, from behavior suspension to scientific intervention; third, they should upgrade the way of resource linking, from simple emergency to seamless docking; fourth, they should reshape professional relationship network, from estrangement to professional follow-up; fifth, they should advocate multiple cooperation from single line down to compound intelligence. In the new era, internet plus social work must adhere to the orientation of intelligent upgrading, integrate technology variables into the mechanism, methods, procedures, resources and brands of professional intervention, and constantly make new breakthroughs in top level design, building new mechanisms, innovative service methods, developing new social governance procedures, new resources linkage and new brand development.

Modeling Forensic DNA Database Performance*

Abstract: Over the past decade or more, DNA databases have been a focal point of development for the forensic field. Using this approach, forensic and law enforcement agencies have aided millions of investigations, many of which would remain unsolved but for the intelligence links provided from DNA database comparison. However, despite their widespread use and increasingly broad legislative and operational reach, there has been limited overarching performance modeling or reflection on drivers of operational or financial efficiency. This study derives an inferential model for DNA database performance using data from major national DNA database programs. Parameters that optimize desirable database outputs (matches) are isolated and discussed, as is an approach for maximizing financial efficiency and minimizing ethical impact. This research takes important steps toward identifying measures of performance for forensic DNA database operations.

Intelligence,reason of state and the art of governing risk and opportunity in early modern Europe

Abstract

Drawing upon primary and secondary historical material, this paper explores the role of intelligence in early modern government. It focuses upon developments in seventeenth- and early-eighteenth-century England, a site-specific genealogical moment in the broader history of state power/knowledges. Addressing a tendency in Foucauldian work to neglect pre-eighteenth-century governance, the analysis reveals a set of interrelated processes which gave rise to an innovative technique for anticipating hazard and opportunity for the state. At the intersection of raison d’État, the evolving art of government, widespread routines of secrecy and a post-Westphalia field of European competition and exchange, intelligence was imagined as a fundamental solution to the concurrent problems of ensuring peace and stability while improving state forces. In the administrative offices of the English Secretary of State, an assemblage of complex and interrelated procedures sought to produce and manipulate information in ways which exposed both possible risks to the state and potential opportunities for expansion and gain. As this suggests, the art of intelligence played an important if largely unacknowledged role in the formation and growth of the early modern state. Ensuring strategic advantage over rivals, intelligence also limited the ability of England's neighbours to dominate trade, control the seas and master the colonies, functioning as a constitutive feature of European balance and equilibrium. As the analysis concludes, understanding intelligence as a form of governmental technique – a way of doing something – reveals an entirely novel way of thinking about and investigating its myriad (historical and contemporary) formations.

情报分析与应用初探

在信息化高度发达的今天,面对海量的信息如何做到更有效率的应用是情报工作的目标,同样也是本文所要关注的重点。第一部分在情报分析与动态应用概念介绍的基础,解释了文章的基本构想;第二部分介绍了我国的警察工作和情报应用的现状,说明正是现实的需要使得警用情报工作实现突破、建立独立的情报分析部门成为必要;第三部分文章列举了在当前条件下成立独立情报分析部门的种种条件已经具备,最初的设想具有了现实可能性;最后笔者结合我国现有的条件提出了建立独立情报分析部门的设计,希望能够提出一种一般型模式为将来我国情报分析部门的建立提供理论上的支持。
